Town Hall 1540 Sullivan Avenue r South Windsor, CT 06074 RE: The LaCava Construction Company-- Beechwood Farms Dear Dick: Peter Demallie and I havelhad some discussions about correct- ing an error made by the own of South Windsor ' n recording a deed delivered in escrow with respect to the above sub- division. It was agreed hat the office of cor oration counsel might assist in aisolution. What follo s is a brief history of the problem. In connection with the ap roval of the Tudor Hill III tract in 1978, the LaCava Const uction Company submitted t Town a deed dated Novembe 20, 1978, to land described as "Proposed Future Open Space" on the Tudor Hill Sect. III key map. By the terms of the subdivision approval of Tudor Hills III and the tender letter from my office dated November 21, 1978, it isiclear that this deed was to be held in escrow pending development of adjoining land. The adjoining land was t e subject of the Beec wood Farms subdivision approval of ctober 2, 1980, and the layout of that subdivision shows ao open space area the a2d0,i1978ded in the previous deed to he Town dated November The express terms of thi approval provide that the Town will hold the deed in esc row. For some unknown reason, ithe deed to the "Proposed Future Open Space" land was recorded by the Town on August 31, 1982, in connection with final acceptance of all roads and open space in the Tudor ill tract. However, it is quite likely t at LaCava will seek reapproval of t is land for developme t, and we would like to confirm the status of the land in luded in the deed. LaCava does not request a deed back to the subj ct land, but there should be some confrmation by the Town o South Windsor that the land wil ' be considered open space area in any future application fo subdivision approval of the Beechwood Farms tract. Application of LaCava Construction Co. , for an open space f subdivision in an A-20 zone, consisting of 31 lots, located at the easterly end of Quarry Brook Drive, known as Beechwood Farms, Section I. Attorney Edward S. Hyman was resent, along with Joseph LaCava, and William O'Neill, of Fuss & O' eill. Mr. Hyman said this is the exact area which was the subj ct of an approval on September 23, 1980. The number of the lots and the general configuration have remained the same. The sanitary sewer pump station was a question at the first approval and that has been resolved since this subdivision will now be served by a gravity sanitary sewer so there is no need for a pump station. A question was also raised at that time about another access road fromthe subdivision and provision for that has now been made when the subsequent section of this subdivision is developed. This subdivision is adjacent to Tudor Hill, Section III, which was also developed by LaCava. Mr. Hyman noted that the Commission has before it two sets of plans. The first is dated August 16ta and the second October 17th. When the plans were first submitte , comments were made by town staff, and Fuss & O'Neill responded and have included all the comments on the revised plans dated October 1 th. Mr. Joseph LaCava then reiterated that the Commission's concerns about the original approval in 1980 have been addressed. There is now a gravity sewer and there will be a second access road to Clark. The homes will be compatible to Tudor Hill - slightly larger - and be priced from $150, 000 to $2 0,000. They expect to put the road in during the spring and summer of 1986, and the houses will be constructed afterwards. Town Planner Peter DeMailie reported as follows: Plans were submitted to the Soil & Water Conservat on District and a report from them should be received in about two weeks. The zone change to A-20 was approved in 1979, and a subdi ision was approved in September, 1980. This subdivision is substanti lly the same except for the following: Sewers are gravity flow through Pleasant Valley Homes II to the Clark Street pump station. W CA has approved this sewer plan, and Clark Street pump station can handle it. There is an outlet to Clark Street via Pleasant Valley Homes II. Brookhaven Lane does not have a stub to the east since it' s not necessary. I Planning & Zoning Commission -2- 10/22/85 They are asking for 31 lots in Phase I, and giving the Town 9 . 