M. in the Council Chambers of the South Windsor Town Hall, 1540 Sullivan Avenue, South Windsor, to consider the following: 1. Application of Indian Ridge Condominium, for a zone change from MF-A to Rural Residential (RR) on approximately 6 . 5 acres located on the south side of Ellington Road, opposite Foster Road, and application for a Modification to the Special Exception and Site Plan in accordance with Section 4. 6 . 3 . 2 which was approved on March 8 , 1983, in order to reduce the size of the proposed condominium development. 2. Application of Pleasant Valley Realty, Inc. , for a resubdivison of 39 lots located north of Chapel Road and west of Clark Street, being Section 8 of Pleasant Valley Homes, in an A-20 zone. Copies of these applications and maps more clearly defining the properties are on f ile in the Of f ice of the Town Clerk of the Town of South Windsor. At this hearing, interested persons may appear and be heard and written recommendations will be received. PLANNING & ZONING COMMISSION Marshall Montana, Chairperson Raymond F. Hallowell, Jr. , Secretary Planning & Zoning Commission -2- 6/7/83 2. Application of Pleasant Valley Realty, Inc. , for a resubdivision of 39 lots located north of Chapel Road and west of Clark Street, being Section 8 of Pleasant Valley Homes, in an A-20 zone. Attorney Raymond G. LeFoll of Rocky Hill was present, and stated that this is the last section in this development totalling 193 homes. In this section, 7. 6 acres is for open space. The site is serviced by electric, gas, and sewers. The sanitary sewer runs to Clark Street for approximately 8 lots and the remaining sanitary sewer follows the roadway known as Jacques Lane and Margaret Drive into Pleasant Valley Road. The detention basin is shown as finally approved by the Inland Wetlands Commission. Originally it was planned to locate the proposed recreational area to the north approximately where the detention basin is located, but Inland Wetlands and the Town' s staff felt it was not a proper location for this recreational facility. The detention basin was moved to where it would be acceptable and the active recreational area was removed. Mr. LeFoll said that he is aware of the fact that the regulations require one developed acre of recreational land for every 50 lots, so this subdivision would require 4 acres of active recreational area. This subdivision is about 3 years old, and there are approximately 13 different parcels that have come into it, and it consists -of a total of 130 acres of land. Of that 130 acres, approximately 27 acres are being committed to the Town as open space. Of the 27 acres, 3 acres are for detention areas. Mr. LeFoll said he would request the Commission consider the quantity of open space that is being deeded to the Town and accept that open space as meeting the requirements. Mr. DeMallie reported that the overall design and layout is good and consistent with the concept plans reviewed in 1981-82. He noted that Lots #186 to 189 go to a point and perhaps could be modified. The concept plan and key map should indicate there is an earlier plan. The plans should indicate any buildings to be removed prior to filing. A portion of the open space in this section is in the Flood Plain. Mr. DeMallie said that originally the preliminary plans did show active recreational land, but it was too wet. Section 3. 2a of the subdivision regulations requires 4 acres suitable for public use. Mr. DeMallie noted that this subdivison has much more open space than any other in Town, including open space subdivisions. He said the Commission can accept the 27 acres as fulfilling the requirements of 3. 2a; could take Lot #73 in Section V as well as land west of it and the land in the Northeast Utilities easement in Section VIII; ask the developer to acquire four additional acres adjacent to this subdivision, or four acres elsewhere and improve it; or finally, the Commission could ask the developer to assist in developing a sports field in another area in Town. He said he recommends the Commission consider either the first or last alternative. Mr. DeMallie concluded by stating that he believes the applicant is out of lots, and Mr. LeFoll said that was correct. Planning & Zoning Commission -3- 6/7/83 Town Engineer Page gave the following report: Hyyppa and Associates are to be commended on the engineering they have done on this sub- division. Beginning with Section I and right through this final section they have been extremely cooperative and have done a fine job. Regarding the open space area, when Section VIII was presented the applicant proposed a tremendous environmental change involving cutting down 3 or 4 acres of trees, bringing in 10 to 15, 000 yards of earth, and when Engineering Department saw these plans the applicant was informed they would not be acceptable to the Engineering Department. The plans were changed and this area will be more or less left in its natural state, except for the detention area. A letter was received from the Soil Conservation Service stating that these plans meet their requirements insofar as