In accordance with the Commission's request I have discussed the extension of Orchard Hill Drive with the Police Chief and Fire Chief. Chief Crombie and Chief Kerrigan both agree that the extension of Orchard Hill Drive through to Avery Street would be advantageous to their respective public safety functions. As you know, the Town does not have any through streets between Oakland Road and Beelzebub Road. The completion of Orchard Hill Drive, from Foster Street to Avery Street, improves public safety response times and improves the Town highway network for the movement of inter-town traffic. It is my recommendation, based on the above comments, that the Commission require the construction of Orchard Hill Drive to Avery Street as a condition of approval for the Maple Ridge subdivision plan. The Engineering Department will recommend that all previous conditions of the Planning and Zoning Commission's letter of approval, dated June 27, 1973, have to be fulfilled. Also, because of the critical problems in the Avery Brook area regarding drainage, you should have your engineer perform a study showing the following: 1. Estimate the current water flow in the brook into which the drainage for your subdivision will be discharged. 2. Estimate- the proposed water flow in this brook after the construction of your subdivision. 3. Your engineer should provide me with his evaluation of items 1 and 2 on the downstream area, including culverts to a point just east of Pine Tree Lane where the brook discharges into a pond. We will be happy to assist your engineer in any manner he wishes. Please contact me at any time regarding these matters. Very truly yours, J. E. Page Planning-Engineer Coordinator JEPfsrc cc: Mir. Very truly yours, Y-yron Feinstein Associates Charles T.utton, P.E. cc : "r. Director cif '.Public 7.:ork_s E. Grace, C:airrn(n Flanning Pnd Zcrir_:r Col-imission MEMORANDUM TO: Planning and Zoning Commission RE: Maple Ridge Subdivision DATE: February 13, 1974 Because of a possible conflict of interest, the firm of Griswold and Fuss, Inc. has taken the position that it would be unwise for them to evaluate the potential storm water drainage problems for the Town from the proposed Maple Ridge Subdivision. I fully respect and agree with this position. Therefore, using a method similar to what Griswold and Fuss Inc. is proposing for the Town Storm Water Drainage Criteria, I have made an analysis and the following comments are offered: 1. The total Avery Brook Watershed contains about 1500 acres. The tributary brook that the storm water from this subdivision drains into handles about 100 acres at the intersection of Avery Street. This subdivision contains 13.5 acres. 2. The effect that this subdivision will have on the total Avery Brook Watershed is minimal. However, the effects on the tributary are not minimal, and the following recommendations are made: a. The storm water drainage from this tributdry brook is now 150 c.f.s. for a 50-year storm at the intersection. on Avery Street. The storm water drainage will increase to 160 c.f.s. after this subdivision is built at the above location. The twin 36 inch pipes under Avery Street can handle about 120 c.f.s. with a five foot head. Therefore, the storm water drainage system from this subdivision shall be modified at the outfall. The storm water manhole shall be moved as shown on plans and a 30 inch pipe shall be directed under Avery Street to outfall east of Avery Street near the existing 36 inch pipes. A 30 inch pipe can carry about 45 c.f.s. , which will enable the three culverts under Avery Street to handle 165 c.f.s. , which is essentially the flow from a 50-year storm. b. The drainage system shall also be modified at the inter- section of Orchard Hill Drive and Avery Street to capture storm water from Avery Street and to prevent storm water from running into Avery Street from Orchard Hill Drive. Double catch basins should be added to each side of Orchard Hill Drive at the intersection and the storm manhole moved as indicated before and shown on drawings. Planning and Zoning Commission -2- February 13, 1974 c. The 60 inch pipes at Benedict Drive and Pine Tree Lane can handle 140 c.f.s. These pipes are undersized and clogged with silt and it is anticipated that twin 36 inch pipes will be added at each location in the future. These twin 36 inch pipes would raise the flow capacity to 260 c.f.s. and would give a margin of safety in this area. The costs for these installations are estimated to be about $7200. The proposed subdivisio:= of 13.5 acres out of 1.20 acres should be charged an $800. downstream assessment fee fortheir share of these downstream improvements. 3. The sanitary sewer plans, specifications and appropriate design information should be submitted to the Director, Water Compliance and Hazardous Substances, Department of Environmental Protection as requested in their letter dated January 15, 1974. 4. The following work shall be done before any building permits are issued for the lots south of Orchard Hill Drive (lots 7-11)... a. The storm system shall be installed from the outfall to the catch basins, which are about 40 feet from the intersection of Avery Street. b. The street shall be brought to grade. c. The street shall have the binder installed from the inter- section to a point about 50 feet west of these catch basins. d. Baled hay shall be installed upstream of these catch basins as outlined on page 5.38 of the U.S.C.S. Erosion and Sediment Control Handbook and as directed by the Planning-Engineer Coordinator. In addition to the above recommendations, all conditions of approval in the letter of June 27, 1973 should be made before final approval is given. `1J. E. Prior to approving this subdivision, the Commission reviewed the drainage situation in this area in detail. The Commission recognizes that this is a very