01 acres of open space. The plans dated October 17th, differ from the August 16th plans in the following manner: Quarry Brook Drive is aligned with the Pleasant Valley Homes II street system, and the Pleasant Valley street system is shown; Section 2 streets/lots and lot numbers are shown; Open space is identified; The proposed stump and soil stockpile area is indicated; Total number of lots is given, as well as number of lots allowed; Allowable lots and open space calculations are given; The 100 year flood is addressed; It is noted that pins are to be set at all lot angles; The open space is identified as Beechwood Farms; They have added a notation about the driveway location for lot #31; An open space improvement plan has been added showing monuments and open space improvements. . Mr. DeMallie concluded by making the following recommendations - and comments: Consideration should be given to temporary stockpile and stump deposit areas, which should be in an area requiring minimal clearing of mature trees; Routing of heavy construction equipment should be considered; Interim cul-de-sac in the vicinity of Lots 32 and 52 should be addressed; The topo map should reflect front yards along all street lines which will affect Lots 3, 4 , 7, 22, 26, 14 and 18; Lots 1, 23, 24, and 25 have minor encroachments in the FP zone, which is not a problem since it is outside of the building lines; The wetlands areas on Sheet 6 differ somewhat from the official wetlands map, and presumably were determined by a soil scientist; The Town Plan draft supports this proposal; The grading plan on Sheet 6 requires slope rights from abutting property owners; Sidewalks should be on both sides of Quarry Brook Drive to tie into the Tudor Hill and Pleasant Valley II network; The question of what happens to the channel protruding from the kettle hole once the kettle hole is filled should be addressed. Mr. DeMallie said he recommends approval after consideration of the concerns raised tonight, barring any major problems raised by SCS. . The Town Engineer, Richard Martel, then gave the following report: There is a flood plain that runs through the area and this site is affected by it. The applicant has contacted FEMA and have obtained a preliminary positive response, but something in writing should be submitted indicating that this is in accordance with their regulations as well as the Town' s. Basement elevations should be above flood 1 Planning & Zoning Commission -3- 10/22/85 y elevations, and the soil conditions require foundation drains for each and every residence. A fence is shown at the brook crossing, and this iihould be changed to metal for maintenance and safety purposes. The fen a should be moved within the I Town right-of-way and within the street line, and it should also be extended 60' on both sides At the junction; of the 72" and 24" ' pipe there should be some sort of structure - a- manhole or catch basins. The plans call for modified rip rap on the south side of the crossing and that should be changed to standard rip rap. ' A catch basin should be added to the southwest corner- of Woodhaven and Quarry Brook. There is very good possibility that some difficult soil conditions can be 'encountered and the option of increasing the road base may a taken advantage of. No one spoke in favor of the application. Mr. Keith Widlanski of Evergreen Lane raised a quest on about the access road which is not shown on the plans. Mr. 'Neill explained that access will be through Pleasant Valley Homes II to Clark Street. Chairman Gilligan asked if this meant there will be no access to Clark Street until Phase II is approved, and Mr. O'Neill said yes. Joseph LaCava was present, and said that they would be pleased to build the entire subdivision in one section since it would be easier . for them to do the work and would be advantageous to the neighborhood to bring in heavy equipment f r the entire development at one time. He said LaCava is willing to immediately come back to PZC for approval of Phase II, and it would be iis preference to build it at one time. Mrs. Maureen Teachman,of Quar y Brook Drive, stated she is in favor of LaCava building both secti ns at one time, since she would not want to see Quarry Brook Drive as he only access for another 30 homes. Mrs. Teachman said she also w uld like to see large truck traffic, such as lumber trucks, prohibited from coming in through Quarry Brook Drive in view of the number of small children in the development. - She also expressed concern about the water pressure to her house, and whether it would be affected by the new construction. Mr. Martel replied that the water pressure is under the control of MDC and they are also concerned. There is a possibility that pressure might be improved since this construction will complete a loop. Mr. Gilligan asked the applicant if they have considered the access to the development during construction. Mr. LaCava said they are very conscious of working in a neighborhood with children. They hold seminars: :and send letters to people in the neighborhood. He noted that if