erosion control, etc. , is concerned. The road to Clark Street is in the vicinity of the so-called "by-pass" road which is in the conceptual stage, but this can be worked out. This developer has been extremely cooperative with the Town, and has done things over and above the call of duty, however, some recent developments give the Engineering Department a little bit of concern. The tnpography, soil conditions and earth removal in Section VIII probably won' t cause any concern to the environment, but it may be desirable for the Commission to take a ride through Section VII and observe the tremendous amount of bulldozing, tree stumping and earth removal that has occurred. In this particular area the effect isn' t too bad, but Mr. Jacques is working with Engineering on developments on other land he owns and he will have to be more careful. There seems to be a tremendous amount of bulldozing and tree cutting going on, and perhaps there is a good reason, but it does cause problems. Also, Engiheeririg is concerned about some of the work in the sewer laterals which seems to be handled by other- than what could be referred to as "professionals" . They can' t find laterals, or run into water problems, and they' re supposed to know what they are doing. These problems have developed in the last few months. However, the area of greatest concern, is that when there are two or three developers bui iding, the Town Engineer' s main -coricern is what is in the best interest of the Town. He must make decisions about where sewers will go, and some of the developers don' t appear too happy about these decisions. The developers in Town should cooperate with each other, as well as the Town. The Commission should be aware of some of these problems. Chairperson Montana said she's sure the developers in Town wouldn' t want the Commission to get involved in the middle of personality conflicts. She told Mr. Page that if there are any problems to let the Commission know and the Commission will sit down with the developers and get their attention. No one in the audience spoke infavor of or in opposition to this application. Planning & Zoning Commission -4- 6/7/83 Commissioner Hallowell said that as a result of his work on the Public Facilities Task Force, he questions the real value of some of the land taken by the Town, in view of .the_ location and the ability of the Recreation Department to develop the land. Mr. Hallowell said he thinks it would be to the advantage of the developers in Town to work with the Town Manager to somehow establish a fund for the development of the Town' s 80 acre parcel, for example. Mr. Hallowell pointed out that if the population of the Town stayed as it is there would be adequate recreational facilities, and the need for more recreation is due to new people coming into Town and the people inthose new developments should support and pay for their recreational facilities, just as the people in the older developments did. Mr. Hallowell said that rather than give up four acres of land, the value of the land could be donated to the Town to be used to develop recreational areas, possibly in this case areas near Pleasant Valley Homes. After discussion with Attorney LeFoll it was determined the four acres may be worth about $20, 000. Mr. LeFoll said he would like approval of this section, but the Commission could reserve the right to discuss this further and work out an arrangement for the recreational land. Mr. Hallowell said he talked to the Town Manager and he didn' t seem to feel there would be any problem with establishing a special account specifically for the purpose of expanding Town recreation, with contributions from the developers in lieu of accepting land. Mr. LeFoll said that speaking on behalf of the developer, they would be willing to make the $20,000 contribution to the Town for the Town' s use as it sees fit for recreational purposes, in order to satisfy the regulation. He said that perhaps in the future, so that developers are treated equally, perhaps the Commission should establish some sort of fee per lot, as it currently does with the drainage assessment fee of $50 per lot. Mr. Hallowell told Mr. LeFoll that the $20, 000 figure mentioned basically breaks down to $100 a lot. He also noted that the Commission is not making any commitments this evening, just suggestions. Chairperson Montana said that she would like more consideration given to leaving trees in front yards in this development. Mr. LeFoll said the developer would try to make an effort to leave as many trees as possible. The Chairperson asked the Town Engineer if he had any suggestions on how to resolve some of the problems that are beginning to occur in this development. Mr. Page said that he doesn' t want to start making the developer do a lot of things that are meaningless, because usually by the time he gets through the subdivision looks pretty good. He noted the erosion problems won' t be that great since the soil in this area is good, but he is concerned about other areas he plans to develop. He noted that he would like to arrange a meeting