E. Page Engineering Department Town Hall, 1540 Sullivan Avenue South Windsor, Connecticut 06074 Dear Mr. Page: As a result of an on-site inspection held on May 1, 1973 , regarding the items mentioned in your letter dated April 16 , 1973 , the following has transpired. A.R.C. Construction Company agrees to rectify the afore mentioned condition at the intersection of Clark and Smith Streets by blocking the existing drainage that crosses Clark Street. This will eliminate any further siltation of the area to the east of Clark Street previously affected. General repairs and cleaning of the intersection will be done in com- pliance with the Engineering Departments recommendations, and all work will be performed to their satisfaction. The temporary drainage swale along Smith Street will be relocated approximately 8 - 10 ' south so as to eliminate the hazardous condition that exists. As you know ARC has an option to purchase the + 12 acres to the south of Smith Street, presently owned by Charles Burr. As we develop our plans for use of this property, we will plan a direct means of draining t e Cinnamon Springs site to the 48" pipe under Smith Street, thereby, elim- inating the need for the temporary swale along Smith Street. However, until this time, we will take the necessary steps to ensure proper flow in the swale to the 48" culvert. Specific ]nd we will lessen the severity of the slope from Smith Street, h rake the disturbed areas, rip-rap the bottom and hydro mulch entire area to insure a stable soil condition in this area. The projected date for completion of on-site improvements, including paving, landscaping, loaming and seeding is June 15, 1973 . We will continue to exercise care so that further erosion or siltation does not occur. As suggested, temporary ACHENBACH REALTY COMPANIES - Page 2 May 3 , 1973 drainage interseptor trenches will be constructed on the north boundary of the property and directed to a siltation basin that we will construct at the outlet of our site drainage and pond venting system. These trenches will contain any overland flow of water and direct it to the central siltation basin before leaving our property. We will also begin to remove any excess soil material from the site, such as top soil, excavated material, etc. This will eliminate a large amount of material that could cause siltation. It ,is our intent to continue to cooperate fully with the Engineering Department in every way, and to work very closely to eliminate any future problems. All work will be performed to the satisfaction of the Engineering Department, and in accordance with the requests and recommendations of your letter dated April 16 , 1973 . We want you to start work .on these matters NOW! Unless some work is done, as outlined in your letter, within the next few days, this Department will begin to take corrective action. Your intent to repair the drainage swale along Smith Street is a step in the right direction; however, this Department still wants a permanent solution to this problem. We want to make it absolute clear that, regardless of whether you purchase the Burr property or not, the temporary drainage swale along Smith Street will have to be filled and regraded, and a permanent solution to this drainage problem designed and constructed by your firm. This solution can be done either by directing the storm water directly across the Burr property (as shown on your drawings of the site ; or an underground drainage system with catch basins, etc., can be designed and constructed along Smith Street by your company, that is acceptable to this Department. We want to thank you for the cooperation you have given us in the past and hope that it will continue. If you have any questions, please call at any time. Very truly yours, TOWN OF SOUTH WINDSOR E. Although the increased rate of flow which leaves our property is not due to our develop- ment entirely in that a major portion of the watershed lies upstream from us and has also been developed by others, the pond can accommodate the storage of this additional runoff. The storage capability of the pond could be realized by designing the outfall structure to limit the rate of dis- charge while simultaneously allowing for the storage of any additional runoff. This proposal would then effectively provide for the equi- valent conditions relating to rate of flow that Mr. Burr experienced prior to any development upstream from his property. It is our position that by making the proposed alteration to the outfall structure and by providing a storage facility for the additional runoff due to the development both on our property and on property owned by others, that we are effectively discharging our obliga- tion in this manner. By providing a small rectangular opening in the front of the new structure , the discharge of stormwater runoff will be regulated to a much slower rate . The additional height of the new structure will allow for the storage of water in periods of peak run- off. The top of the new structure will be open (protected by a steel grate) to allow for the discharge associated with an extraordinary storm event . This precaution will limit the possibility of water damage to the surrounding dwellings . I hope that this proposal meets with your approval . In addition to the information requested in that letter, the following information is needed to evaluate the proposal: 1. A watershed analysis using a 25-year storm to provide the run-off before development and after development, including the 15-inch pipe that is not now directed to the pond. 2. The capacity of the pond and the time this will allow for storage before overtopping of the steel grate. 3. The amount of freeboard that this arrangement will provide. 4. Your proposal for obtaining drainage easements from Mr. Burr. 5. WOODCOCK III ATTORNEY AT LAW (203) 644-2431 P. O. BOX 445 1678 ELLINGTON ROAD SOUTH WINDSOR, CONNECTICUT 06074 April 26, 1978 William E. Grace, Esq. Chairman, Planning and Zoning Commission 1541 Sullivan Avenue South Windsor, Connecticut RE: Charles R. Burr property Smith-Clark Streets Dear Mr. Grace: I represent Mr. Charles R. Burr in connection with the drainage problems that he is experiencing at his property which is located at the intersection of Smith and Clark Streets. The problem is caused by the storm drainage runoff of waters from the Cinammon Springs Complex which is owned by one of Achenbach' s companies on to my client' s land. The situation is such that at the present time, Mr. Burr' s property is totally undevelopable and has greatly diminished in value as a consEquence of this drainage situation. He would like to market it but is unable to do so until the drainage situation is resolved. As I stated in my appearance before the Commission on April 25th, 1978, many promises have been made by the Achenbach people to resolve the drainage problem, but none of these promises have been kept. The Town is holding a $50, 000. 00 performance bond with respect to the resolution of the storm drainage situation. At present, we have two major problem areas on this piece of land. They are: 1. Surface water runoff from the Cinammon Springs piece over a substantial -portion of this property; and 2. A four foot ditch running from the intersection of Smith and Clark Streets to an existing culvert. JOHN J. WOODCOCK III April 26, 1978 Page Two The ditch was dug by Achenbach in 1974 to relieve a serious safety situation that was occuring on the corner of Smith and Clark Streets. Its presence along the entire frontage of Smith Street makes Mr. Burr' s property very undesirable. In addition, over the past five years there has been a substantial loss of topsoil caused by the surface drainage problem. This letter is to advise the Planning and Zoning Commission of the continued existence of the above drainage problems, and to secondly, request the Commission' s assistance in bringing about a resolution of same once and for all. It is my understanding that the Town has received numerous promises from Mr. Achenbach and his people over the years with respect to a finalization of this situation. It is Mr. Burr' s position that his property be restored to a state at least commensurate to the one that it was in prior to the Cinammon Springs development. I thank the Commission for its cooperation and assistance in bringing about a resolution of this very difficult matter. I shall be meeting with Mr. Jules Page in the near future with respect to an update and evaluation as to how this will be accomplished. Thank you for your courtesy.
