Dear Commissioners :
We the undersigned, hereby respectfully request a public
hearing on whether a BURGER KING should be constructed
at its proposed sight , in front of the Sullivan Avenue

need to be addressed and answered with regard to the above.
A few examples are : the increase in traffic , an inc ease
in trash and refuse, and a change in the character o the
now existing zone.
These problems , and others that would be brought out at
a public hearing , should persuade this honorable coimaittee

RE: Proposed Burger King SpUt
Sullivan Avenue planning & h W°sor
South Windsor, CT I08 OrnmiSSipR

Dear Mr. Siddell
In accordance with your request, we have made a review of
parking and circulation patterns within the property of tie
South Windsor Development Company on the south side of Su livan
Avenue west of Ayers Road in South Windsor. A portion of the site
is proposed for modification by the addition of a Burger King
restaurant. The site presently provides a single building of
47, 500 square feet which provides a variety of commercial
activities including; Armata ' s .Market, a package store, a
pharmacy, two banks, a video store, laundry, thrift shop,
hair salon and office space. In addition, the Diplomat
Restaurant occupies a separate leased parcel to the east.
The site presently is developed with 343 marked parking
spaces in lieu of 430 spaces required by strict interpretation
of South Windsor' s zoning regulations. A waiver of 87 parking
spaces was granted in accordance with section 8 . 4 . 1 of the re-
gulations by action of the Planning and Zoning Commission on
December 2, 1983 . There are, in fact, additional space to the
south or rear of the building where employees and service vehicles
and others do park, so that the net parking available on the site is
in excess of the marked spaces. We estimate that about fifty
spaces are available for use in the rear of the building and that,
typically, ten to twenty of those spaces are utilized.
In terms of circulation, this location seems to function well with
a single point of access and egress to Sullivan Avenue con-
sisting of a four lane driveway with two lanes of incomind traffic
separated from two lanes of outgoing traffic by a raised denter isle.

Page 2
Traffic signal control at the Sullivan Avenue Driveway rovides for
efficiency and safety for entering and exiting traffic. A
forty foot right of way connects the entrance road with the
Diplomat Restaurant site west of the center with that right of way
being located at the north end of the present parking area and
separated from Sullivan Avenue by grassed buffer strips
Our observations of traffic movements on the site indic to
adequate capacity of the entrance and exit roadway and io difficulty
created by the roadway connecting the entrance/exit dri eway
with at the Diplomat Restaurant. During our observatio s of
traffic movements on the site we did not observe any hi is of
traffic congestion or traffic difficulties. We do understand
however, although we did not witness it, that cars awaiting
service at the bank drive-in facility at the Northwest corner of
the building do at times cause a stack up of traffic to the north of
the building. That stack up occurs, in a sense, off to the
or corner of the lot and apparently does not interfere with the major
flow of traffic between Sullivan Avenue and parking spaces.
It is proposed to construct a Burger King Restaurant at the
north end of this property, immediately east of the driveway
connecting the facility with Sullivan Avenue. The restaurant
will require 48 parking spaces to meet the requirements of
the ordinances. A modified site plan for Burger King aid South
Windsor Development Company indicates a total of 337 parking spaces
to the north and west of the building. A strict interpretation
of the parking requirements would indicate a total of 4 0 spaces
would be required for the present use with 48 additional spaces
required for. Burger King- and a grand total of 478 spaces required.
The site plan indicates a total of 337 ( ignoring any potential
for parking to the rear or south side of the building) . Thus,
the addition of the Burger King restaurant would require a waiver of
of 141 parking spaces as provided for in the Section 8 . . 1 of
the regulations.
In order to determine the impact of such a waiver on
existing parking needs within the facility we conducted a
survey of the number of parking spaces utilized with emphasis
on the noon time period when Burger King Restaurant ' s traditionally
experienced their greatest traffic and parking demands as well as
the peak Friday and Saturday shopping period common in the super-
market. Our observation of utilized parking spaces thep were
made on Wednesday, Friday and Saturday at times between 12: 15 PM
and 1 : 45 PM, 6: 30 and 7: 30 PM on Friday and peak noon time on
Saturday. The following Table lists the results of that counting
program:
Mr, Martin Siddell

1/26/85 Saturday 1 : 30 PM 80
1/26/85 Saturday 2 : 00 PM 72
71
The Table above indicates the number of parked vehicles.
Since there are presently 343 spaces available in the front
and west of the building it can be seen there are a number
of spaces available ranging from 224 to 291. It is
immediately obvious that the introduction of a Burger Ki g
Restaurant with a requirement of 48 spaces would not cre to
a shortage of parking. A waiver of 141 spaces would sti 1
provide an excess of parking spaces ranging from 83 to 1 0 based
upon our observations. During busy shopping periods
associated with holidays or in the event of a change in
tenancy of the main building which would create an addit onal
demand, it would still be possible to provide employee p rkin to the rear of the stores and thus assure adequate parki for
the front of the building long into the future. g
The site plan for the Burger King facility does require the
relocation of the forty foot right of way to a location south
of the Burger King location. In that connection, a site
plan has been prepared to extend the existing center isl
within the driveway providing an additional area of storage
for entering and exiting traffic and to insure a safe
intersection at the point where the entrance driveway me is
the forty foot right of way. In our opinion, this will
provide adequate circulation for all movements within the shop-
ping center.
The site plan also proposes a restripping of the parking spaces
opposite the northwest corner of the building in order to gain
some additional spaces in that area. It is our understanding that
the wide open space presently provided in that area is to permit
some stacking for customers at the bank drive-in window. It
is recommended that a meeting be held with all interested parties
within the shopping center to determine the wisdom of that
parking. It might be necessary to remove at least ten of those
spaces and permit the bank drive-in facility to function 41s it has
in the past. In that case, it would be necessary to modify the
application to South Windsor Authorities to provide a waiver of
151 parking spaces . Our studies indicate that such a waiver
Mr. Mr. Martin Siddell

would not create a hardship or a situation where inadequate
parking would result on this site.
If we can provide further information to assist you in
processing of your applications or in the planning of
the new construction, would you please advise us.