sensitive area, and we understand that steps have been started to enable the Town to clean the tributary brook and at some future date to install the proposed additional culverts at Benedict Drive and Pine Tree Lane. In order to help improve the drainage affects from this proposed subdivision, a downstream assessment fee in the amount of $800 will be charged to cover this subdivision's share of the downstream improvements as indicated in Condition #7 of the enclosed letter. Because of the critical nature of Avery Brook regarding silting and flooding, you will comply with the Planning and Zoning Commission's letter of approval, dated February 21, 1974. You will make every reasonable effort to comply with the Soil and Water Conservation Service letter on Conservation Practices, dated March 14, 19742 which is enclosed. The performance bond which is on file in South Windsor clearly guarantees you compliance with the above requirements. 2. The storm water drainage outfall east of Avery Street, as shown on plans by Griswold and Fuss, Inc., will be completed by June 1, 1974. Rip-rap shall be placed on the north side of the brook for a distance of 20 feet from the outfall and shall extend from the top of the bank to the brook flow line. Grace, Chairman . Planning and Zoning Commission Town Hall South Windsor, Connecticut 06074 Dear Bill: On Friday, July 5th, I had occasion to stand in the rain on Avery Street where the headwall was constructed at the outlet to the storm sewer con- duit for the extension of Orchard Hill Drive. With me at that time was the home owner who had approached the Council some- weeks ago about his con- cern that the construction to that inlet to Avery Brook would cause serious damage to his property. At the time of his contact with the Council, I was distressed that we did not have some prior knowledge of that activity affecting the very sensitive Avery Brook problem, and I later found no relief from advice concerning precautions being taken. The torrents of water that came through that headwall demolished the minimal rip rap that had been put in place, endangered the driveway area and par- tially washed away soil surrounding several trees. I fully anticipate that this home owner will appear again before some governmental agency to voice his concern and to present photographs which he took during the course of the storm. It is my feeling that the conditions set down for the construc- tion of this drainage area were not tough enough and that appropriate pro- tection for adjacent land areas was insufficient for the type of water flow that could be anticipated. The flow of water from the storm sewers on the uncompleted Orchard Hill Drive was less than it would have been had there been a paved surface. In spite of that, a tremendous flow occurred and considerable damage resulted. I request that the Planning and Zoning Commission re-examine their activities in regard to this drainage matter and suggest that an early contact be made with the land owner principally affected, which might reduce problems for both• your Commission and the Town Council. Certainly a better solution is required than the one utilized up t-o this point. Since this item is a sen- sitive one, I would appreciate being kept advised of remedial action. Fitts Town of South Windsor Town Hall South Windsor, Connecticut 06074 Dear Hap: In answer to your letter of July 8, 1974 to the Planning and Zoning Commission regarding flooding problems on Avery Street and the new extension of Orchard Hill Drive, I am enclosing copies of all pertinent information relating to the Maple Ridge Subdivision. As you can see from the enclosed information, the Planning and Zoning Commission took precautions on this 11-lot subdivision, which had been previously approved in 1965 and was brought in for review under the provisions of State Statutes. The storm on July 5, 1974 deposited approximately three to five inches of rain in a very short period of time and flooding problems were caused all over South Windsor and in many other parts of the State. The Planning and Zoning Commission is making every effort to minimize storm drainage problems in the Town; hosever, planning on paper is one thing and the developer carrying out the work properly is another. Since the storm on July 5, the developer has done the following at our insistence to minimize the flooding problems at this location: 1. An emergency swale has been constructed to prevent water from running into Avery Street. 2. The street has been brought to grade at the intersection of Avery Street and the Orchard Hill Drive extension. 3. The developer is proceeding to complete construction of the road in this area. If you should need any further information in this regard, please let me know. Very truly yours, eZ7 , RL E. Page Planning-Coordinator JEP/src cc: Mayor Robert Smith William E. Page Planning Coordinator Town Hall South Windsor, Ct. Dear Buck: I very much appreciate your letter of July 31st and the helpful material provided with it. It is clear that the Planning and Zoning Commission recognized much of the potential for downstream problems and sought to require proper safeguards. Nonetheless, there are two points that continue to disturb me. First, in an area and with a subject that is so sensitive, the Council should not be surprised. Certainly you will agree that an angry citizen at a public meeting is not the best way to find out about this matter. The second point is more serious. During the rain storm of August 4th I examined the activity below the headwall at Avery Street and found a substantial flow of water from all three pipes. The protection to the bank areas within 15-20 feet of the headwall was nearly non-existant. Flows of this nature will not be unusual; in fact, with a paved street and driveways the flow will likely increase. Where is the