3. IF THERE IS NOT NOW, SHOULD THERE BE A MECHINISM FOR APPROVAL OF NON
CONFORMANT USE?
4. SHOULD THERE BE A LIST OF CONDITIONS TO PROTECT THE TOWN FROM LIABILITY IF A
NON CONFORMING USE IS ALLOWED?
TO MY KNOWLEDGE THERE HAS NOT BEEN A PROBLEM WITH THE CURRENT OWNER.

Hi Mel,
I got a call from a contractor(and then the homeowner)about a driveway at 63 Colony Road they want to
repave. The driveway is 37 feet wide at the street gutter which exceeds our maximum width of 22 feet
and we have no permits for it.The driveway has obviously been there for some time. It appears threre
was originally a 1 car wide driveway that someone added 2-1/2 more car widths at the street only. The
homeowner claims it has been there since before he purchased the house 20 years ago. I am trying to
verivy this with our old aerial photos but it is not easy.
If you are familiar with this driveway do you have any idea how long it has been there in its current
configuration?
Have there been any problems, issues, complaints with this driveway?
If it has been there for 20 years and there have not been any issues I think we can let him repave it in its
present configuration.
