Talbot, Town Manager DATE: January 17, 1978 SUBJECT: Status of Allerton Construction--Achenback Property Option In response to a Town Council request of January 16, 1978, I am attempting to determine the present status of the option offered to the Town for purchase of the remaining 10.59 acres of the Allerton Construction--Achenbach property. Please find attached a summary of some background information and review it for accuracy. Additionally, please advise this office if a zone change request has been brought before the Planning & Zoning Commission and/or if any plans for the proposed subdivision have been formulated. Any other pertinent information you have regarding this situation would also be helpful. Thank you for your prompt cooperation in this matter. I wish to have a report to the Council for Monday, January 23rd and thus would appreciate your reply by Friday, January 30, 1978. Attachment ALLERTON CONSTRUCTION--ACHENBACH PROPERTY LOCATION: Off Sand Hill Road, opposite Nevers Road. Refer to Town Map 106. BACKGROUND: In 1974, the Town of South Windsor purchased a 5.31 acre parcel of land in conjunction with the proposed Plum Gulley Project. The purchase price was $25,000. An abutting 10.59 acres was offered to the Town for one dollar provided that certain conditions are met. These conditions include: (1) A zone change of the area from A-40 to A-20; (2) Subdivision approval of an adjacent lot for 56 or more units; (3) The Town's agreement to relocate the stream maintenance easement if needed when the Archenbach subdivision is developed. MEMORANDUM January 23, 1978 To: Paul F. Talbot, Town Manager Re: Status of Allerton Construction--Achenback Property Option The Planning and Zoning Commission was not a party to, did not endorse, and did not enter into any agreements with Allerton Construction on any property owned by Achenback. The Planning and Zoning Commission had no knowledge of the option offered to the Town for the purchase in 1974 of the 10.59 acres next to the parcel bought by the Town. The Achenback property in question comprises three parts. The first part is the 5.31 acres bought by the Council for $25,000 in 1974. The second part is the 10.59 acres west of the power line offered to the Town in 1974 of which the Planning and Zoning Commission had no knowledge. The third part is 19.5 acres to the east of the power line. A zone change request for the 19.5 acres to the east of the power line has been presented to the Planning and Zoning Commission. A public hearing will be held on February 14, 1978 on this zone change. The land is currently zoned RR and the zone change request is for A.30. No subdivision plans have been presented to the Planning and Zoning Commission, and Mr. Page has had no discussions with Allerton or their representative on any subdivision plans. i1.1-Le William Grace, Chain Planning and Zoning Commission WG/ml y1 N 8 4< cm loqMill C * Y 0-je S-0 ?dzf C a u v 1540 SULLIVAN AVENUE • SOUTH WINDSOR, CONN. 06074 11 'OR•C0 AREA CODE 203/644-2511 January 30, 1978 Allerton Construction Company c/o Achenbach Realty Company Waterfront Road Essex, Connecticut 06426 Gentlemen: This is to notify you that there will be a public hearing of the Planning and Zoning Commission on Tuesday, February 14, 1978 at 8:00 p.m. in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, Connecticut At this time your application for a zone change from RR to A-30 on property consisting of 19.5 acres located near the intersection of Sand Hill Road and Ellington Road will be heard. Chairman, Town Planning & Zoning Commission Town Hall Sullivan Avenue South Windsor, Connecticut 06074 Dear Sir: Mr. Paul Kupchunos has requested that I write you as Chairman of the Town Planning and Zoning Commission notifying you that he desires that he receive written notice of any meeting of the Town Planning and Zoning Commission relating to the proposed subdivision of the property across the street from his home, and across the street on Ellington Road from the property owned by Kupchunos Brothers Incorporated. He did not oppose the change of zone for that tract of land. He does, however, object to the approval of any sub- division of that land which would permit the back yards of the lots in the subdivision to front on Ellington Road. A proposal that would provide that his house, and the houses of the other property owners on Ellington Road should forever look into the back yards of other residential property, is not good planning, and would depreciate the value of his properties. On his behalf I emphasize that he wishes to be notified in writing whenever the subdivision is on the agenda of your Commission, so that he can appear and voice his objection.
