Box 503 South Windsor, Connecticut 06074 Dear Mr. Carino: I have been retained by Patrick J. Ward, Jr. , of 2228 Ellington Road, South Windsor, regarding the problem situation in relation to his property on Doria Lane and Lake Street. It is my understanding that the owner, Carlo Prestileo, and C & D Builders, are in the process of applying for approval of Oak Grove Acres, a subdivision bordering the land of Mr. Ward. Mr. Ward and myself have reviewed the drainage proposals on the preliminary plans submitted by Mr. Prestileo. The proposal, as initially submitted to your Board, interferes severely with Mr. Ward' s contemplated use of his property by allowing the dumping of the drainage from the Oak Grove Acres onto his property. We would hope that we might resolve this situation without legal action against Mr. Prestileo, and would ask that you and your Board give us notice of any meetings regarding any con- templated change or temporary approvals which would be given to Oak Grove Acres as to their anticipated use of their land. We would gladly upon those occasions explain Mr. Ward' s contemplated use of his property to the Board. We believe the proposed preliminary plans are unlawful and illegal, and would create a nuisance situation, and would severely affect the value of Mr. Ward' s property. Mr. Joseph J. Carino, Chairman - 2 - March 9, 1971 I would gladly meet with you or your Board on any occasion with my client and further cooperate in any way you would ask. Very truly yours, J es A . The land is basically wooded with gently rolling contours . The contemplated development will be single family homes with 2 to 4 bedrooms. ! SUBSURFACE INVESTIGATIONS Seepage tests were made on this tract on April 2, 1971 and May 12, . 1971. The tests indicate Class B, C & D seepage rates . The details of the soil cross sections of the test pits of the seep- age rates may be found on charts enclosed. A cursory review of the test information would indicate that any septic fields installed in this area should be within the upper 36" of the existing surface of the ground. They must be designed and installed with the most exacting care to accommodate each individual lot . Curtain drains above the upper side of the leaching area are recommended for Lots 15, 18 and 19. In the case of several lots, it may be desirable to take additional tests after the land development has been accomplished to help facilitate proper sewage disposal design. It must be kept in ,mind that if the Town of South Windsor sewer program does not indicate sewers for this area in the near future, all lots must allow area for a replacement field (Conn. Dept . of Health Code) . I I 1 yI 1• 1 3 SEEPAGE TESTS :! Page -- Planning Co-ordinator FROM : Melvin Edwards, Jr. -- Superintendent of Pollution Control SUBJECT : OAK GROVE ACRES...PROPERTY OF CARLO PRESTILEO As you are no doubt aware the sanitary sewers in the referenced sub-division are no longer capped - having been activated by the recent acceptance of Graham Road Area, Contract "H". My primary concern at present - and the reason for this Memo - is the owner- ship of the rights-of-way involved in these sewers. There are two (2) - one (1) running from Berle Road to Rosemary Lane, and the other from Rosemary Lane to Do ri a Lane. I have already contacted Attorney Dennis concerning this. He is unaware of any deeding of these R.O.W. 's to the Town, and stated that, at least preliminary, steps should have already been taken by Planning & Zoning. Any light you can shed on this matter will be greatly appreciated. Melvin Edwards, Jr. - Superintendent Pollution Control Division ME/ cc: E.W. Lucek -- Director of Public Works J.H. There is water surfacing in the vicinity of lots #7 and #8. This water is causing severe icing conditions near the inter- section of Christine Lane and Rosemary Lane, and will undoubtedly cause damage to the road. 2. Sanitary sewer and storm drainage easements are needed. Please get in touch with me on your return so we can resolve these two problems. Very truly yours, ' J. E. Lassman EAL/mp MEMORANDUM February 10, 1976 To: Donald McLaughlin Certified Building Official Re: Lot #10 - Oak Grove Acres Lot #10 in the above-mentioned subdivision has two (2) wells. Well #1 is located in a Sanitary Sewer easement. This well is presently connected to the house; however, it has to be abandoned for domestic use. I have discussed this with Mel Edwards, the buyer' s attorney, and Mel Stead. Before a C.O. is issued, the house should be connected to Well #2, which is to the North and rear of the house. Also, as you are probably aware, there is a landscaping problem (water) which Cote is in the process of alleviating. Lester A. Braddock LAB:prb cc: Melvin Edwards, Jr. J. E.
