M. in the CouAcil Chambers of the South Windsor Town Hall , 1540 Sullivan Avenue, ' South Windsor, to consider the following: 1. Application of Beatrice M. Thrall, for a 4 lot subdivision on 2. 927 acres, located between Avery Street and Concord Road, north of the Sout4 Windsor/Manchester town line, as shown on a plan prepared by Megson & Heagle, dated 9/9/85 , Map No. 26-85-1, A-20 zone. 2. Application of Dart Hill Realty, Inc. for Phase II of Mountain- view Estates, consisting of 32 lots, and Phase III consisting of 33 lots, located on. the north side of Dart Hill Road, west of Newmarker Road and the South Windsor/Vernon town line, A-30 zone. Copies of these applications and maps more clearly defining the properties are on file in the Office of the Town Clerk of the Town of South Windsor. At' this hearing interested persons may appear and be heard and written recommendations will be received. PLANNING AND ZONING COMMISSION Robert F. Gilligan, Chairman David H. Sorenson, Secretary Planning & Zoning Commission -3- 11/19/85 Mrs. Carolyn Berzins said she was representing her mother, Beatrice Thrall. With her wa Andrew Tupper, of Megson & Heagle, Civil Engineers and Land S rveyors, who had prepared the subdivision map. Mrs . Berzins explained that they wished to subdivide almost 3 acres into 4 lots, in an At20 zone. Two new lots would front on Concord Road, and one of the ''lots fronting on Avery already has a house on it. That lot is designated lot #1, and consists of about 12 acres. In May of 1985 they went to the Zoning Board of Appeals for a 5 ' variance on the frontage of o e of the lots on Concord Road, and it was denied because of substantial opposition. The reason for denial is that it was not in keepin with the character of the neighborhood. Mrs. Berzins said sh is not requesting a variance now. Each of the lots will have 100 ' f width at the building line in accordance with Section 1. 2 f o the Zoning Regulations. No Wetlands approval is required, and the have applied for Conservation approval. The lots will be serviced by ewers and water. Referring to the opposition at the ZBA meeting, she produced a map showing a number of ots in the area with less than 100 ' frontage. Mrs. Berzins said he husband has been in the building business for over 20 years, a 'd the homes they build would detract from the neighborhood. Mrs . Berzins conclud d that this property has never been previously subdivided, and the uilding line is being established on one lot in accordance with Section 1. 2 f. The lots can all be serviced by sewers and water, and are not out of character with other lots in the neigh- borhood. Town Engineer, Richa 'd Martel, said he had no comments. Mr. DeMallie, Planning Director, s , id the Planning Department recommended the public hearing in view of t ,e denial of a variance by the ZBA. This appli- cation does not requ re a variance. The building line on Lot #4 is 95 feet. Notation 4 ' should read that Lot #2, rather than #1, is serviced by South Widsor sewer. Lot #4 still contains a sufficiently large area for a house. Mr. DeMallie said he recommends a turn-around driveway on Lot #2. No one in the audienle spoke in favor of the application. Speaking in opposition was Richa 'd Roback, of 116 Concord Road. He said he feels that if approved, th s subdivision will change the character of the neighborhood due to the placement of the houses. The neighborhood consists of custom b ilt homes from the 1950 ' s and 1960 ' . Properties immediately surrounding the proposed subdivision have lot widths of at least 134 ' , and a;eas close to 3/4 of an acre. The front building lines are b6tween 40 and 50 feet from the road. The ZBA denied this beca se one of the lots did not meet the minimum requirements. Mr. R 'back said he submitted a petition at that time asking the variance o be rejected. By careful manipulation of the lot lines, they have, come up with this plan. This plan only makes the matter worse reg4rding the effect on the neighborhood. He said that he and his neighbor offered Mrs. Thrall an option: A single Planning & Zoning Commission -4- 11/19/85 house lot, with the land on each side purchased by himself and his neighbor, and they have had little success in negotiating. Mr. Roback then submitted a petition which he said was signed by 16 residents representing 7 properities in close proximity. Mrs. Berzins said she would like to mention that the Commissioners should see the neighborhood and they would see what is planned is not out of character with the neighborhood. She