RE: OAKLAND CENTRE APPLICATION REVIEW
Dear Mr. Moran:
The plans have been modified similar to the indication last
month. The indicated activities within the wetlands for which a
permit will be required are:
1. The installation of a discharge from their dentention basin.
2. The placement of standard rip rap at the corners of the
brook. This was previously requested and it has been indicated
that this can be placed without work in the brook.
3. The plans indicate that the foliage along the brook and
wetlands shall be cut and mown. This area shall be planted with
a collection of shrubs.
If a permit were to be approved, a bond of $5,000 could be
appropriate to assure compliance with the notes and schedules
indicated on their sedimentation & erosion control sheet No. 3 of
S.
A modification of the wetland map - 3.1 & 3.2 shall be required.

RE: "THE OAKLAND CENTRE" APPLICATION REVIEW
Dear Mr. Moran:
The application and plans for work on this parcel when compared
with the 1984 edition of the Town "Inland Wetlands Map" reveals a
large discrepancy between the two. Ten or more years ago, Farm
Brook was relocated into its present location. How and/or why
could be subject to some research, but it has been in its current
location for an extended period of time and I am not in
disagreement with their indicated location. Their application
should include the appropriate information required under Section
III to show the wetlands eliminated and the new watercourse, for
the inventory.
Then it would appear that the regulated activity applied for
would come under Section 5.2 & 5.3 of the regulations. This
would include the storm drainage, including detention, grading of
the channel banks and the restaurant location.
I am concerned about any excavation in or adjacent to the
watercourse. Farm Brook carries the runoff from a sizeable and
mostly developed section of Town. It would appear that the
channel was maintained fairly well, based on the size of the
brush along its sides. This root growth has retarded earth
movement, erosion and the depositing of silt downstream. With
this proposal, there is nothing on the plans to indicate how they
intend to work in a live stream and preserve the water quality.
There is no protection at the corners where one would expect a
certain amount of scour, even at morderate flows . Nor do they
evaluate the channels condition, capabilities or propose a
maintenance schedule. If the slopes were to be ignored, they
will grow up into brush, like what is there today. Over an
extended period, this could affect the flow and perhaps have an
adverse effect on the site and require a major restoration effort
by the owner. To remove it by digging or chemically, would be
prohibited.
John M. Moran, Jr.
"The Oakland Centre" Application Review
Page 2.
Item 5 in the application asks for a purpose, description and a
time frame for a proposed activity, which a permit from the
IWA/CC is required. It appears that more information is needed
on the plans to make an evaluation or recommendations of their
proposal.

RE: Appl. #88-11P, The Oakland Centre
I have reviewed the proposed phasing of site construction (revision
date 12/8/92) and the proposed changes to the Sediment and Erosion
Control Sheet received by the Planning Department on January 11,
1993 . I have the following comments:
1 . The proposed filter fabric fence, as shown in red, should
be relocated so that it is approximately ten (10) feet from
the toe of the proposed grades. As shown, it doesn't allow
for the grading which is proposed.
2. The "proposed limit of site construction" , as shown on the
plan for proposed phasing of site construction, should be
relocated to include the area necessary for the sediment
and erosion control measures .
3 . The original bond amount of $5,000 .00, which we are
currently holding to assure compliance with the sediment
and erosion control measures, should still be required.

Dear Mr. DeMallie:
Re: EXPIRATION OF PERMIT #88-11P, Oakland Center
This is a reminder that the permit with the Inland Wetlands
Agency/Conservation Commission, application #88-11P will expire on
April 23, 1995 .
If you plan to extend your project beyond the above expiration date,
you must apply for an extension at least sixty-five ( 65 ) days prior
to the expiration 'date. There will be a thirty-five dollar ( $35 ) fee
required for an extension of the permit. This includes a ten dollar
( $10 . 00 ) surcharge assessed by the State, to fund the State
Environmental Review Team.
An application for an extension shall be made in accordance with the
following subsection of the IWA/CC Regulations:
a. The duration of any amendment or extension shall be for three
years unless otherwise specified in the permit.
b. The application may incorporate by reference the documentation
and record of the original application.
C . The application shall state the reason why the authorized
activities were not initiated or completed within the time
specified in the permit.
d. The application shall describe any changes in facts or
circumstances involved with or affecting wetlands or
watercourses or the property for which the permit was issued.
e. In unusual situations the Agency may accept an untimely
application to extend the expiration date of a permit if the
authorized activity is ongoing and allow the continuation of
work beyond the expiration date if in its judgement, the permit
is likely to be extended and the public interest or environment
will be best served by not interrupting the activity; the
application shall describe the extent of work completed at the
time of filing and the schedule for completing the activities
authorized in the permit.
Peter DeMallie - 2 - February 1 , 1995
Application #88-11P
f . The Agency shall evaluate the application pursuant to these
regulations and grant the application as filed, grant it with
any terms or limitations , or deny it; and shall state upon the
record the reason(s ) for its decision.
In the event that you are requesting an extension, section 8 . 1 . 6 of the
Zoning Regulations establishes the process for monitoring the approved
conservation plan. Per that regulation, a progress report is required
from the applicant' s engineer verifying that erosion and sedimentation
control measures have been installed and maintained in accordance with the
approved conservation plan. This verification report shall also be
submitted 65 days prior to the expiration date of the permit to allow time
for the Commissioners to evaluate your project controls .
If work has been finished or will be finished by the expiration date,
please send a letter stating work is completed according to the approved
plan.
If you have any questions call me or Michele R. Lipe, AICP, Assistant
Planner/Analyst at 644-2511 , ext 253 .
