Sisisky Site Plan - Chapel Road Dear Tom: In reviewing the above matter with Peter DeMallie and with Bo Davies, it is apparent that the approved site plan, approved in June of 1976, is still valid. The provision in the statutes which requires the notice of an expiration date and that requires that the work on a site plan be completed within five (5) years of approval refers to site plans approved in 1984 or thereafter. Since the site plan was approved in June of 1976, it is my opinion that it is a valid site plan and that the buildings remaining to be built can be built under said plan. It is my further understanding that the Inlands/Wetlands Agency approved the subject development on May 10, 1976 •the things that had to be done to comply with the wishes of the Inlands/Wetlands Agency under the permit which was issued have been done. Bo Davies has indicated to me that all required work was completed, and in that case, I see no reason for further approval from the Inlands/Wetlands Agency of the original site plan. Therefore, I see no reason why building permits cannot be issued for the remaining buildings to be built under the original site plan. Of course, any modifications to the site plan would require re- approval. If you have any question on this, please do not hesitate to contact me. Thank you. Very tru'1y_aJ-o ' Richard M. Although the two buildings are wider than proposed, the total impact is about the same. There are no wetlands on the site , as indicated. The area where the buildings are going is the typical sand for Chapel Road and perhaps building on it will stabilize it some. Their proposal is not dif- ficult, but it should include some time frame. If the commission is of a mind to approve the above application, conditions could include: 1 . A bond of $2 , 500 to assure compliance with this and previous approvals . 2 . A realistic time frame - i .e. 3 months - 6 months - 4 years - etc. 3 . A copy of the detention pond As Built Plan should be included. Staff has no further input into this proposal . Windsor, CT Dear Mr. Rasmus: The Town of South Windsor is concerned about the stormwater management for your A Space Station facility on Chapel Road, South Windsor, Connecticut. It has been brought to our attention that JMJ Construction Company intends to fill in the stormwater retention pond currently being utilized by your facility. At the time Chapel Road was being reconstructed, the Town was in contact with you regarding the possible connection of your facility into the proposed stormsewer in the road. At that time, it was indicated that JMJ Construction Company had plans to utilize the space occupied by the retention pond for expansion of their facility. After your evaluation of the costs associated with connection to the proposed system, you notified the Town in December 1989 that you did not want to connect to our system. With JMJ's filling of the retention pond, your A Space Station facility has no outlet for their stormwater. At the present time, we are not aware of any firm schedule for this work. However, the Town of South Windsor will require that a plan for the management of stormwater at your facility be submitted to this office by May 1, 1991 for review and approval. Rittenband 1750 Ellington Road South Windsor, Ct 06074 Dear Dick: Re: 282 Chapel Road (A Space Station) , Drainage Easement The above-referenced propert which is fully developed with self-storage warehouses, has be using a re ention basin located on adjacent property, owned y- JMJ Cons uction Company, for their stormwater drainage. The pr rty owne of A Space Station had an easement to construct and use he on facility. According to the easement, the right to drai expired one year after a new drainage system was completed in Chapel Road. That new drainage system was completed in October 1990 . JMJ Construction Company would like to use the remainder of their property for their own business uses, which would include filling in the retention pond and constructing a much smaller one for their own use. The drainage pipe from A Space Station would be plugged by this action, and their drainage would spill over on the surface of the ground with no place else to go. Both the Town and JMJ have been attempting for over two years to resolve the situation with A Space Station (correspondence enclosed) . To date the efforts have been unsuccessful . JMJ Construction has decided to proceed with the necessary steps to reclaim use of their property and begin the filling operation. Town staff have indicated to JMJ that a staff change order would be required under normal circumstances. However, given the high potential for litigation in this issue, either from A Space Station if we approve the change order, or from JMJ if we don't, I am requesting your guidance. Subsequent to learning all of the above, I checked back to 1986, when PZC approved the last two buildings on the site, to see how the drainage had been represented. The site plan which was submitted with the application did not indicate anywhere on it that the mini-warehouse property had just a drainage easement over the retention basin; rather the plan as submitted led me to the conclusion that the mini-warehouse owner owned the retention basin! Attorney Richard M. Rittenband Page Two May 15, 1992 (In fact, the site exceeds PZC's impervious coverage requirement without ownership of the retention basin; had we been aware that the property owner did not own the retention basin, PZC approval would not have been granted without a ZBA variance to the impervious coverage requirement. ) Can we approve the change order which allows JMJ to plug A Space Station's drainage into JMJ's retention basin? The Planning & Zoning Commission will then review your request, prepare an evaluation and make their recommendation. In addition to the normal engineering concerns, your proposal should include the following: 1 . Any detrimental downstream effect of an unrestricted or limited runoff from your site. 2 . The proof that the capacity of the proposed 24" stormpipe to handle the watershed wouldn't be diminished with the additional runoff from your site. 3 . At present, the 24" pipe doesn't exist. It would be deep enough to service your site, but is proposed to be on the opposite side of the road without a connection to your property. Your proposal should show the appropriate structure location of this crossover which is to be included in the Chapel Road reconstruction. This structure shall be installed by others , at no cost to the Town or the State. 