noted there is a thick hedgerow between Lot #4 and the Conyers property, and setting the house back would not be unatractive. Insofar as the offer is concerned, Mrs. Berzins said Mr. Conyers never made an offer - they just talked to him. Mr. Roback offered $35,000 for the entire parcel fronting on Concord Road, which is improved property with water and sewers or an alternative offer of $1, 000 an acre for the excess property. She said she doesn' t know where he got that figure, but the property is certainly worth more and that' s why her mother didn' t seriously consider the offer. Commissioner Klenke asked if the lots were wooded, and Mrs . Berzins said all three lots are basically very open, with the Conyers property, and also some on her mother' s property. Mr. Asplund asked Mrs. Berzins to restate the lot sizes on Concord Road. Mrs. Berzins said the abutting properties are 38 ' frontage on the Roback property, but he has 138 ' on the building line; the Carman Road properties are 93 ' , 971 , 97 ' and 821 ; across the street from the proposed lots there are two lots with 102 ' and 81 ' . Mr. Asplund asked the square footage of the lots. Mr. Tupper said the three lots on the east side of Carman Road are 180 ' deep, and are a little less than 20, 000 s. f. The lot on the left are two lots combined. which had . 47 and . 33 acres for a total of . 8 acres. The lot to the east - the one with the 38 ' frontage - is . 7. Mr. Roback reiterated that the lots they are speaking of were put together in 1938, long before the present zoning regulations. He said there are other lots in the area with more frontage. The newest lot in the area on Avery Street has 134 ' frontage and is close to an acre. The Pasquilini property on Avery has 134 ' and is about 3/4 acre. The Conyers property, which abuts the property in question, has well over an acre. Another property to the south of the Thrall property has about 200 ' . The other houses on Concord Road do have smaller frontages, but they were part of a subdivision in Manchester approved in 1938. 2. Application of Dart Hill Realty, Inc . for Phase II of Mountainview Estates, consisting of 32 lots, and Phase III consisting of 33 lots, located on the north side of Dart Hill Road, west of Newmarker Road and the South Windsor Vernon town line, A-30 zone. Present on behalf of the applicant were Attorney Curtis Roggi of the firm of LeFoll & Roggi, and Bill Clock, of Reino Hyyppa & Asso- ciates. Mr. Roggi submitted sets of plans which he said were revised i Planning & Zoning Commission -5- 11/19/85 in accordance with c mments from the Planning Department. They are asking for approlal of both Phases II and III, consisting of 32 and 33 lots. Thel, only substantial change between the plan the Commission is re.iewing tonight and the one they saw with Phase I, is that the phasing has been changed. Half of the homes in Phase I have been built, and 'the others are under contract. The WPCA approved the sanitary sewers for all six phases. IWA/CC heard this matter the other night, but adjourned before taking it up due to the late hour. Mr. Ftoggi said he does not foresee any problem with IWA/CC. i Mr. Clock said the phasing has been changed in order to accommodate development to the north which will be called "Windmar" . Mountainview will service their drainage and sanitary sewer needs. A detention basin is proposed tolthe west of Lots 42 and 41. i Mr. DeMallie said th4, Planning Department recommends that building permits be authorized: only for Phase II. The difference between the plans submitted this evening (revised to 10/15) and the plans submitted with the a0plication originally are as follows: An overall c-ncept plan showing the new phasing has been attached; they have furn- ished area calculations for detention basins; temporary stockpile site have been provided; pavement widths are shown on the topographic maps; and, the hedgetlow and barn in the area of Lots 37 and 38 are clarified. Mr. DeMallie concluded by stating the plans are now complete and no furtH6 r changes are required. Town Engineer, Rick Martel, reported that the revised plans corrected the following items : i Sheet #11 now shows a piece of drainage pipe that was missing; a latch basin was added to the northwest corner of lot #43. Mr. Martel said the grade shown on the plans is greater than the 3% requirediby the subdivision regulations at the intersection of Debbie/Newmarker. I That will be addressed with Phase VI. He said he recommends that tle Fire Marshal approved the configuration of the