Moran, Jr. , Chairman South Windsor Inland Wetlands Agency/Conservation Commission 1540 Sullivan Avenue South Windsor, CT 06074 RE: Paul's Distribution, Lot 6, Application Review U y Dear Mr. Moran: This application by Pauls' Distributers on Mr. Woodcocks's Land is similar to the previous application on Kennedy Road. In essence, they are creating a one acre lot, around the existing building, out of the 4 .664 acres on the westerly side of Kennedy Road. It has been indicated that they intend no regulated activity. The plan submitted indicates a wetlands limits and a nomenclature inconsistent with the Town Plan. Apparently they are claiming that this land is improperly designated on the inventory map and is therefore exempt from these regulations, per Section 3.3. There is insufficient information to process the "Request for Exemption" . The owner should recognize that an eventual approval of Lot 6, as with Lot 3, does not automatically make the other lots building lots . They would have to comply with the regulations in effect at that time. There appears to be no regulated activity for which a permit is required. The exemption should be sufficient, once approved. Sorenson, Vice Chairman South Windsor Planning and Zoning Commission 1540 Sullivan Avenue Windsor, Cr 06074 Dear Mr. Sorenson: i Thank you for your recent undated letter concerning the Kennedy Road resubdivision application of Milton Bayer. I was unaware of the fact that subdivision approval was necessary prior to Mr. Bayer's application. On March 14, 1988 I met with Town Manager, Richard Sartor and my attorney, John J. Woodcock, III in connection with the Kennedy Road cul-de-sac issue. Your Commission will be receiving an application from Attorney Dominic Squatrito of Manchester in connection with the sale of the freezer warehouse which is located on Kennedy Road. This transfer is subject to subdivision approval. The contract provides for a May performance date. Your recent letter indicated that the Camnission would require that the Kennedy Read cul-de-sac turnaround be constructed to Town specifications before a subdivision approval would be given. To that end, I am enclosing a copy of the March 3, 1965 minutes of the Town Council of South Windsor which provides that the Town of South Windsor is legally obligated to complete this road as a consequence of a Town Council resolution of that date. If it is the Planning and Zoning Commission's wish to require the Town of South Windsor to complete Kennedy Road, I would appreciate very much your advising me at once. I do not want nor does my buyer want to become immersed in Commission and Town Council discussions concerning budget constraints and alike. Thank you for your courtesy. Very truly yours, i John J. Councilman Throwe moved the adoption of the following Resolution: 3 "RESOLVED THAT the Town construct a highway from the general northerly line of Sullivan Avenue, at the land owned by John Woodcock; said road to run in a northeasterly direction a distance of 1276.60 feet more or less together with storm sewers, and be generally perpendicular to Sullivan Avenue, at a cost to the Town not to exceed $19,000.00; provided that title to a fifty foot (50') right-of-way for said road, is conveyed to the Town; and provided further that a bond in the amount of $15,000.00 with surety running to the Town, be- posted with the Town, guaranteeing the construction of no less than twenty- five thousand square feet (25,000 sq. ft.) of office, garage or warehouse space, in accordance with the Building Code, within one year from date that the Town commences construction of the road." Councilman Thresher and Councilman Pas tula seconded the motion. The vote was unanimous and so ordered. Mr. Sprenkel commented for the record, the following: "The expenditure of funds at this time, will not fully complete this road and it will be completed at a later date, as additional permits are taken out, then completion will be requested." Woodcock, Site Plan, west side Kennedy Road Emil Lucek of Lucek Engineering Associates was present and stated that this applicant leases freezer space. The proposed building is 9 , 129 s. f. and the site has sewers and water. The road will be extended slightly, and it is a town road. Mrs. Klenke asked if this is the building with the swale around it, and is that swale working. Mr. Lucel said yes , it is pretty much doing what they intended it to do. He said this is a very flat site with only one contour. Mrs. Klenke asked if they have approval from Wetlands and Mr. Lucek said not yet, but they will be going to Inland Wetlands. Mr. Conde said he thinks the moat across the street should show on this site plan. Referring to the Town Engineer' s report, Mrs. Montana said it appears that there should be some storm water detention and she asked if it is the intent .o incorporate detention for this site into the area across the street. Mr. Lucek said he 'd have to talk to the Town Engineer to determine which side of the street the detention will be on. It may be time to start doing something on this side. Mr. Sorenson raised a question about the Town Engineer ' s comments questioning the movements of tractor trailer trucks since the loading dock appears close to Kennedy Road. His memo noted that he had been informed that only two-axle trucks use the facility but a site inspection on Aoril 12th revealed an unhooked trailer at the loading dock. The Town Engineer recommended that the Commission be shown thaly a standard tractor trailer truck is able to make the necessary turning movements. Mr. Lucek said he has no answer to this right now, and will have to look into it. He noted there is 50' from the edge of the pavement to the dock. Commissioner Conde said this must be addressed, and Commissioner Sorenson made a motion to table this matter until these items are addressed. Mrs. Klenke seconded the motion, and it was unanimously voted in