they are allowed to build both sections at one time, the equipment can stay on the site. With proper schooling and monitoring it can work. Mr. Gilligan asked if they intend to bring equipment in through Quarry Brook Drive, and Mr. LaCava replied that until the roadway is complete there is no other way in but Quarry Brook. He noted that Balf can pave the entire roadway in one day. Planning & Zoning Commission -4- 10/22/85 Mr. Robert Toma,of Quarry Brook Drive, asked about the possibility of a temporary road from Clark Street. Mr. DeMallie said they would need permission of the property owner who is J. M. J. Construction Company. Mr. LaCava said he has not spoken to J. M. J. Mrs. Teachman said if LaCava is given the opportunity to develop both phases at the same time, couldn' t the equipment come to the site via Pleasant Valley Homes? Mr. DeMallie responded that there are people living in Pleasant Valley Homes also. A gentleman in the audience stated that he would like to see side- walks on both sides of the streets. Mr. Hallowell asked how they plan to handle the stump deposit area. Mr. O'Neill said they will walk the site and locate an area, and after the stumps are placed in the area it will be filled and covered, and will become an attractive area. Mr. Hallowell said that in 1980 the Commission was looking for an open space area that could be used for a ballfield or open flat area, before completion of Phase II. The area around lots 20, 21 and 19 was considered. He asked what they are planning to do about that. Mr. O'Neill said they plan to leave the area natural, and there will be no ballfield. It will be a walking area. Mr. Hallowell said he would like to see consideration given to an active recreational area. Mrs. Montana said the stump area is next to a lot, and questioned whether someone buying a $200, 000 home would like this area next to their house. She asked if this will be an unsightly dump. Mr. O'Neill responded that it won' t be visible with the foliage, and Mr. LaCava pointed out that within 72 hours the area will be filled in, seeded and planted. Mrs. Montana said she can see the logic of putting in the entire roadway for both sections at one time, and asked if they would want permission to put in the houses also. Mr. LaCava said he is willing to limit the number of houses per year if the Commission requires it. Mr. Sorenson said he does not like the idea of using open space for depositing stumps or anything. The developer is giving the Town open space and he personally finds it offesnive to use it for this purpose. Commissioner Klenke raised a question about the street names and where Quarry Brook Drive will end. Mrs. Montana said she thinks it should continue right through Pleasant Valley Homes II. Mrs. Klenke said she agrees that it is disappointing to see trees removed so there can be a storage area for stumps when the stumps could be taken off-site. I I Planning & Zoning Commission -5- 10/22/85 i Commissioner Asplund said he assumes there will be abutters on Stanley Drive, and they are not shown on the map. Mr. O'Neill said they are appearing tonight on only Phase I. and those property owners will abut Phase II property. Mr. O'Neill added that he doesn' t think there were any people in there in July when the maps were prepared. Mrs. Rossi raised a question about the drainage easements and - ► basement drains. Mr. O'Neill responded that there is no problem with any drainage easements t ey need, and Mr. LaCava' s policy is to place basement drains in all of the houses he builds. Mrs. Rossi then asked about increased run-off because of the houses being built. Mr. O'Neill sai they determined that it was proper storm water management to all w the water to flow directly into the brook and then quickly into the pond and that will allow it to get to the river as quickly aE it can. The erodibility of Quarry Brook is not of concern because they have a large amount of undisturbed area even on the lots being developed since they are wooded. Mr. Martel noted that he has been in touch with Mr. O'Neill about this but hasn' t had the time to do the proper research. However, it was suggested to J. M. J. that the subdivision to the north do the same thing, but they thought it might cause a time delay and therefore went ahead with the current policy which is zero increase. Mr. Martel said Commissioner Conde has requested a report concerning the current policy and that is something he wants to do into with the Commission. There are different options, and this is one of them. He noted that off-hand he doesn' t have a problem with it, but still wants to go through the numbers which Mr. O'Neill has