Re : OBJECTION TO THE PROPOSED BURGER KING ON SULLIVAN AVENUE
Dear Commissioners :
We the undersinged wish to make formal protest to the
proposed BURGER KING to be located on Sullivan Avenue. The
reasons for our protest are as follows :
FIRST, the building of this establishment will cause serious
and dangerous problems with respect to the traffic t1lat travels
in and out of Sullivan Avenue Shopping Centger, and the traffic
that uses Sullivan Avenue. Problems arise not only ith regard
to volume of motor vehicles that utilize these passag ways, but
also with the traffic patterns . Presently, stoplights exist at
the interesection of Sullivan Avenue and the entrance to the
shopping center. These stoplights allow for the outflow of
traffic from the shopping center onto Sulivan Avenue They do
not however, allow for any systematic inflow. Drivers
approaching the intersection from the east side (or pper side)
of Sullivan Avenue have not only to contend with the top light,
but also with the traffic that is proceeding straight n Sullivan
Avenue. At a busy time, which happens during morning Ind evening
rush hours, maybe two, or at most three vehicles cai make the
turn from Sullivan Avenue into the shopping center. If
additional traffic, from the proposed BURGER KING, we e added to
this traffic nightmare, the results would be unsettling.
Additionally, because of the shopping development that exists
across the street from the shopping center, which houses the
SEVEN-ELEVEN and other stores, there is also need f r concern.
This development has its entrance also located at the
intersection described above. Unfortunately, its entrance is not
in a direct line with the entrance to the shopping center. Now,
without the proposed BURGER KING, confusion exists as to the
right of way for vehicles leaving both premises ; specifically
those vehicles that are leaving the shopping center and wishing
to travel east on Sullivan Avenue, and those vehicles eaving the
development containing the SEVEN-ELEVEN and wishing to ravel west
on Sullivan Avenue. Again, to increase the traffic volume by
allowing the BURGER KING to be built in the suggested sight may
result in grave consequences and tie ups for those who presently
travel to and from work via Sullivan Avenue.
EXHIBIT A
004')20
Zonning andPlanning
Commission -2- March 18, 1985
SECONDLY, we as a tenant in the shopping cente , would be
hurt by such a proposal , because of the change in the traffic
flow of the shopping center itself. Presently, with SOUTH
WINDSOR BANK & TRUST' S drive-up window, customers have a
difficult time getting into the main area of the shopping center.
On key nights, the traffic for the drive-up window backs up to
the entrance of the shopping center. By adding a B RGER KING,
and extending the island that presently divides the out-going and
in-going traffic, customers would have an even more horrendous
time trying to get in and shop. Conversely, if there was an
extended island, customers would also find it difficult to exit
the shopping center; especially for those patrons trying to exit
eastward on Sullivan Avenue. Currently, during busy times, only
three or four cars can make that left-hand turn. Problems also
arise in that the hill, which contains the entrance and exit to
the shopping center, freezes over during the winter months,
leaving the hill icy and a difficult place on which tc maintain a
car ' s position.
FINALLY, the existence of the proposed BURGER KING will take
away valuable parking spaces from the shopping center. Although
the developer has suggested the creation of a new parking plan ;_o
make up for the loss in present parking, the developer has failed
to realize this plan ' s affect on the present tenants ' needs with
respect to parking; namely employee parking. Such a plan would
eliminate many of the spaces that are needed to be used by the
employhees, in order that they may provide servi es to the
stores .
In closing, we wish to voice our object on to the
proposed location and scheme that accompany the proposed BURGER
KING. We do wish it known, however, that we are not against the
idea of the entity BURGER KING coming into South W ndsor, but
merely resent the proposal, the way it now stands . Additionally
we wish answers to the traffic, '4A04 parkinc-
problems that we have raised above. Please know t-
at we have
every confidence in this honorable committee ' s inquiry and
decision.

RE: Burger King - Store #A-5867L —Su it;ual Aj e-
Dear Ms. Karth:
We are in receipt of your May 12, 1987 letter requesting the release of the
$10,000 bond we are currently holding for landscaping work to be completed
on the Burger King Store located on Sullivan Avenue.
We are aware that this site is not going to be built on due to all the
conditions the State Traffic Commission placed on the developers. However,
it would be inappropriate for us to release this bond with an approved mylar
for this site in our Town Clerk's Office.
Until such time that this mylar expires (five years from the date that it
was approved) or new plans come in for the site, we have an obligation to
hold onto this bond in the case that Burger King were to decide to build.
If you have any questions, feel free to contact me.
Very truly yours,
Michele M. Rowley
