Box 559 435 Buckland Road South Windsor, Ct. 016074 Dear Wayne: Re: Westgate Associates Development - Sand Hill Road In 1973 the Zoning Board of Appeals granted a variance to Lewis J. Dube for property at the Southeast corner of Sullivan Avenue and Sand Hill Road. As per the attached minutes, a condition of approval was that the owner enter into a bindingiagreement with the Town requiring future sewer hook- up, when and if sewers become available. The variance permittled the construction of one (1) 5,000 sq. ft. building on the site to be served by an on-site septic system, rather than served by sewers, as required in the RO zone. Westgate Associates has submitted a copy of an agreement to my office. Insofar as this agreement is subject to your approval and not under my jurisdiction, I am hereby forwarding same to you. Please apprise me oflfurther developments in this matter. Sincerely, Peter R. I have informed Richard Eriksson, member of the Zoning Board of Appeals, and Harold Cummings, attorney for the applicant, of my opinion on the foregoing. I would anticipate a bond being posted in an amount satisfactory to the Town Engineer to ensure the hookup to the sewer line if it is ever installed in Sullivan Avenue and the depositing with my office for the Town of an easement for the sewer hookups. When the bond of at least $1,500 per building and the easement agreement have been furnished to my office, I will notify you that they have met the conditions for the issuance of a building permit. Naturally, all of this is conditioned upon the Zoning Board of Appeals actually granting them the variancesthey request at the Board's meeting on February 5, 1981. It is my understanding that Mr. Kelly plans to ask for three variances, one being to replace the 1973 approval which you forwarded to me. The bond in these matters can take the form of assurity bond, cash, or eal property bond, 7 Very 3Attor urs, Waynher Gerlt Town bes 6