provided. Chairman Gilligan asked if Mr. LaCava intended to sell any of the _ lots. Mr. LaCava replied that if anyone wants to buy a lot they will have to buy the house that goes on it. Mr. Tom Leonard of Evergreen Rane suggested that if Mr. LaCava needs a place to fill, he could the rear portions of the lots on Evergreen. He also asked how large the houses would be, and Mr. LaCava said tentatively about 2200 s. f. to 3,000 s. f. There being no further comments, the public hearing was adjourned. REGULAR MEETING Call to Order nublic Participation - None New Business 1. Applications to be officially received: Planning & Zoning Commission -6- 10/22/85 a. Harold J. A. Collins/Post Road Stages, Inc. Subdivision and site plan, south side Strong Road, RR zone b. Andre Charbonneau, Site Plan, Parcel 2, Nutmeg Road, I zone Mr. DeMallie reported that item "a" is for an amended site plan to allow construction of a shelter for buses. Mr. Collins has filed an application for a variance with the Zoning Board of Appeals since the regulations only permit 10% lot coverage in an RR zone, and he will have about 20% coverage. The secretary noted that item "b" should also indicate a subdivision application has been submitted as well as a site plan. Mrs. Montana made a motion to amend the agenda to indicate item "b" is for a subdivision as well as site plan. Mrs . Klenke seconded the motion and it was unanimously voted in favor and so ordered. Mr. Sorenson moved that both of the above applications be officially received. Mrs. Montana seconded the motion and it was unanimously voted in favor and so ordered. 2. App. #1047 - Bridlewood Estates (Uccelllo & Ireland Builders) Mr. Martel recommended that the bond amount in the above matter be set at $250, 000, and reduced by $160,000, to $90, 000. Mrs . Klenke made a motion setting the bond at $250, 000, and reducing it to $90 ,000. Mr. Sorenson seconded the motion and it was unanimously voted in favor and so ordered. 3. App. #1113 - East Hartford Welding Co, Site Plan Bill O'Neill of Fuss & O'Neill was present with Mr. Ken Corneau of East Hartford Welding. Since discussing this matter last week with the Commission, Mr. O'Neill said his client prefers to put the Town road in. They have the right-of-way and can drain and put in a cul-de-sac. Mrs. Klenke asked if they have permission for the road cut from East Hartford, and Mr. O'Neill said they have a verbal commitment and do not see any problems. Mr. Martel said he also talked to East Hartford, and the only question they raise is drainage to Burnham Street. They do not want it. Mr. Martel noted that a 26 ' road is shown and the subdivision regulations call for 30 ' , except in residential subdivisions. He said it is up to the Commission if they want to approve the 26 ' wide road, and said he has no problem with it. He did note that this road will open up land to the east to further development which might someday require a 30 ' road. Mr. Martel estimated the additional cost for a 30 ' roadway at $3, 500. A lengthy discussion ensued among the Commissioners, the Town Engineer and Messrs. O'Neill and Corneau, with the final consensus being that the 30 ' wide road would be preferable. Mrs. Rossi made a motion to approve the site plan of development for property located on the north side- of Burnham Street, as shown on a plan prepared by Fuss & O'Neill, dated Sept. 1985, revised to 10-7-85, Proj . No. 85-360-A, subject to the following modifications : Zoning Commission -7- 10 22 85 i Planning & Zo i g issio / / I. The street name and location of fire hydrants is subject to approval of the Fire Marshal. 9 . A typical road cross- eation should be shown on the plans. 10. Quantity estimates must be submitted to the Town Engineer for the purpose of determining bonding, and the bond must be submitted prior to filing the final plans. The Commission voted to accept a letter of credit for a one year term in lieu of a surety bond. The letter of credit must be renewed on a yearly basis until completion of the development. If a ne letter of credit has not been received within thirty (30 ) da s before the expiration date, the Commission may, at it option, call the letter of credit it is holding. 11. A liability insurance policy shall be submitted to this Commission naming the Town of South Windsor as an insured with a combined single limit for bodily injury and/or property damage in the amount cf $1, 000 ,000. 