I have conducted an on-site soils investigation of the property located on Sullivan Avenue and Rye Street in South Windsor, Connecticut. The principal purpose of this soils investigation was to locate and flag in the field all poorly drained and very poorly drained soils or "wetlands" as defined under the Inlands Wetlands Act. The flags will be located by survey and plotted onto the site plan or topography map. In this soils investigation and report, the sdil classifications, soil textures, descriptive terms, and drainage classifications follow the guidelines and criteria of the National Cooperative Soil Survey. FINDINGS---- The soils on the property consist of sands over varved silts and clays on a very gently sloping to nearly level slope. The soils range from moderately well drained to well drained over the property. The upland soils on the property include both the Melrose sandy loam (MmA) and Elmwood (EnA) . If the -varved silts and clays are below 40 inc es, these soils will go into the sandy soils such as Windsor loamy sand and Sudbury fine sandy loam. The upland soils were not checked in detail, only to check for poorly &ained and very poorly drained soils. For more detailed information on the above named soils, see the Hartford County Soil Survey. The only "wetlands" located on the property is an intermittent brook that flows across the property from south to north. Part of this brook was channeled and is very straight. To the north this brook becomes a very deep entrenched gulley. This gulley has cut down into the varved silts and clays. One branch of this gulley has cut into the open field. In this location there is -a proposed 20-foot drainage easement. Most of this gulley should be filled and stabilized in the area of the proposed easement. The flagged area of the intermittent brook includes the bottom of the channel, small areas subject to frequent flooding, and most seepage areas along the sides of the channel. It does not include all slopes because many of these slopes are well above any water line and are completely dry or consist of well drained soils. There is some erosion occurring is occurring in the brook channel in places. However, the vegetation is holding most of the area in place. The greatest erosion area is the area of proposed drainage easement and was addressed above. The varved silts and clays are not eroding as a very rapid rate. Any attempts to change the shape of the stream ed may cause additional problems. If there are any questions, please do not hesitate to contact me. Re ctfully submit ed, r ,al enry . Rennie, Chairman South Windsor Inland Wetlands Agency/Conservation Commission 1540 Sullivan Avenue South Windsor, CT 06074 RE: Phase II, John Fitch Industrial Centre Plan Review Dear Kevip: This proposal for the development of this 66+ acre parcel is primarily for the roadway and utilities to service 33 potential lots. The plans indicate a field location of the wetland limits along the water course. This falls within the limerick series which is a poorly drained soil that is too wet for most crops. The activity proposed would be for the storm drainage install- ation. The balance of the site is apparently of the Sudbury Type, rapidly permeable, subject to a high water table with the possibility of the subsoil waterlogged during a wet season. This subdivision is not for residential purposes and basements should not be a factor. If an approval were to be considered, I would suggest the follow- ing conditions. 1. That other than the storm drainage off the road and the construction of the stockpiles, that the roadway construction limits shall be no greater than 701 . That the roadway shoulders will be stabilized and seeded promptly. 2. That the plans be modified to show the specific seed- ing mix method and when to be used. 3. Submit a realistic time frame to install a 2,000 LF roadway with utilities. I would encourage limited exposure to wind erosion. 4 . That no building permits be issued until the site is stabilized. Mr. Kevin F. Rennie May 1, 1987 RE: JFI Center Plan Review Page 2. 5. Modify the plans to show the tree line. 6. Submit 3 full sets of modified plans prior to any work on the site. 7. A bond in the amount of $20,000 be submitted to assure compliance with their plans. It should be noted that all of the site work could be done before the plans are filed. Very truly yours, A. The design and construction of the improvements should be coordinated between the developers and one plan for the improvements should be submitted. It is anticipated that improvements will include: 1. Signalization of the Route 194-Rye Street intersection. 2. Widening and realignment of the Route 194 and Rye Street intersection to provide for two lane approaches on all legs. 3. Widening of Route 194 to provide for two westbound travel lanes from Rye Street to Route 5. 