These soils were located by the New England Environmental Service and are substanially as shown in the soils book. For all intents and purposes, the roadways have been roughed in together with storm, sanitary, water and gravel 'as per Section 4 approval. During and since this construction, concern has been expressed about the large quantity of ground water coming from the north, basically, and for tree preservation. The plans indicate about 3 feet of fill through the wettest area and the front 100 ' shall be void of trees. It is also my understanding that plans showing drains for the area are to be submitted. Note #9 on Sheet 6 indicates, "all significant specimen trees 12" or greater in diameter will be protected whenever possible", is a fine proposal. It seems the plans should show all the 12" diameter or greater trees that will be protected as shown on Sheet 10, on the plans. The areas of concern notes on Sheet 11, No. 1 "outlet into', exsting detention basin", needs some explanation. Forty feet of tip rap never has been a concern before. Item 2, wind and water erosion is a natural concern. Identify on the plans what method they will recommend and practice in Section 5 to provide wind and water erosion. For instance, I want all disturbed areas sodded, as shown as an option on Sheet 11. i Mr. Kevin F. Rennie - 2 - April 8, 1987 RE: Mountain View Estates A concern that has not been addressed is the ground and surface, water runoff and the tree preservation. If an approval were to be considered, a bond in the amount of $25,000 could be appropriate and should be deposited with the town prior to any further work and subject to the following conditions: 1. Modify the plans to show methods of handling the water runoff. 2. Modify the plans to show all the significant trees 12" diameter or greater. 3. Modify the plans to show the sedimentation and erosion controls they plan to use. 4. Submit 3 sets of the modified drawings as approved prior to further work on the site. 5. A general observation is that the house sizes shown are about 70" x 35 ' and are on lots with a minimum 10 ' sideyard. The possible location is relatively accurate. Lots 132, 133, and 134 appear to have perhaps 4 ' of exposure above original ground and could be graded appropriately, leaving 2 ' of concrete showing. The other lots 13, 139, and 140 are deeper, with perhaps less grading problem. A specific problem could be the foundation drain on lot 140. For the Commissions ' feet on observation, lot 132 was cleared a couple of months ago. Perhaps a layout on the ground, of this house by the applicant would provide an opportunity for the members to see what could be, or should be, saved; the preservation of the 20 ' tree growth between the houses, etc. If approved, the Commission should change the "not approved" status and appropriate conditions that went with Section V. The settled or broken sidewalks on Debbie, lot 10 and house numbers 15, 34, 88 and 111 (3) , Newmarker Road numbers 15 & 45, Jessica Drive number 85 and Lisa Drive, numbers 20, 28, 42, 89, 90, 120 and 141 (2) should be replaced. 4 . On Natsisky Farm Road, between house numbers 75 & 87 where the future street will be built, the ends of their concrete sidewalks should be connected with a temporary sidewalk to permit through pedestrian travel. 5. The riprap channel between the large detention basin and Debbie Drive should be cleaned of trees, grass cuttings and other debris. 6 . Dart Hill Realty Mountainview Estates Subdivision Dear Attorney Kindl: It is my understanding that you are the legal advisor associated with the above noted subdivision. The subdivision improvements are essentially completed, and with some adjustments it is expected that the transfer of title could be completed before the end of the month. The development process in South Windsor requires that the deeds for the streets, open space and easements be submitted to the Town, prior to filing the mylar maps, to be held in escrow until such time as the subdivision improvements are accepted by the Town. This provides for any changes encountered during the development to be incorporated in the final documents . We are now at that point and need your assistance. In Phase I, the open space configuration was modified and a new plan was filed on November 14, 1990 which is not reflected in the 1985 submittal. A modified or revised deed will be required. For your convenience I have enclosed a copy of the 1985 deed and the 1990 map. The streets in Section 4 have been deemed acceptable and those in Section 5 are not, at this time. The Warrantee Deed should be modified to separate the streets in sections . In addition, the area reserved for the future roadway (21,727 SF) should be a part of the Section 4 Street Deeds. The Open Space Deeds in Phases 4 & 5 do not reflect what is shown on the filed maps, numbers 1753A & 1845A. There should also be a copy of the filed document of the 0.72 acre parcel being deeded to the adjacent property owners. .-_--- • - •,r F ,r, ,z.*,: ':.{4 :Y- •at.' _ `}." Baseel: We have received your letter of November 11, 1991 concerning the sidewalk problem in front of your house at 141 Lisa Drive. It is understandable that you are concerned about the reoccurrence of the "sinking" problem and the repair of it becoming your responsibility. Presently JMJ Construction Co. is responsible to make any repair/corrections necessary through October 31, 1992. At that time, normally, the responsibility for the maintenance of the sidewalk would revert to the property owner, as per Town Ordinance #115 . As you have indicated, this has been a recurring problem which has been repaired each time by JMJ Construction Co. The cause of this sinking is unknown at this time, and any conclusion as to why it happens would be speculation. If Mr. Davies conclusion as to why this happens is correct, his suggestion may work for a short time, however the material would still migrate through the filter fabric but would do so at a slower rate. If this "sinkage" does occur before October 31, 1991, the Town's Engineering Department will have JMJ Construction at this location to repair the problem. We will, with JMJ, do some exploratory investigation to .discover the actual cause. A method of repair will then be decided upon and implemented. Because of the frequency of occurrence of this problem, we can assume that if it does not reoccur by October 31, 1992 the problem has been corrected. We hope that this will ease your fears concerning your liabilities in this matter and that this will be resolved soon. Very truly yours, Jean E. Zurbrigen Town Manager JEZ/jsv cc: Michael J. Gantick. Director of Public Works , . MEMORANDUM November 25, 1991 TO: Jerr ' Iazzetta, Town Engineer FROM: Ron Asselin, Street Supervisor ` RE: 141 Lisa Drive The Street Department responded to a complaint at 141 Lisa Drive on November 23, 1991 involving roac[ and sidewalk underminings. My findings revealed four sections of sidewlak and a hole the size of a baseball are clear evidence of the reported undermining. This isn 't the first incident we've had to respond to. April 1990 a contracted street sweeper broke through the pavement in the same area. After inspecting the baseball sized hole that has developed in the roadway surface, a cavity of 2 1/2 to 3 feet deep lay beneath the road. The severely fractured subbase displayed evidence that serious pavement failure was eminent. The sections of sidewalk in question are experiencing the same type of fatigue. The two sections of walk to the west of the driveway at 141 Lisa are the most dangerous to pedestrians. The cavity that lay beneath the sections displayed no base present after the recent rain storms. It is conceivable one more heavy rain storm more than 1 inch could collapse the two sections leaving the walk unpassable and hazardous to area residents. I spoke with the residents from 111 and 141 Lisa during my inspection. Both residents are concerned that the repairs made many times in front of ther properties are still showing signs of failure. Because pavement failure exists our department has temporarily barricaeded the areas in question. Please investigate JMJ 's status in making these repairs. If repairs aren 't made swiftly pavement failure could jeapardize travel of vehicles using the shoulder of the road daily, (i . e. , snow removal equipment , school buses, refuse trucks, etc. ) RA/ds cc: Mike Gantick Bo Davie Mel Stead jt,t ce SIOU& ?40&U1460t 1540 SULLIVAN AVENUE • SOUTH WINDSOR.
