MEMORANDUM November 3, 1983
To: Planning and Zoning Commission
Re: Myette Industrial Resubdivision Application - Sullivan Avenue
Mr. William F. Myette has a four lot industrial resu divis on
application pending with the Planning and Zoning Conmiission.
At the October 4, 1983 public hearing, I observed that the
two large sheds located on the proposed lots 10 and would
fail to conform to the front yard setback requirements of the
Industrial Zone, and recommended that they be razed prior ro
filing of the final plans in the town Clerk' s office.
Mr. Myette subsequently informed me of his desire to utilize
these sheds for equipment storage until these lots Were ready
for building construction, if not before.
A number of options are available should the Commission
a) approve the application, and b) accommodate Mr. M ette.
First is to impose a condition that no building perm is be
issued on either lot until the respective building i razed.
A second condition could be to require surety to cov r the
costs of building demolition and removal. A third is to
require a Temporary and Conditional permit, (reducing the
front yard requirement) , from the Zoning Board of Appeals.
A fourth option is a combination of the above.
The most important notion here is to avoid creation of a
situation in which we have one or ' more buildings in violation
of zoning, to wit: the Jurgelas Subdivision on Chapel Road
which resulted in litigation over a nonconforming shed.

Imo. Bill O'Neill of Fuss & O'Neill was present with Mr. Myette and explained
that when this subdivision was approved last December, Lots #1 and #2 we e
- not included, and no building permits were to be issued until the sheds ere
removed. They would like approval of lots 01 and #2 and .also wou like tD
leave the sheds for storage. Mr. Hallowell asked if they could de onstr to
that Lot #1 has proper turning radius, and said lot1 is using to #2 t turn
trucks. Mr. Myette said his tenant's lease still has another 1-1 year to
run, and he had received permission from this Commission for outdo r sto age.
Mr. Hallowell said he thinks it still has to be shown that lot #1 can st nd
on its own and has sufficient turning radius. Mr. O'Neill said he think
they can show that but would like to do it at the time of site plan appr val.
Mr. Gilligan noted that when they come in with a site plan it wi be fo Lot 42,
and the Commission can't talk about Lot #1 at that time. Mr. Gi 'gan n ted
that the question is whether or not Lot #1 would be approved if it were site
plan, and some proof that it will work must be presented to the Co 'ssi n, and
the Commission can't rely on what the tenant says.
Mr. Conde noted that the next tenant may have more trucks, and Mr. Myett replied
that the 22' x 12' pad to the west is a boiler room and no other t nant ould want
it, and also there is a lot of storage running across the building which nobody
else would need. Mr. Gilligan replied that what he is saying that if th re was
a new tenant it might work out, and he told Mr. Myette the Commission wo ld want
to see that site plan. Nor. Gilligan went on to say that the Commission ould
like to see something proving that Lot #1 will work, if Lot 2 is evelo ed.

RE: Myette Industrial Subdivision
Dear Kevin:
This is primarily the same proposal that came before, and was
approved by this commission on September 21, 1981. The current
proposal was modified to include a construction schedILle and a
Erosion & Sediment control notes. It is a request to develop a
portion of a 7,- acre industrial park north of SullivanAvenue.
The Hartford County Soils Book indicates the Wetlands soil On the
site to be Walpole and the non-wetlands as Ninigret. Generially
most of the site was under cultivation and they intend to fill it
as needed.
My comments , as they relate to this project, if approved, would
include:
1. Show the stockpile area.
2. Delineate the detention limits, to Lots 3 & 10 (Phase I)
or complete as indicated.
3. Item 3 in the E & S notes, "restabilization will be
scheduled as soon as practical" , shall be revised to be
specific, like two weeks.
4. Give Item 7 some thought.
5. Any individual site development plan shall be submitted
for commission approval.
6 . A bond in the amount of $4 ,000 should be submitted with
the modified plans prior to any work on the site to assure
compliance with the sediment and erosion controls.
7. The applicant shall return to the Planning & ZoningCom-
mission to establish a bond as per Item 3 in the Planning

RE: INDUSTRIAL ZONE SUBDIVISION
SULLIVAN AVENUE
Dear Mr. Myette:
It appears that the entire frontage is currently being used as
access and creating a traffic hazard. I don't believe that
this was the intent. Would you make the appropriate adjust-
ment in the field.
Thank you.
Very truly yours,
