We dispatched two maintainers to the area and patched the hole with cold patch class 5 bituminous concrete yesterday February 9th. We used one third of a ton at a cost of $18.73 for material. Two maintainer 2 worked for one hour at a cost of$40.92. The truck rate for one hour is $13.50. The total cost for the Town to respond to this re-occurring problem is $73.15. Both maintainers reported that this settlement is getting larger in size. I will take pictures of the area and give them to you. I decided to look at the area this morning at 9:00am to see how the patch was holding up. The patch was doing fine but the area settled some more and needed more attention. I dispatched Don G. and Rob Hunt to the area and had them fill it and with cold patch again. The labor cost for Rob and Don to respond was $21.96 for V2 hour of work. The truck rate for V2 hour was $6.75. They used about a wheel barrel of cold patch. I called Tracy Lapiene and told him that we had to respond to this area yesterday and today. I also stated that we would probably get called in over the long weekend for this problem. Cold patch does not adhere to the road surface very good. The rain is not helping the situation. I told Tracy that the contractor responsible is working up the street. Maybe we can get him to fix it. Let me know if you want us to fix it. I will need to call a dig ticket in and it will take a couple of days to clear. The total cost for the last 2 days is $101.86. We have now responded to this area 4 times this winter. The.trench has settled, the pavement has broken-up and a large pothole has developed in the east bound lane of the road at the east end of this excavation. In accordance with'the Town of South Windsor Code of Ordinances, Section 86-31 through 86=48, and the Street Excavation Permit Manual, you are responsible for the maintenance and repair of this pavement patch. We tried to contact you starting on January 7, 2005-to-tell--you of this problem and-notify you that you are responsible for maintenance and repair of this patch. On January 11, 2005 the Engineering Secretary spoke to you about this patch failure and told you that you are responsible for the maintenance and repair of this patch. We have received several additional complaints about the failure of this patch and the pothole since then and have tried to contact you each time. However, you have not answered the phone or responded to our messages and it does not appear that you have been maintaining this patch. The Town Public Works crews have responded to complaints about this patch and filled the pothole 4 times to date, on 1/7/05, 1/18/05, 2/9/05 and 2/10/05 (see attached memos). The Town keeps track of our costs and will be charging you for the time, equipment and materials needed to maintain this patch to prevent accidents and property damage. This patch will continue to require maintenance until the failed area is cut out, excavated, refilled, recompacted and repaved with bituminous concrete hot mix. This is your responsibility as well as the ongoing maintenance of the patch. In addition to charging you for the Town's expenses to maintain this patch, failure to respond to our calls and letters about this patch needing maintenance may result in suspension of any further permits from the Town to your firm. Please contact the Engineering Department at the above number, ext 244 to let us know your plans to maintain this patch for the rest of the winter and when you will make permanent repairs. Page 1 From: Melvin Stead To: Bernard Drabek; Jeff Doolittle Date: 1/7/05 10:25AM - Subject: Sewer settlement Pleasnat valley Rd. There is a settlement over the sewer line in the vicinity of the Barrington Estates pump station. The settlement is East of the pump station near a manhole within the patch made for the sewer extension to serve the new development on the north side of Pleasant Valley Rd. I am having it patched with cold patch today because of its location in the middle of the east bound lane and because it is Friday andwe do not want to be called in over the weekend to repair. Please put the contractor on notice of this problem and that we will expect any further maintenance done here to be done by the contractor.Thanks. The slip reported that the hole was located between Clark St. and the Manchester Town Line. I inspected the area and found no problems in that specific area. I did however find a settlement by a sanitary manhole located just east of Pleasant Valley Condos that was approximately 7 inches deep). I dispatched truck 41 to the area and requested that they fill and inspect the hole. The area of the hole had been saw cut and some construction work had taken place this fall. Most likely from the houses that are being built just east of the pump station. I called the person who left the voice mail and spoke with him about the location that he hit the hole. He stated that he hit the hole on Monday and that the location was somewhere between St Francis church and Clark Street. I told him that if he felt there was something wrong with his vehicle he should get it inspected and file a claim with the Town Clerks office. I told him I would write a report stating the facts. I believe this is the same location that you informed the engineering Department that there was settling going on and that the contractor should be put on notice about two weeks ago. I can recall getting e-mail on it. Dan Jacobsen called the office and said that he just spoke with the contractor and the contractor is now aware of the problem. Bruce Lundie called the garage r and stated that he hit the settlement this morning. Bruce said the settlement is from the construction for the development east of Pleasant Valley Condos. He said the contractor replaced the manhole covers between the pump station and where the new construction is going on. The gentleman's name that may be filing a claim with the Town of South Windsor is Pat McAffrey. His home phone is 644-1960 and his work number is 646-4260. I told Mr.McAffrey to call me if his vehicle does indeed have problems as a result of this settlement. Dan Jacobsen inspected the manhole and thought that it was the result of poor compaction and back filling.
