WHEREAS, George W. Jahrstorfer of South Windsor, Connecticut desires to
connect his premises at 285 Oak Street to the sanitary sewer system of the
Town of South Windsor, and
WHEREAS, because said George W. Jahrstorfer has erected a sun deck over
the septic tank of his individual sanitary sewage disposal system, and
WHEREAS, crushing and backfilling or removal of said septic tank would
impose an undue .hardship on said George W. Jahrstorfer in that this operation
would require all handwork due to said sundeck, and
WHEREAS, allowing said septic tank to remain is not in accordance with
commonly accepted practices and may in the future result in a cave-in with
resulting damage to the premises;
NOW THEREFORE, in consideration of the Town of South Windsor permitting
said George W. Jahrstorfer to connect to the sanitary sewer and leave said
septic tank intact, the said George W. Jahrstorfer, for himself, his heirs,
executors and-assigns hereby agrees to hold the Town of South Windsor harmless
from any and all claims for damages of any nature whatsoever resulting from or
attributable to the septic tank above mentioned.