12. The mylar must be filed in the Town Clerk' s Office within 90 days of the date of approval (by 1/20/86 ) . ; Mr. Sorenson seconded the motion and it was unanimously voted in favor and so ordered. _ 4 . App. #1115 - Post Road Stages, Inc. /Harold J. A. Collins Site Plan and Subdivision, south side of Strong Road, RR zone Mr. Collins explained that basically what he is doing is putting a roof over 8 buses. Three sides will be closed and the north side will be open. There are no doors, and it will be constructed on piers. They would like permission to start right away before cold weather starts. The builders are waiting to start. All the other buildings were built when this was a commercial zone. This will improve the appearance and get the buses covered. Chairman Gilligan noted that the subdivision is because a new line will be drawn at the rear of this property. Mr. Hallowell noted that this Commission cannot give Mr. Collins permission to build without a variance. Mr. Gilligan noted the alternative to securing a variance is to create a larger lot, and there' s plenty of room to do that if necessary. Mr. Hallowell said the Commission can approve this site plan pending a ZBA approval of a variance, and if Mr. Collins chooses to put the building up prior to securing the variance he does so at his own risk. Mr. Collins said he is willing to do it at his own risk. Mr. Sorenson said he sees nothing wrong with putting the piers in at their own risk. Mrs. Rossi made a motion to approve the above application for a site plan of development, and subdivision of property located on the south side of Strong Road, as shown on a plan prepared by Petersen & Hoffman, L. S. , dated Oct. 1981, revised to Sept. 1985, subject to the following: 1. Applicant must obtain a variance from the Zoning Board of Appeals for maximum percent of lot coverage, and the site plan shall note that the variance was granted. 2. A subdivision map, portraying the new enlarged lot, must be submitted in accordance with the Subdivision Regulations. 3. The plot plan should be entitled "Site Plan of Development" and only the new lot lines should be shown. The previous 185 ' rear lot line shall be deleted. 4. No building permits shall be issued until the final plans are on file in the Town Clerk' s Office. Planning & Zoning Commission -9- 10/22/85 i Within 90 days of the dare of approval (by January 20, 1986 ) black and white transparent mylars of the site plan and subdivision map, together with three paper prints, with the letter of approval of this Commission reproduced thereon, must be submitted to this Commission to be stamped and signed. The mylars will then be filed in the Town Clerk' s office. = I Mrs. Klenke seconded the motion and it was unanimously voted in favor and so ordered. - 5. Timber Ridge Subdivision Bond Reduction = ' Mr. Martel reported that he has not yet inspected this site. Mrs. Montana moved that the request for the bond reduction in this matter be tabled. Mr. Sorenson seconded the motion and it was unanimously voted in favor and so ordered. 6. App. #10 8 2 - Robins Wood Mr. Martel recommended that tie $30, 000 bond in the above matter be reduced to a $3,000 mainte ance bond. Mr. Sorenson moved that the $ 0,000 bond be reduced to a$3,000 maintenance bond for one year. Mrs. Rossi seconded the motion and it was unanimously voted in favor ani so ordered. 7. App. #1100, 1101 and 1102 - Alexander Terlizzi, Resubdivision of 7 lots, and Site Plan of 'Development for Lots #2 and #6 Mr. Steve Seliger of Landscap Architectural Design Associates was present and explained that Ru so & Palmberg asked him to prepare a landscape plan to buffer the esidential areas across Burnham Street in East Hartford. Mr. Selige said the area along the property line is fairly extensively treed with large trees. These trees will be left as a canopy. They will reate a number of 3-4 ' berms to possibly hide headlights. The-re will be a double row of pines creating a solid row of evergreens. Flowering shrubs will be added at the entrance along with other plantings. Each lot will have its own landscape plan also. It would be a good idea to plant the pines and shrubbery now, so they will have a chance to grow before these lots are developed. Mr. Hallowell pointed out that the only way the Commission can guarantee that the trees will remain along Burnham Street is to take a Conservation Easement. Mr. Sorenson questioned what would happen if East Hartford widens Burnham Street. Mrs. Rossi asked if the berm would be intact if Burnham is widened and Mr. Martel said it would not affect the berm. After further discussion, Mrs. Montana made a motion to approve the application of Alexander Terlizzi for a resubdivision of property located on the north side Planning & Zoning Commission -10- 10/22/85 of Burnham Street, in an Industrial zone, into 7 lots, as shown on plans prepared by Palmberg & Russo, dated 3/24/85 , revised to 4/29/85 and 6/28/85, with modifi-ations. Prior to filing the final plans the following conditions must be complied with: 1. Approval must be obtained from the Inland Wetlands Agency/ Conservation Commission, and this approval is subject to their conditions of approval. 