stonework, the rip rap, the cement, etc. to keep the bank from being wasted away by the current and volume of water entering the stream bed at that point? I did not find provisions for proper protection of this sort in the material you provided. I feel strongly that the abutting property owners should not expect the Town to approve placement of a pipe that will, without precautions, cause their property to be damaged. My concern is that the Town not contribute to further erosion at this point and that we set requirements to prevent such problems before they occur and, finally, that we do a little PR with such an affected property owner and let him know of our anticipation and planning. Please clarify for me just what is to be done in that area within 20 feet of the headwall. Some night after you have finished your gardening I'd be happy to look at the site with you. Page, Planning-Coordinator SUBJECT: Wanza's Orchard Hill Drive Subdivision DATE: April 30, 1975 I have inspected the storm water drainage outfall at Avery Street from this subdivision. There is severe erosion taking place in this area, but the erosion is mainly from the two drainage pipes that cross under Avery Street, north of Wanza's installation, that were there before Wanza did any work in this area. It is my recommendation that the erosion taking place to the north of Wanza's drainage pipes be repaired by the Town. I have talked this over with Emil Lucek, and we have concluded that this repair work could be done in the following manner: 1. A downstream assessment fee of $800 was contributed by Mr. TTanza. Some of this money could be used to buy rip-rap. Z. Summer help could be used to hand place this rip-rap in the correct place. We still hold the bond on this subdivision; and after the Town has repaired the erosion taking place from the other drainage pipes, we could then make a decision on Wanza's further responsibilities in this area. Please be advised that the Planning and Zoning Commission does not agree with your letter. The Town of South'Windsor's problem is solely with Mr. Wanza's failure to meet his obligations in this subdivision. Each of the following clearly states the Town's position: 1. Mr. Wanza has not completed Orchard Hill Drive and the surrounding area. to Town Specifications. 2. The Town has been trying to get jk!r. Wanza to canplete these obligations since the summer of 1975, after all houses in the subdivision were sold to private individuals. 3. If, by May 15, 1976, Mr. Wanza has not fulfilled his obligations as outlined very clearly in my letter of November 12, 1975 (copy attached), the Town of South Windsor will have no other recourse but to call the bond. In the nine (9) months I have owned the property, there has been ng attempt by Wanza to complete the construction and paving of the street. There are lengthy areas where there are no curbs, man-holes and catch basins are raised causing bumps, and there are several depressions caused by settling or faulty construction. Not only is all this unsightly and gives an unfinished look to the neighborhood, but It creates a hazard for the residents and people who use the street. For example, last fall my daughter had a fall from her bycycle while riding across the street which necessitated emergency medical treatment. I would greatly appreciate any action you could take through your office to assure that this section of Orchard Hill Dr. is put into a condition which meets the standards of the Town of South Windsor. I am sure you will recall a considerable length of time elapsed prior to our actual involvement as completing Surety during which I feel there was ample opportunity for the Town of South Windsor to make known to us the scope of the project. At no time were we lead to believe that work, other than that appearing in the November 12, 1975 letter written by Mr. Grace to Mr. Wanza (copy enclosed), would be required. That letter was extremely specific and formed the basis of "calling the bond". Mr. Dennis, Town Attorney, in his letter of May 21, 1976 and again in his letter of June 30, 1976 advised that compliance with Mr. Grace's letter was that which was necessary for completion of the project. Your records should inciate that a carbon copy of Mr. Grace's letter was sent to a number of people including the Commissioner of the State Insurance Department. I can only assume, therefore, that those items appearing in Mr. Grace's letter that had not been completed as of that date, constituted the basis for complaint to the Insurance Department. I am taking the liberty of notifying the Insurance Department by copy of this letter that we have, in fact, complied with your request for completion of the work. Verytruly yours, ,a D. L. Dennis, Town Attorney FROM: J. E. Page, Planning-Coordinator SUBJECT: November 8, 1976 DATE: Orchard Hill Drive As you know, the Orchard Hill Drive work connected with Mr. Wanza's Maple Ridge Subdivision has been done by the Traveler's Insurance Company who held the surety bond. This work was accomplished in accordance with the November 12, 1975 letter from William Grace to Mr. Wanza. However, this letter was never intended to be a complete listing of the work required. Mr. Banta of the Traveler's Insurance Company has written to me regarding release of the bond. I advised him that some work remained to be done in accordance with the subdivision regulations. As you can see from his November 2, 1976 letter, he feels that Travelers has completed the required work. Would you please advise the Planning and Zoning Commission how to proceed on this, and if you feel the Traveler's Insurance Company has completed its obligation. I will be happy to discuss this further if you need any questions answered. Thank you. J. E. Page, Planning-Coordinator JEP/src cc: William E. Grace, Chairman Planning and Zoning Commission