4. A 500' extension of the exclusive left-turn la.ne on southbound Route 5 at its intersection with Route 194. It should be noted that the review of the Rye Street Business Park is ongoing and that the above listed improvements are subject to change. In addition to the above improvements the following is required of the John Fitch Industrial Center, exclusively. - Construction of a left-turn bypass area for northbound Rye Street at its intersection with Commerce Way. A 22' half-section is suggested. If it is anticipated that the John Fitch Industrial Center will open before the completion of the equitable improvements listed above, the developer should submit separate plans for partial improvements that offset the development's traffic impact. The situation , as we understand it , is: STC Criteria Current JFIC Over Criteria Total Parking Spaces 200 201 2 Total Square footage 100 ,000 103 ,000 3,000 A solution, with pr}:cedence, has been suggested by Mr. Hesketh, our traffic engineer . This action will yield the following compliance level : STC Criteria Revised JFIC Under Criteria Total Parking Spaces 200 199 1 Total Square footage 100 , 000 99 ,200 1,800 This solution was successfully applied in a similar situation by Anderson Laboratories of Bloomfield when they unknowingly violated the STC criteria. Drawer A Wethersfield, CT 06109 RE: Certificate Application John Fitch Industrial Center, South Windsor STC No. 132-8712-01 Our File #8708 Dear Mr. Stoeckert: On December 15, 1987 , we submitted an application on behalf of the John Fitch Industrial Center in South Windsor for an expansion of a previous industrial facility. At that time the John Fitch Industrial Center Phase I was under construction and provided less than 100 , 000 square feet of floor area and less than 200 parking spaces. The expansion for which we sought certification would extend Commerce Way from a dead end to a new intersection with Rye Street and would provide a subdivision with an anticipated maximum floor area of 270, 000 square feet and 500 parking spaces. That application included recommendations and plans wherein the developer expected a certificate with a condition that he provide for the widening and realignment of Route 194 at Rye Street and the reconstruction of a portion of Rye Street. In addition, the developer would have no objection for equitable participation in the signalization of the intersection of Route 194 at Rye Street. On February 29 , 1988 , you advised us that the review of the application could not be continued pending receipt of additional data in your office. That request was prompted by the on-going review of the Rye Street Business Center proposed by Culbro Land Resources Inc. and resulted in a requirement that the developers coordinate and prepare a single plan for the improvements which would include, in addition to the signalization and widening of the Sullivan Avenue/Rye Street intersection, the widening of Route 194 to provide for two westbound travel lanes from Rye Street to Route 5 and a 500 foot extension of the exclusive left turn lane on southbound Route 5 at its intersection with Route 194. In addition, the comments indicated a requirement that the John Fitch Industrial Center provide the construction of a left-turn bypass area for northbound Rye Street at its intersection with Commerce Way with a suggestion that a 22 foot IritCEIVE® MAY 171988 - STATE TRAFFIC COMMISSION traf fic studies t r a f f is engineering t r a f f is planning r Mr. William W. Stoeckert May 9, 1988 Page Two half section be employed. Subsequent to the receipt of that communication, we met with representatives of Culbro Land Resources Inc. and with their consultant, Mr. Benjamin Barkan, and agreed upon a plan for the development of survey data and roadway widening plans which would incorporate the requirements. Surveys necessary for the preparation of those plans are currently in progress . In addition, we understand that your letters of February 4th and February loth in connection with the Culbro Land Resources application indicated a requirement for traffic studies and potential improvements at numerous other locations. Culbro Land Resources is currently re-evaluating its plans and might possible provide information on a project of substantially reduced scope. JFI Associates, Inc. recognizes the need for a coordinated effort with respect to these improvements and appreciates the opportunity to meet with and provide a coordinated effort in two land uses. The difficulty of providing coordination when the other developer has a much greater extensive list of requirements and, therefore, is reviewing his entire development causes concern with respect to the JFI Associates application. The