CAVANAUGH January 26, 1978 SOUTH WIN DSORCONN.06074 HAROLD R.CUMMINGS (203) 644-9441 RICHARD D.NICHOLSON PLEASE REPLY TO* West Hartford Mr, Buck Page, Town Engineer Town Hall Sullivan Avenue South Windsor, Connecticut 06074 Dear Mr. Page; I am writing to confirm the substance of my telephone call to you yesterday morning. From the several meetings I have had during the past year with town officials, I have the impression that the Town Attorney's office is reluctant to recognize that the Town has a contractual responsibility to furnish drain pipe for the entire Nevers Road frontage of the Benjamin property, starting at the edge of the Russo property and running to Podunk Brook. That reluctance is puzzling to me because the contract language is clear and I thought the Town Council had recognized the Town's contractual obligation when it appropriated $12,000.00 for the drain pipe in the 1976-1977 budget. The drain pipe is not needed solely from the standpoint of the Benjamin property. Rather, the drain pipe system is necessary to service subdivisions and other lands which are not a part of the Benjamin farm. Hence, there is no reason why Benjamin, or his estate, should pay any of the cost, ex- cept that Benjamin is bound by the contract to pay for the engineering and pay for the installation, just as the Town is bound by the contract to provide the pipe. The zoning Commission has approved a change to A=20 for the 550 feet of the Benjamin frontage on Nevers Road, and a sub- division plan is presently being prepared for the same. Approval of a subdivision plan will, no doubt, involve install- ation of the required drain pipe along the entire Nevers lR i Road frontage of the Benjamin property to the Podunk Brook therefore, imperative that the pipe for the same be furnished KUEHN, CAVANAUGH AND CUMMINGS 2 .r by the Town as per the Town s contract. If the $12,000 .00 appropriation is not sufficient, an additional appropriation may be required. I do hope this matter will receive prompt attention as Mr. Benjamin and his representatives have been most patient and time is now of the essence. Sincerely, L" S Kit,/ Daniel P. Cavanaug$/ DPC/'cv