phasing. Phase III requires the abandonment of a portion of Newmarker Road, and he referred to a letter written to Attorney Rittenband which gives the procedure for the abandonment, and the maps have been prepared by the applicant. The sanitary sewer which is supposed to extend from Phase III of this subdivision to the north to the Lavitt subdivision, is somewhat in question is somewhat in question. It is not a major problem, and Mr. Markel said he thinks it can be worked out. The drainage that is beiniig proposed for Sections II and III will also handle drainage from Mr. Lav'itt' s subdivision. The original detention basin which had been planned for the Lavitt subdivision was in a heavily wooded area, and it plow looks like this area will be saved. Mr. Martel noted that further to the north in Ellington the watershed that will be coming down to these detention basins covers approximately 40 to 60 acre more. He contacted Lombardi Associates who acts as consultants for Ellington, and they do not have a policy regarding drainage and how it relates to development. He said he would like to ask the Commission to write to the PZC in Ellington to determine their policy of further development in this watershed area. Development of this area could have a significant impact downstream and it does drain just about due south. Planning & Zoning Commission -6- 11/19/85 Mr. Martel said the Engineering Department has been in contact with Vernon regarding the realignment of Newmarker, and the only comment they had was that the pavement that is to be replaced be replaced up to the manhole which had been excavated. Mr. Martel said he has bond estimates ready to submit at the work session on this application. Mr. Gilligan asked if anyone in the audience wished to speak in favor of the application, and no one did. Mr. Roger Hildebrand said he is concerned with the safety problem at the intersection of Debbie and Dart Hill Road. He said he lives near this development and it is impossible to see anything to the left coming out of Debbie onto Dart Hill. He said relocating the trailer might help. Mr. Gilligan asked Mr. Martel if it is permitted to park construction trailers. Mr. Martel said yes, but he will check to see if it is blocking the sightline, and report back to the Commission next week. Mr. Roggi explained that the applicant intends to move the trailer in a couple of weeks. Mr. Gilligan said it sounds like it is a hazard and Commissioners Klenke and Sorenson suggested that tomorrow might be a good day to move it. Commissioner Rossi asked if there was any way the 3% grade on Newmarker could be done prior to Phase VI. Mr. Clock replied that the existing condition is only temporary, until Phase VI is constructed. At that time Newmarker Road will be reconstructed and the grade will be lowered 18" or so. When that grade is dropped the 3% will be achieved. Mrs. Rossi asked if they objected to doing the work at this time. Mr. Clock said they would have to extend the limits of construction beyond a few hundred feet quite a ways. Mrs. Montana asked if Debbie Drive would be coming onto Newmarker with the next phase. Mr. Clock said it will come onto to Newmarker with Phase II. Mrs. Montana said the Commission is concerned with Newmarker Road and has refused to accept it as a Town road, and people will be exiting onto Dart Hill from Newmarker, and eventually people will come from the subdivision in Ellington onto Grant and then to Newmarker. She said she is disturbed with the timing. Mr. Clock said he spoke to Mr. Jacques just a minute ago, and if the Commission prefers they won' t connect to Newmarker and will just put in a temporary cul-de-sac. He noted that they are proposing a temporary cul-de-sac at the end of Lisa Drive where it will eventually connect to Grant Road. Mr. Sorenson asked how far along they are on Phase I. Mr. Clock replied that there are 14 under construction, and other lots have been sold. They are about 50% along in the construction of houses, and 75% sold. Mr. Sorenson asked how many houses are actually completed, and Mr. Jacques said 10. Chairman Gilligan confirmed that the applicant does not intend to connect to Grant Road, and that Lisa Drive will be cul-de-sacced. Debbie Drive will not be connected to Newmarker Road, and the paving of Debbie will end at Lot 55. Mr. Clock said that is correct. 