original JFI Industrial Center presently has available for use and occupancy 99, 200 square feet and 199 parking spaces. Agreements have been reached with prospective tenants on four additional lots which would provide an addition of about 55, 000 square feet and about 160 parking spaces. Due to the coordination required with another developer, which may take additional time beyond that required for JFI to respond to traffic conditions resulting solely from its project, formal request is hereby made for a partial opening of JFI Industrial Center to provide for construction of a facility not to exceed 155, 000 square feet of floor area and not to exceed 360 parking spaces . As indicated, this would amount to an addition of about 55, 000 square feet and 160 parking spaces over the Phase I development which is currently in place and occupied and, thus, which has been accounted for in the background traffic in the area. JFI Associates, Inc. have authorized me to indicate that they would certainly accept the condition wherein they would equitably participate in the previously described improvements to the intersection of Rye Street and Sullivan Avenue as well as the provision of two lanes westbound on Sullivan Avenue between Rye Street and Route 5 and the lengthening of the southbound left-turn lane on Route 5 approaching Sullivan Avenue. We also request an extension of 60 days in the requirement outlined in your letter of February 29 to provide detailed data within 120 days which would require a response by August 29, 1988 . JFI Associates, Inc. is continuing to pursue the design requirements to meet the conditions outlined in your letter of February 29 in conjunction with Culbro Land Resources , Inc . and will meet its responsibility in that connection. Mr. William W. Stoeckert May 9, 1988 Page Three It is requested that the Commission make this request under immediate advisement so that the present commitments with respect to the JFI Center can be met. A 22 foot half section is suggested. 3. A 2.50 foot , full width, extension of the exclusive left turn lane on south bound U.S. Route 5 at it 's intersection with Route 194. 4. The deedi rg , to the State, of 15 feet of right-of-way from the final edge of road where the developers property abuts the existing Route 194 right-of-way line. 5. Equitable participation in any future project to widen Route 194 between Rye Street and U.S. Route 5. 6. Equitable participation in any future improvements (signalization) to the Route 194 - Rye Street intersection. The review for a partial opening of 557000 square feet (for a total of 155,000 square feet) would require: 1A. A 100 foot, full width extension of the exclusive left turn lane on south bound U.S. Route 5 at its intersection with Route 194. 2A. The construction of a left turn bypass area, for east bound Route 194 at its intersection. with Rye Street. =A. Items Nc. 2,4,5 and 6 as listed above. As of this date the Division of Traffic Engineering has not received plans for any i mprovements that offset the developments traffic impact. Before the review of the development can continue plans for improvements must be submitted. J F I Associat s, Inc. P.O. Box 1061 South Windsor, CT 06074 E RE C EI VD (203) 289-7662 JUN 198 8988 SO. WINDSOR PLANNING DEPL Y Jul ,• Ms. Marcia Banach Director of Planning Town of South Windsor 1540 Sullivan Avenue South Windsor , CT 06074 RE: John F,,,it"ch Industrial Centre, Phase 2 Sidew' k Dear Marcia: The approval letter for the referenced subdivision, dated October 9 , 1987 , carried as condition number 5 , "Concrete sidewalks, built to Town specifications , shall be installed on one side of the interior street . " The attached map shows the sidewalk location in orange. We believe the requiring of this sidewalk should be reconsidered in its present context and eliminated. At the time of the approval , the inclusion of the sidewalk made sense in the context of an integrated industrial and commercial community, i .e. , pedestrian traffic from the industrial facilities moving back and forth to the commercial/retail services . With this eventuality now eliminated, the 2 ,000 ' long ribbon of concrete serves no purpose but to add 8 ,000 square feet of impervious surface to the road and a snow removal and maintenance liability for the businesses that front on it . We appreciate that the Commission does what it believes is best for the Town and its citizens. In this instance, the sidewalk does nothing for the Town and is a liability to the "business citizens" that it is supposed to serve. REPORT OF FINDINGS JOHN FITCH INDUSTRIAL CENTER ROUTE 194 TOWN OF SOUTH WINDSOR SITE DESCRIPTION: The proposed John Fitch Industrial Center will have a total of 270,000 square feet of gross floor area and 500± parking spaces. Phase