favor and so ordered. n Planning & Zoning Commission -7- 5/7/85 5. App. #1064 - John J. Woodcock, Jr. , Site Plan of Development Emil Lucek and John Woodcock were present. Mrs. Montana noted that at the last meeting the Town Engineer asked that drainage be shown on the plans. Mr. Lucek explained that they are planning to have a swale similar to Mr. Woodcock' s other building. During heavy storms _ it will overflow into the drainage system. Mr. Lucek said the road was built with a storm system, gravity flow, all the way to the cul-de-sac. The road was paved by the Town, and there is a gravel area with a turn-around. Right now there is debris and vegetation ' on the cul-de-sac but they will have it cleaned up and get it back down to gravel to make sure it is accessible to fire trucks. They plan to extend the pavement 35 ' so that it is opposite the edge of the building. They hope someday to have a railroad siding coming to this area. Mr. Woodcock said there is only one truck a week coming to the site during most of the year. From May through August there may be three or four trucks coming to the building. Mr. Conde questioned the drainage system and a discussion ensued, with Town Engineer Martel stating that as far as the drainage goes, he thinks this will be an improvement over what there is now. Mrs. Smith made a motion to approve the above application for a site plan of development for property on the west side of Kennedy Road, as shown on a plan prepared by Lucek Engineering Associates , Inc. , dated 2/14/84 and 2/15/85, Proj . No. 84-7, subject to the following modifications: 1. The existing house and shed must be shown on the key map. 2. The 50 year flood limit must be addressed. 3. The debris and vegetation must be cleared from the gravel road and turn-around area. 4. No building permits will be issued until the final plans haTe b►eenfiled in the Town Clerk' s Office. .. t 5. Prior to commencement of site work, a meeting must be held with Town staff. 6. This approval is subject to the conditions of approval of the Inland Wetlands Agency and Conservation Commission. Within 90 days (bv August 6, 1985) a black and white transparent mylar of Sheets #1 and #2, with the letter of approval of this Commission, the Inland Wetlands Agency and Conservation Commission reproduced thereon, msut be submitted. Three paper prints should also be submitted. After signing, the mylars will be filed in the Town Clerk' s Office. Mrs. Klenke seconded the motion and it was unanimously voted in favor and so ordered. Mrs. Smith made a motion to continue the meeting past 10 : 30 P. M. , seconded by Mrs. Klenke. Voting in favor were Smith, Conde, Montana, Klenke, Hallowell and Asplund. Mr. Sorenson abstained. Appl. #88-42P, Paul Tosi, Trustee, Paul's Distributors Trust, Resubdivision, Lot 6 on the east side of Kennedy Road, north of Sullivan Avenue, I Zone. Engineer Emil Lucek and Atty. Dominic Squatrito represented the applicant. Atty. Squatrito first reviewed the history of the property and discussed the installation of Kennedy Road, where the applicant proposes to locate his business in an existing building on Lot 6 . Atty. Squatrito said when Lot 3 was approved by the PZC a letter had be n sent to Mr. Woodcock stating if any further subdivision or oth r work was to occur on that street it would be up to him to finish th road. However, Mr. Woodcock's response dated March 14, 1988 sent to Vic Chairman Sorenson together with excerpts from the March 3, 1965 Town Council minutes (Attachments A & A-1) seemed to indicate to Atty. Squatrito that Mr. Woodcock was not responsible for road completion. Atty. Squatrito described two problems raised by Town Planner Marcia Banach: ( 1) Lot 6 has no cul-de-sac, and (2) Lot 5 does not hav enough paved road in front of it. However, he proposed the Town had alr ady essentially accepted the road and that Mr. Woodcock' s construction of a building there had been predicated on that acceptance. Town Planner Banach read her report: 1. This application is for a 3-lot resubdivision on the northwest side of Kennedy Road to create Lot 6 while also creating Lot 5 and revising Lot 1. 2. A nonconforming building in both front yard and rear yard requirements currently exists on Lot 6 . Lots 1 and 6 meet the minimum requirements for the industrial zone. Lot 5 has frontage on a Town right-of-way but there is no road constructed in front of the lot, thus it appears the lot does not conform to Town regulations. Under Section 2.1 .e, no certificate of occupancy would be able to be issued for Lot 5 until the road is paved. The entire Lot 1, unrevised by a new subdivision, could be sold. 3 . There are regulated wetlands on the site. The applicant has received IWA approval. 2 JULY 19 , 1988 PLANNING AND ZONING COMMISSION Kennedy Road. sewers running partway up• 4 . The denial is based on the following. 1 . The proposed application does not conform to the subdivision regulations. Section 2.5 requires that "where the land to be subdivided does not abut an accepted Town street . . . the subdivider shall provide and construct a street from the subdivision to such a Town or State road to be built in compliance with the requirements and specifications applying to the construction of streets within the subdivision. " The proposed Lot 5 does not abut an accepted, constructed Town street and the application did not contain a proposal to construct such street. Section 2.5.e requires that "dead-end streets shall terminate in a circle not less than 55 feet in radius [and] shall be paved to an outside radius not less than 42 feet . . . . " Kennedy Road currently does not conform to this requirement, and the application did not contain a proposal to construct such a cul-de-sac. The lack of an adequate cul-de-sac forces Town maintenance vehicles to utilize private properties to execute turn-around movements, thus creating an unacceptable maintenance situation.