2. All lots will be connected to the Metropolitan District Commission sanitary sewer system and is subject to approval of MDC and the South Windsor Water Pollution Control Authority. 3. Water will be provided to this site by the Metropolitan District Commission, subject to the approval of the South Windsor Town Council. 4 . The road cut onto Burnham Street must be approved by the Town of East Hartford. 5. The plans and profiles shall be modified to show a typical road cross section, and the cul-de-sac must have a 42 ' radius in accordance with the Subdivision Regulations. 6. Dear Mr. LaCava: At its meeting on January 27, 1986, the Inland Wetlands Agency/ Conservation Commission discussed your Application No. 361 , for Beechwood Farms Subdivision. The Commissioners have indicated that more information on the following issues is necessary before a decision can be made: 1. A proposal for stump disposal is needed - not in wetlands floodplain or open space. If on site, should be within subdivision grounds; if off-site, trucked away. 2 . Stability of fill in road crossing Quarry Brook, and steepness of the side slopes. 3. Address concerns notea in correspondence from the Hartford County Soil and Water Conservation District dated October 30 , 198 (copy enclosed) . 4. Soil stockpiling areas should be indicated. 5. Entrance pad should be delineated. 6. Limits of constructio should be noted on plans. 7. Details of sinkhole filling should be supplied. 8 . Preservation of some of the sinkholes should be addressed. 9 . Routing of construction equipment and dust control. Mr. Joseph LaCava January 30, 1986 Page 2. DeMallie and Martel went over the comments they made at the public hearing. The question of how construction equipment will enter the site was raised. Mr. LaCava was resent, and said they would be willing to come back to the Commission ight away from Section II, so that equipment could be brought in b th from Quarry Brook and Clark Street. He noted it will not be a treee dous amount of equipment, because they plan to put in all the roa s first and pave them, and then come back and build houses. The location of an area for dep siting stumps was discussed, and the Commissioners felt it should no be in open space. They also noted that if they have to be stored n a lot, the trees would have to be cut. Mr. LaCava said he is willing to move the stumps off the site if he cannot satisfy the ommissions in selecting an area. The Commissioners agreed there should be sidewalks on both sides of the main street, and none woul be required on the little cul-de-sac streets. Let me briefly explain Corps jurisdiction. A Corps of Engineers permit is required for all work beyond mean high water in navigable waters of the United States under Section 10 of the Rivers and Harbors Act of 1899. In New England, for purposes of Section 10 , navigable waters of the United States are those subject to the ebb and flow of the tide and rivers, lakes and other waters that are used to transport interstate or foreign commerce. Permits are also required under Section 404 of the Clean Water Act for those activities involving the discharge of dredged or fill material in all--waters of the United States, including not only navigable waters of the United States, but also inland rivers, lakes, and streams , and their adjacent wetlands. On the coastline our jurisdiction under the Clean Water Act extends landward to the extreme high tide line or to the landward limit of any wetlands. Please furn..sh this office with additional information so we may determine whether a Department of the Army permit is required. A copy of our pamphlet on the permit program is enclosed for your assistance. May 5, 1988 Dear Mr. LaCava: I have reviewed the revised plot plan submitted for a building permit for lot 25 and it is being denied again. It appears from the plot plan submitted, and from the activities on this lot, that an encroachment into the conservation easement is proposed and has occurred without proper authorization. This is a difficult lot with the garage corner a little over 6' from the conservation easement. Perhaps once the encroachment has been resolved, a more detailed plan based on a field location of the watercourse, existing and proposed contours based on a field survey, and real method of preservation of the conservation area with the house location as indicated would be helpful.