I (98,000 square feet and 199 parking spaces) of the development is currently open and operating. The primary land-use for the development is located in the northwest quadrant of the Route 194/Rye Street intersection (see attached location plan). , Access to .the site.wilI be via .a.. newly constructed.. road, which will be called Commerce Way. The development has the Town of South Windsor planning and zoning approval . SITE ENVIRONS: OTHER DEVELOPMENTS: The only other development in this vicinity is the proposed Rye Street Business Park. This proposed development is located directly to the north of the Fitch Industrial Center and will have ,access off of Rye Street. It is anticipated that this development will Contain approximately 600,000 square feet of office space. It will be recommended to the State Traffic Commission that the developers of both projects (Fitch Industrial Center and Rye Street Business Park) equitably participate in improvements at several locations. COMMERCE WAY: The first portion of the roadway, including the Commerce Way - Route 194 intersection was constructed in 1985/86, under a permit review. This first section of roadway extended from Route 194 to a point approximately 1/4 mile north and terminated in a cul-de-sac. The second portion of the road recently constructed, but not opened to traffic, extends from its prior termini to Rye Street. The roadway is a 30± foot wide bidirectional roadway with a posted speed limit of 25 mph, Both termini of Commerce way are stop controlled. RYE STREET: This is a 24± foot wide bidirectional town-owned roadway with a posted speed limit of 35 mph. Rye Street is primarily a collector type roadway. Rye Street begins at its intersection with Route 194 and ends just over the East Windsor Town Line. Rye Street at its intersection with Route 194 is stop controlled. ROUTE 194 (SULLIVAN AVENUE): Route 194 is a 30± foot wide bidirectional roadway with a posted speed limit of 40 mph. Route 194 is a primary col- lector roadway and also serves as a minor arterial connecting U.S. Route 5 with the central area of South Windsor. Route 194 in the area of the development has a 1987 ADT of 15,300. Route 194 begins at its intersection with U.S. Route 5 and terminates with its intersection with Routesi 30,74 and Buckland Road. -2- U.S. ROUTE 5 - ROUTE 194 INTERSECTION: U.S. Route 5 at its intersection with Route 194 has two 12-foot wide thru lanes in each direction and 1-foot _ wide exclusive left-turn lanes. The Route 194 leg of the intersection has two 11-foot wide lanes with one being an exclusive right and the other a thru and left lane. The fourth leg of the intersection is a Town-owned bidirectional roadway with a one lane approach. The intersection is con- trolled by an actuated traffic control signal that currently operates in the U.S. Route 5 computerized signal system. . SITE GENERATED TRAFFIC: It is expected that the development will generate approximately 1,300 vehicle trips per day. 240 vehicles (185 enter, 55 exit) will be in the a.m. peak hour and 349 vehicles (136 enter, 213 exit) in the p.m. peak hour. It is expected that 55% of the site traffic will use Route 194 to access U.S. Route 5 were 31% will travel north and 24% will travel south. Of the remaining traffic, 5% will travel north on Rye Street and 40% will travel east on Route 194 to access Routes 30 and 74. The volumes and directional distributions have been reviewed and approved by the Bureau of Planning. ACCIDENT EXPERIENCE: A review of the latest three-year accident experience for Route 194 in the direct vicinity of the development revealed no accident patterns or trends. However, the intersection of U.S. Route 5 and Route 194 is No. 1118 on the Department's 1984-1986 SLOSSS List. The addition of the development's traffic is not expected to cause further difficulties at this location. The developer is also being required to make improvements to this location (extension of southbound left-turn lane). This improvement is expected to improve traffic operations at the intersection and may reduce the number of accidents. PROPOSED PROJECTS BY THE DEPARTMENT OF TRANSPORTATION: The Department has no projects planned for this area, however, the Bureau of Planning is currently conducting a corridor study of Route 194 and may recommend future improvements. The Bureau of Planning - has been informed of this development, its generated traffic and the recommended improvements. DEVELOPER'S RECOMMENDED IMPROVEMENTS: The developer has recommended improvements for both the total development and a partial opening of the development. The partial opening is for an additional 55,000 sq.ft. and 160 parking spaces, which would being the development to a total of 155,000 sq.ft. and 360 parking s aces. The developer's recommendations for the full development are as follow : 1. To reconstruct the Route 194 (Sullivan Avenue) - Rye treet intersection. 