4"M M "44 -TO WI-L 0./-? Mr. Davies also noted that a drainage channel to the rear of the site must be regraded as needed to the west. The plans should have a stump dump addressed on then, plus a note addressing site stabilization outside prime seeding dates. Mr. Rennie made a motion to approve Application #353 with conditions that (1) all above modifications be noted on final plans, and (2) a bond of $5,000 be posted. Seconded by Mr. Lanza, carried unanimously. e. Application #356, #357 - Dart Hill Realty - Mountainview Estates Sections II, III Mr. Davies said that applicant has done a good job on Section I. Motion made by Mr. Moynihan to approve Section II in its entirety and to approve Section III road network and detention basin, with a $25,000 bond and with the conditions that (1) they pay careful attention to erosion and sediment control for the oncoming winter, (2) construction limit of 60 feet for roads and (3) same conditions as approval of Section I. Seconded by Mrs. Warren, and carried unanimously. Planning & Zoning Commission -3- 1/21/86 I They have been disrupted, and are not maintained. Mr. Wentzel said he would like to mention that this area is wet, even during the airy season and even building on a slab will create problems without a great deal of filling. He pointed out that traffic is also very heavy during rush hours , and this is a direct route from Route 5 to Route 30 . Mr. Lucek said they culd not afford to develop this ]little piece of property if they h d to put in 2, 000 feet of pipe. When the land to the west is d' veloped the Town Engineer will request drainage pipes and until then this system will work. 2. Application of Cla k Realty, Inc. for approval of 12 lots in Section 1 of Pleas nt Valley Homes II, an Open Space Resubdivision in an A-20 zone, b ing lots 9 , 10, 12, 13, 19 , 20 , '21, 22, 23, 24 , 25, and 26, to ated on Stanley and Sally drives, west of Clark Street. Attorney Raymond G. LFoll, of Rocky Hill, was present on behalf of the applicant. He ex lained that this was previously 'approved, but the plans were not fi ed within the 90 day period required by law. He is asking for the ame approval, except for Lot 11 which was not approved by the Inlan Wetlands Agency/Conservation Commission. He asked the Commission to take notice of all prior information and testimony. } Mr. DeMallie said all1his previous comments still apply and he has no further comments e cept to note that the plans should indicate 57 lots will be in th s subdivision, rather than 58 . Mr. Martel said he has nothing t add. Commissioner Hallowel questioned whether everything in the original approvals has been co plied with, and Mr. LeFoll said yes, to the best of his knowledgeland belief. Mrs. Klenke noted that Lot #11, which was not approved by IWA/CC, is supposed to be part o the area of the conservation easement, and asked if this is show on the plans, and whether the conservation easement has been sub fitted. Mr. LeFoll said that once they give up on Lot 11 that is the end of it for all times if they give the Town the Conservation ' easement. He said he doesn' t think IWA/CC had the right to require an easement, and they should have just denied the lot. Mr. Sorenson said that Mr. LeFoll is saying that they will not comply with a condition of approval.. There being no furthe comments the public hearing was closed. I . I I Planning & Zoning Commission -4- 1/21/86 SPECIAL MEETING Call to Order New Business 1. Pleasant Valley Homes II, Section 1 After a lengthy discussion concerning the submitting of the Conservation Easement for the area of Lot 11, the Commissioners concurred that it must be submitted since it is a condition of approval, even if Mr. LeFoll hoped to return to IWA/CC at some future date to try to secure approval of Lot 11. Arrangements were made for the signing of the mylars so that they could be filed immediately in order to permit closings, which had been held up for a few weeks, to be held. Mr. Hallowell made a motion to approve Lots 9 , 10, 12, 13, 19 , 20 , 21, 22, 23, 24, 25 and 26 in Section I of Pleasant Valley Homes II, as shown on plans prepared by Reino E. Hyyppa & Associates, dated 6-3-85, revised to 12-10-85, Map No. 43-80-1H, subject to the following modifications : 1. Within 90 days, black and white transparent mylars of Sheets #1, #2, #3 and #4, together with three paper prints, with all the letters of approval of this Commission as well as the Inland Wetlands Agency/Conservation Commission reproduced thereon, must be submitted to this Commission to be stamped and signed. Mrs. Rossi - tic""onded the mQtio and it was unanimously voted in favor and,-s"o or'd- ered. 2. App. #1111 - Dart Hill R It , Inc. , Mountainview Estates, Sections 2 and 3 