4 . Since funding of the road reconstruction is not entirely the Town of South Windsor your proposal would also need approval of the appropriate agencies responsible for the funding. We cannot consider your proposal until a submission is made. Re: A Space Station 282 ChcYe1 Road Dear Mr. Iazzetta: I received your letter addressed to Mark Rasmus on the above referenced property. I am quite familiar with this situation on the storm drainage and I am responding as your contact instead of Mr. Rasmus. When we started to analyze the connection of our storm drainage to the town's storm sewer system there were problems that we came across and decided to stop. First the grade was not. proper for our flow and went against proper engineering norms. Second the costs involved were prohibitively expensive. We certainly sympathize with Mr. Jacques inability to develop his land however, we have a valid easement which makes it illegal for him to build on that portion of his property. We have recently been provided with copies of correspondence by and between your Company and the Town of South Windsor with respect to your intentions relating to the storm drainage issue affecting your Company' s property at this address which, as you know, abuts property owned by our client. As I am sure you are aware , the deed by which your Company acquired title to these premises provided for a temporary drainage easement allowing for storm drainage from your parcel to a retention basin located on the premises of my client. As noted above , however , this easement was tem orary in nature and the aforementioned deed specifically provided as follows : "The Grantees herein, for themselves , their heirs and assigns, agree to release any right , title and interest in said temporary drainage easment within one year from the availability of a storm water drainage system installed in Chapel Road. " We have been advised that a storm water drainage system was installed in Chapel Road during the late Summer/early Fall of 1990 . As indicated by the enclosed copy of a letter I requested from the South Windsor Town Engineer , that system was completed on October 3 , 1990 . Consequently, on October 3 , 1991 , the temporary easement for the benefit of your premises will expire and under the terms thereof, you will be required to release any right , title and interest in said temporary drainage easement . Consequently, I would suggest that immediate arrangements be made by your Company to connect to the storm water drainage system available in Chapel Road so as to avoid any future problems in this regard . Please be advised that your interference with our client ' s termination of these drainage rights and/or failure to make alternative arrangements satisfactory to the Town of South Windsor for the storm drainage from your premises will result in the immediate initiation of legal action on behalf of our client. Facility on Chapel Road, South Windsor Dear Mr. Lally: We have reviewed your proposed drainage system for the "A Space Station" facility on Chapel Road owned by International Management Services and find that it is unacceptable . Your design does not evaluate the downstream effects upon the existing storm drainage system in Chapel Road, i .e. the capacity of the existing system, etc . When Chapel Road was being reconstructed in 1989 , International Management requested permission to connect to the then proposed storm water drainage system in the road. At that time we indicated that their engineer needed to show that the system designed could carry the added storm water from their site and would need to determine what the downstream effects would be . It was determined that if this facility were to connect to the storm system, the system from that point downstream to the proposed 54" pipe under Route 5 would need to be upgraded. International was notified that if they wished to connect, they would be required to pay the additional costs for the upgrade. On December 14 , 1989 , they declined, indicating that they had no interest in proceeding any further. I hope this little bit of background information will help you to understand the rejection of your proposed system. If you have any questions please feel free to call me at 644-2511, Ext. 245 . In your letter to me dated March 18, 1992 , it was indicated . that your client was proceeding to negotiate with the Town for connection of your client' s drainage to the municipal sanitary system in Chapel Road. I have recently had occasion to speak with the Town Engineer who has indicated that he has had no such conversation with your client or your client' s engineers regarding this issue and, in fact, believes that such a connection to the municipal system would not be allowable. In any event, my client' s patience is at an end and it intends to proceed with the relocation of its existing drainage area so that it can proceed with its planned site expansion. Accordingly, this letter will serve as notice to you and your client that I have advised my client to proceed with its plans which will require the termination of your client' s current , drainage onto my client' s property. Please be advised that my client will assume no responsibility for any damage, claims, penalties or losses of any nature arising out of the stormwater run-off from your client's property onto any other property or into Chapel Road. Kindl : Pursuant to our discussion, Mr. Jacques and I met with Ms. Marcia Banach, Mr. Jerry lazzetta and Mr. John McCahill of the Town of South Windsor to discuss the filling of the existing detention basin at the rear of the subject project. Following is my understanding of what was determined at this meeting: Normally, a modification of this nature to an approved site plan can be handled by the Staff as a Change Order. This also includes the extension of Garage "A" by 20' . However, because of the problem with the abutting land owner and the potential for South Windsor to be drawn into a lawsuit should they approve the filling ( ie. , condone the plugging of the pipe which could result in stormwater runoff onto or flooding abutting properties) , Ms. Banach felt that she should consult with the Town Attorney and Chairwoman of the Planning and Zoning Commission before approv- ing the Change Order. We also briefly discussed modifying the layout of Garage "A" and the Staff feels that this would be more than a "minor" change and would have to go back to the Commission for approval . Based upon the above, I would suggest that we prepare a "Change Order" and submit it to the Town so that we can keep this project on course. Michele R. Lipe Assistant Planner A WINDSOR PLANNING DEPT. Town of South Windsor 1540 Sullivan Avenue South Windsor, CT 06074 Re: 282 Chapel Road, South Windsor, Connecticut Dear Michele: This confirms our telephone conversation of today, Tuesday, August 30, 1994, concerning the above-referenced property. The zoning office file indicates that the initial site plan to permit the construction of the storage facility at the above- referenced property was approved in June of 1976 . The initial site plan provided approximately 94 percent imperious surface area. In June of 1976 , the zoning regulations of the Town of South Windsor did not provide a maximum imperious surface area provision. Subsequent to June of 1976 , the zoning regulations were amended on two separate occasions to address imperious surface area. The first created a 75 percent maximum imperious surface area provision. The second modification reduced the maximum imperious surface area requirement from 75 percent to 65 percent . Therefore, because the facility was approved in 1976 and constructed prior to the promulgation of a maximum imperious surface area zoning regulation, the existing 94 percent coverage is a valid pre-existing nonconformity.