2. To construct Commerce Way and its intersection with Rye Street, as shown on the referenced plans. 3. To install and maintain a "Stop" sign, stop bar and double yellow center line on Commerce Way at its intersection with Rye Street, as shown on the referenced plans. 4. To provide and maintain 400 feet of sight line in each direction from Commerce Way onto Rye Street. 5. To maintain the existing "Stop" sign, stop bar, ouble yellow center line and sight line for the Commerce Way - Route 194 intersection, as shown on the referenced -pl n. The developer's recommended improvements for the partial o ening of the development are as follows: 1. To construct a left-turn bypass area for eastbound Roue 194 at its intersection with Rye Street, as shown on the efer- enced plans. 2. Items No. 2 thru 5, as listed above. However, as-built surveys of the structure constructed on this parcel indicate that the structure is located 2.5 feet closer to .Route 194. than .the original plans called for. Therefore, to maintain a 35-foot setback from the right-of-way, as required by Town of South Windsor Planning and Zoning, the developer is requesting a revision to his Certificate. Apparently the building was placed parall 1 with Commerce Way, assuming Commerce Way and Sullivan Avenue to be perpendicular to each other . As you can see, the angle of th intersection is greater that 90 degrees and 75 .51' west of the intersection Sullivan Avenue changes direction. Further, while the site plan labeled the building 110' deep, the foundation plan called for 110' -4" in depth. Since this was unintentional, can we sell the State a deed for 2.67, and an easement for highway purposes for 7 .33 ' in-lieu of its original requirement? Very truly yours, 7 RaY mo d . Drawer A 24 Wolcott Hill Road Wethersfield, CT 06109 Re: STC 132-8712-01 RECOVED John Fitch Industrial Center South Windsor, CT Our file 8708 NOV 2 1988 Staff Tra c Dear Mr. Stoeckert, Recently the State Traffic Commission issued a certificate to the John Fitch Industrial Center on Sullivan Avenue at Commerce Way in South Windsor. A condition of the approval required the developer to deed a portion of the frontage along Sullivan Avenue to the Connecticut Department of Transportation for highway purposes. At that time, we pointed out that a building was under construction on the lot to the west of Commerce Way and that it was planned to place that building 40 feet from the existing street line. Accordingly, we requested that the dedication include a 5-foot transfer of property and a 5-foot easement for highway purposes so that the proposed building at 40 feet from the existing line would remain behind the town-required setback line of 35 feet. In areas to the east of Commerce Way, where no construction was underway, the developer agreed to the dedication of a 10-foot strip for highway purposes . The building construction has now proceeded to the point where the foundation is completed and as-built surveys have been accomplished. The surveys indicate that the building was constructed with the closest portion of the foundation 37 .67 feet from the existing highway line on Sullivan Avenue. Dedication of a 5-foot strip at this point would place the building almost 2. 5 feet over a 35-foot building line. In order to maintain the relationship between the building line and the building, we request a modification to the conditions of the certificate as depicted in enclosed sheet 2 of 3. The suggested revision would provide for the dedication of a 2.5 foot strip for highway purposes , and the dedication of a 7 .5 foot easement for highway purposes. traffic studies traffic engineering traffic pl nning tt f'•`%' ^,•9.,Ie7 D_i+;, ..'r:di`"L..li 1riran_5:.'•-^.eei tit r,Y s r""'d-`'fi.Ll..t]i:61fri.isr7Y'J3:.rs..r-x •.LL.:'.. _ _ ':..<Z:t:=Y•'•%•y[.4.:.:s>+..(....:.e w...14...:. ...•.. ... 1.n .........a • r Mr. William W. However, as-built surveys of the structure constructed on this parcel indicate that the structure is located 2.5 feet closer to -Route 194 than .the original plans called for. Therefore, to maintain a 35-foot setback from the right-of-way, as required by Town of South Windsor Planning and Zoning, the developer is requesting a revision to his Certificate. The developer now proposes to deed 2.5 feet of right-of-way to the State and provide a 7.5-foot wide easement for highway purposes (as shown on referenced plans). Included within the conditions relating to this certificate were requirements to provide traffic improvements at the intersection of Route 194 and Rye Street, specifically referring to conditions 1, 2 and 9 on the certificate for the entire center, and conditions 1 and 