with Mr. LeFoll to see Planning & Zoning Commission -5- 6/7/83 if they can find some common ground, and then he will put the suggestions in writing to the Commission. Commissioner Evans questioned the comment made about Lot #73 in the previous section, and asked whether it was built upon. Mr. DeMallie reported that it has not been sold. Mr. LeFoll said that if #73 remains intact as shown they will take the land to the rear and made it part of #73. Mr. DeMallie said he is not adverse to this, and Mrs. Evans said that would mean to the land to the rear' is not land- locked. Mrs. Evans noted that back in the 60 ' s the Commission suggested taking money instead of land for open space, and at that time there were no takers. She also noted that this subdivision could not have been developed without the 27 acres being open space, so she felt there should be recreational land ineKcess of what is there now. Mrs. Evans also raised a question regarding the comment made about the by-pass road, and the Planning Director explained the status of the road at the present time, and concluded it should not cause a problem with this development. Commissioner Norman said that he is very familiar with this subdivision and that there isn' t any open space area that could really be considered good recreation areas. Access to the space is also difficult. He said he would like some. consideration given to providing "good" recrea- tional areas for this subdivision. Mr. Norman said that so far it' s been a pleasure to work with Mr. Jacques, and he doesn' t want to get to the point where the Commission is forced to use the bonds it holds. In previous developments of this builder, and in earlier sections of this subdivision, everything was neat and orderly and in walking through Section VII there appeared to be 'a- large amount of earth moving and the site was not as neat as it could have been. Mr.Norman said that perhaps a caution flag should be raised at this point so that the Commission can continue to have a good rapport with the builder and maintain a good relationship. Mr. Norman noted that the applicant and his attorney should also keep in mind that it has been a two-way street regarding cooperation, and this Commission has given quick approvals and has accommodated the builder, as has the Town staff and other agencies. Attorney LeFoll said he realizes that and is grateful. He said perhaps it' s because they are building 50 houses at one time that Section VII appears to be a little raggy. He said Mr. Jacques is responsible for over 400 new families in South Windsor inthe past 8 years and is very proud of the Town and lives in it. Commissioner Gilligan asked if Mr. Jacques would be willing to develop four acres of the proposed park at Nevers Road, and Mr. LeFoll said they would prefer that a figure be established and the developer would provide work or materials up to that amount. - c D TOwn 011 s 1540 SULLIVAN AVENUE . Now that it appears tha spring has arrived and the completion of your subdivision will be within months, t is appropriate that a number of items bel, attended to this spring season before it becomes too wet, dry, hot, late or something. I have mentioned most of these items to ou earlier, but, a tentative list includes, but not limited to the f of lowing: 1. The iron pins and merestones should be set not only around the lots where the new homeowner are living, but also, the merestones around the open space areas. Co idering that this is the planting and fencing season in a new area for each owner, it would be especially important to establish their bounds now. 2. With the number o new families with children within the construction area, your dust control does not exist and keeping the street open, for through • traffic seems dif icult. It is especially important that yogi keep the dust down as a s ety factor for all of us. 3. Section 2.2-B of a Subdivision Regulations Planting ir' ents--There shall be a min' of two trees of 2-1/2" minimum. diameter infront of all houses. Any tree planted by the developer shall be of nursery stock, planted in a workmanlike er. 4. The detention bas and the waste pile behind Lots 160, 161,, 162 and 163 should be taken care of 5. -The manufacturing of the stock pile south of Margaret Drive, ' behind Lots 177, 178, 179 and 180, indicates little planning and a waste pile that would have to be moved in th same manner as the one from Chapel Hill Condominiums to Clark Street, jus to obtain a Certificate of Occupancy for one of those lots. 6. The loaming and s of all the disturbed areas as indicated on Sheet 7 of 11 of your Sec 'on 8 drawings shall be done now. There appears to be about 25 acres exposed d you are certainly not in compliance with your own drawings. A Pleasant Valley Hones April 10, 1984 Page 2. 7. The final gradin around the lived in houses now is especially important. You should also a care in the grading around Lots 173 and 174 to avoid any standing wat It would appear that al of these items are self-explanatory, but if you wish to discuss than, I can be ontacted at 644-2511, extension 244.