e Commissioners.r- called that the question of road improvements was brou -uF' the public hearing. Mr. DeMallie suggested a phasing sequence for road improvements, and Mrs. Montana said there would still be a gap in time and people would be occupying the homes before the roads were improved. Mrs. Klenke asked which was most critical - Newmarker or Dart Hill Road. Mr. Sorenson said his personal feeling is that Newmarker is more important. Mr. Hallowell said the real problem is Dart Hill because of the traffic. This development will compound a problem which exists. Mr. Hallowell asked the Town Engineer if drainage will be improved and Mr. Martel said yes, they are also working on this in connecti• with Partridge Meadow. Mrs. Klenke recalled that the Commission Planning & Zoning Commission -5- 1/21/86 contacted Ellington rearding drainage, and Mr. Martel said yes, he had received a call from them. They will use the name policy that South Windsor is sing - zero run-off. Referring to Newmarker Road, Mr. Martel said the To n Council will have to vote to abandon it. As the Town' s traffic authority, I would required the proper posting of warning signs in both directions to advise motorists on Mill Road of the intersection, as well as double line the roadway through the intersection, for the prescribed measurement to create a no passing zone. View Estates, Section 3 Dear Mr. Jacques : During a recent street maintenance activity, our vehicle broke through the pavement on Lisa Drive.- "A visual inspection this date revealed additional settlement of the driveway and sidewalk to #111 Lisa Drive. This settlement or pavement failure should be investigated by an excavation process, removing the material to sufficient depth to determine the extent and the corrective action to be employed. This is to be accomplished with a Town inspector present. We would appreciate your completing this repair by May 1, 1990 . If you have any questions, I can be contacted at 644-2511. A request for corrective work was sent to the developer on April 4, 1990 with a requested completion date of May 1, 1990 . To date this work has not been started. Several verbal requests, prior to our letter, have also failed to achieve any resolution. Banach, Director of P an ing FROM: Jerry C. Iazzetta, Town Enginee RE: Bond Reduction Requests We have reviewed the bond reduction requests transmitted to us on January 23, 1991 by Ms . Michele Lipe and have the following comments : 1 . The bond reduction requests for Mountainview Estates and Partridge Meadows is dated October 15, 1990. We have responded to these in our memo dated November 7, 1990 and Mr. Ganticks memo dated October 19, 1990. In addition, Mr. Bo Davies wrote to JMJ Construction on January 9, 1991 indicating that the drainage problem on Natsisky Farm Road needs to be corrected before any bond reductions can be considered for Mountainview Estates . 2 . The January 22, 1991 request for reduction of the bond for Cambridge Estates asks for a reduction from $136 ,000 to $46,000 . On November 7, 1990 we recommended a reduction of this bond to $80,000 . We feel that this $80,000 figure is still appropriate. JCl/jsv cc: Michael J. Gantick, Director of Public Works ""ON a44 e P .a 9 ~ 1540 SULLIVAN AVENUE • SOUTH WINDSOR. Christian II Principal Civil Engineer Water Resources Unit, DEP State of Connecticut 165 Capitol Avenue Hartford, CT 06106 RE: #DS-89-082 Mountainview Estates Farm Pond Dam II Dear Mr. Christian: i A member of the Engineering Staff recently made a cursory examination of the above noted site which has led to a number of concerns that will have to be addressed before the Town accepts this structure. There appears to be a breach in the dam, permitting more water exiting the pond along the side of the pipes than through them. From our limited exposure, I don't believe this was what was intended. This particular structure is within a 27 acre open space parcel being given to the Town. The Town intends for this area to remain open to passive recreation activities . The outlet structure is not visible from the street and in an emergency situation, there isn't a safe access to this structure. The gate operating device should also have locking capabilities . In addition, the attempts to provide a permanent vegetative cover are not consistent with the "Connecticut Guideline Standards " . We are concerned about this project and if any remedial work is required, that it be done in a timely manner. Please advise as to your schedule for inspection and acceptance of this work.
