SIGNED t r✓ r 2 APPLICANT WNER James E. Sheehy 41 Glenn Road East Hartford, Conn. Mr. Joseph J. Carino, Chairman Planning and Zoning Commission 1540 Sullivan Avenue South Windsor, Connecticut 06074 Dear Mr. Carino: I am writing in regard to the subdivision of Sand Hill Estates. I was pleased to learn that the Planning and Zoning Commission gave this subdivision final approval last month. At this time, I would like to clarify the Commission's position regarding the right of ways across land owned by the Connecticut Light and Power Company. As you recall, around last January, the Commission requested the proposed street (Sandy Lane) to have a width of sixty (60) feet, because it was the Commission's feeling that this could be a major artery, and would then conform with the Comprehensive Town Plan. Mr. Leichtner took the necessary steps to meet this requirement, and on February 8, the Connecticut Light ard Power Company granted tentative approval of an additional ten (10) feet to the existing fifty (50) feet of right of way, enabling Sandy Lane to be a continuous sixty (60) foot road. The subdivision plan shows a proposed street between Lots 14 and 15, which connects to an existing right of way across Connecticut Light and Power Company property. During subdivision submission, it was my understanding that this right of way could remain fifty (50) feet wide. Was I correct in assuming this? The reason I question the width of this second right of way is because the Commission choose to hold acceptance on the lots adjacent to this reserved street. If Sandy Lane is to be the only sixty (60) foot right of way, steps are now being taken to get approval from the Connecticut Light and Power Comapany's Board of Directors, and their decision would be part of the records. If there is some question on the right of way between Lots 14 and 15, please do not hesitate to contact me. Very truly yours, James E. Sheehy Registered Land Surveyor JES/p cc: Mr. Leichtner December 7 , 1970 Leo Leichtner 478 Park Avenue East Hartford, Connecticut 06108 Dear Mr. Leichtner: During Executive Session of the Planning and Zoning Commissi n held on Tuesday, November 24, 1970, your application for a subdivision known as Sand Hill Estates was discussed. It was noted that the key map is 1" -- 800' and not 1" w 1000' as required in the subdivision regulations. The Commission felt that a variance would be required for the 750' road. It was the feeling of the Commission that sidewalks would be required on both sides of the streets in the subdivision and on lots fronting on Sand Hill Road but not on the lots fronting Ellington Road. The Commission felt that the developer should provide a written agreement from CL&P that South Windsor has a right-of--way for a paved road and sidewalks to the Roadway Specifications of the Torn of South Windsor. With regard to capped severs, the Commission will have the Town Engineer send a copy of the plans to th Sewer Commission for their opinion. Preliminary approval will be deferred until recommendations from the Sewer Commission are received. Very truly yours , PLANNING AND ZONING COMMISSION Joseph J. Because of the legal implications and the amount of time that may be consumed, I am suggesting the following action. It is suggested that your attorney take the necessary steps to coordinate with Connecticut Light & Power and the South Windsor Town Attorney (Daniel P. Cavanaugh) communication which will result in a proper written agreement which will assure the Town of South Windsor that they have positive rights over the power transmission lines west of Sand Hill Estates, Section I. at two locations: a 60 foot right of way, and the more northerly one a 50 foot right of way. The Commission will require a written statement from the Town's i Attorney indicating that he is satisfied that all legal steps have been taken to assure the Town full right-of-way over this i property. z Very truly yours, =' y.iZ. Donald McLaughlin, Building Inspector Town Hall t South Windsor, Connecticut - 06074 Dear Don: In my opinion the easement dated October 19, 1971 from the Connecticut Light and Power Company to Leo and Jack Leichtner fulfills the requirement described in Mr. Carino's letter of October 7, 1971 addressed to Leo Leichtner with a copy to you and to me.. Please have the Town Clerk record the easement and bill Leichtner for the recording fee. This easement does not, of course, convey anything to - the town. It merely makes sure that if and when the Leichtners transfer title to a roadway or right-of-way to the town, the Connecticut Light and Power Company will not be able to object.