2 as relate to the approval for a partial opening, with a total of 155,000 square feet. The latter condition 2 required that "plans for the reconstruction of the Route 194/Rye Street intersection be submitted to the Division of Traffic Engineering within six months of the issuance of a certificate for a partial opening." As members of the Commission and representatives of the' Division of Traffic Engineering are aware, JFI Associates has been cooperating with Culbro Land Resources in the development of plans for improvements to he intersection. Hallowell: This is a request for an informal meeting with the Commission to discuss possible alternatives to the referenced sidewalks . The approval letter for the Phase II subdivision of the John itch Industrial Centre, dated October 9 , 1987, carries as conditio number 5 , "Concrete sidewalks , built to Town specifications, shall b installed on one side of the interior street . " We believe th requirement for the sidewalk should be reconsidered in its pr sent context and eliminated. At the time of the approval , the inclusion of the sidewalk made sense in the context of an integrated industrial and commercial co unity, i .e. , pedestrian traffic from the industrial facilities movin back and forth to the commercial/retail services . With this event ality now eliminated, the 2,000' long ribbon of concrete serves no urpose but to add 8 ,000 squared feet of impervious surface to the ro d and a snow removal and maintenance liability for the businesses that. front on it . a We appreciate that the Commission does what it believes is be t for the Town and its citizens . In this instance, the sidewalk do s nothing for the Town and is a liability to the "business citi ens" that it is supposed to serve. Thank you for your consideration in this matter. One of the prerequisites for the creation of hiking trails is that access points be acquired. GOALS OF PLAN - to preserve the flood boundary open space along the Scantic River - to encourage towns to require dedication of land within the flood boundary as public open space during the subdivision process If the Commission accepts the dedication of this land in lieu of the sidewalks, the Planning Department recommends this land be donated to the State of Connecticut. The banks are very steep. 2 . The difference in elevation from the base to the rim is 35 to 40 feet. 3 . Water bleeds out in numerous areas along the banks at about 10 feet below the rim. 4 . The area is in it ' s natural state with several eroded gullies, some abandoned vehicles and trash. S . There are numerous dead fall trees. 6. A considerable area at the west end is in the flood plain . I believe that current zoning, wetland and flood plain regulations coupled with the topography will keep this area in it ' s natural state for the foreseeable future without the Town having any ownership responsibilities . Martin Sorokin Sorokin Gross Hyde & Williams, P.C. One Corporate Center Hartford, CT 06103 Re: ---Fitch Industrial Centre, Phase II S Windsor, CT)-- Letter of Credit Extension Dear Attorney Martin: This letter is in response to your correspondence dated February 14, 1994, to Attorney Ralph Alexander, regarding the letter of credit extension for the above-referenced project. Please be advised that the Town of South Windsor does not present letters of credit for payment except under extreme conditions of non-performance. Circumstances under which we might collect on the letter of credit would only include such circumstances as: failure of an applicant to renew a letter of credit (in which case we are obligated to protect our rights by collecting on the letter of credit prior to its expiration, so;that we may complete the project); or failure of an applicant to complete the project within a reasonable time after expiration of the project approval. In this subject case, none of these circumstances apply (pr&lided, of course, that Bank of Bostun Connecticut extends the expiration date of the letter of credit); so I would not expect that the Town of South Windsor.would present the letter of credit for payment during the one-year extension period. I would note that the project expiration date is October 6, 1994. The Town would expect the applicant to make arrangements to complete any outstanding work on public improvements within the industrial:park so that the subdivision improvements may be accepted by the Town within a reasonable time frame. (Town acceptance of the subdivision improvements includes a requirement for a one-year maintenance bond equal to 10% of the original subdivision bond.) If I may be of further assistance, please do not hesitate to contact me. Very truly yours, LC-lit , Marcia A. Banach Director of Planning mb/sf cc: Attorney Ralph Alexander j F I Associat s, Inc.
