Because she cannot transcribe accurately if we 13 are both talking at the same time , it ' s important that 14 we be elaborately polite to one another and we not 15 speak at the same time . If do you answer my question , I will 25 take it as a statement by you that you have heard my r t 5 1 question , that you have understood my question , and 2 that you are giving me your best answer . 3 Does that seem fair to you? 4 A . That ' s fair . 5 Q . If during the course of this deposition you 6 wish to take a break, if you wish to get up and 7 stretch , or get a drink of water or perhaps use the 8 restroom just say that . And we can suspend for a 9 moment to accommodate you . You are not trapped in this 10 room. 11 A . That ' s fine . 12 Q . Mr. Galligan , how old are you? 13 A. Forty six . 14 Q . Would you tell me your educational 15 background? 16 A . Masters Degree Business Administration. 17 Q . From where? 18 A. Iona College , New Rochelle . 19 Q . Would 'you spell it . W a ® 20 A . I-O-N-A College . o 21 Q . When was that? 0 0 W 22 A . Oh, would have been January of 179 . 23 Q . What is your present employment sir? 24 A. Town Manager . Town of South Windsor. 25 Q . Have you ever had any similar positions in S 6 1 other towns? 2 A . Yes . 3 Q . Would you tell me about that? 4 A. Well go in reverse maybe from when I got 5 here? 6 Q . Sure . 7 A. Village of Mamaroneck, New York. Town of 8 North Branford . 9 Q . You better spell Mamaroneck for her . 10 A. M-A-M-A-R-O-N-E-C-K. Before that was Town o 11 North Branford , Connecticut . And before that was the 12 City of Newburgh , New York . N-E-W-B-U-R-G-H . 13 Q . And, were you town manager in each of those 14 towns? 15 A. Yes . 16 Q . Could you tell me when you first became town 17 manager? Was it in Newburgh was your first job? 18 A. Yes . 19 Q . What year was that? 0 W ® 20 A. Oh I was appointed , I think it was December g 21 of 183 . LL ZO O CO 22 Q . Would it be fair for me to say that you have 23 been the manager of some town between 1983 and the 24 present day? 25 A . From 183 to present day? 1 7 1 Q . Yes . 2 A. Yes sir . 3 Q . Is the answer yes? 4 A . Yes . 5 Q . When did you first become town manager in 6 South Windsor? 7 A. January of 196 . 8 Q . In your capacity as town manager in South 9 Windsor, do you supervise the executive departments in 10 the town? 11 A. Yes . 12 Q . Is one of the executive departments you 13 supervise the police department? 14 A. Yes . 15 Q . Could you tell me in a sort of summary 16 fashion , what you perceive your job is with respect to 17 the police department? A W 18 A. Basically the police as with other 19 departments they manage their own departments . They d Z W ® 20 the running of the day-to-day operations . I kind of 0 21 have a more global picture when it comes to finances , 0 22 budgets , things where we have more capital expenditure , 23 expenditure nature . Making sure they are following 24 those types of procedures . 25 Q . In your supervisory capacity as to the South c i 8 1 Windsor Police Department , is a part of your duties to 2 resolve complaints about the performance of police 3 officers? 4 MR . ARCIERO : Object to the term supervisor 5 but you can answer . 6 A. Oh , if the complaint comes to my office , the 7 complaint about the police department, I would then 8 call the Chief and initiate and take a look at it . If 9 it ' s a complaint on an officer, didn ' t come through my 10 department or didn ' t come through me , that would go 11 through the police department and they have their own 12 internal investigation on complaints of officers . 13 Q . So , would it be fair for me to say that if a 14 complaint about a South Windsor police officer came to 15 your attention , it is part of your responsibility to 16 investigate that complaint? Is that a fair statement? 17 MR. ARCIERO : Objection to the form. 18 A. Well I would say that I would initiate g 19 through the Chief an investigation . I would ask the Z W a ® 20 Chief to come in , I got this complaint on this LL 21 particular officer , you need to look at it and you nee 0 22 to get back to me as I will have to get back to the 23 individual who made the complaint . 24 Q . Has it ever come to your attention other than 25 in a context of Mrs . Hutensky' s case , that there has t s 9 1 been a complaint about the performance of a police 2 officer named Daniel Martin? 3 A. No . 4 Q . Is Mrs . Hutensky ' s complaint about Daniel 5 Martin ' s performance the first time you became aware 6 that there was a complaint against Daniel Martin? 7 A. That was my first time of Daniel Martin . 8 Q . How did you first hear that Mrs . Hutensky was 9 not satisfied with the performance of Sergeant Martin? 10 A. She came to my office . 11 Q . When was that sir? 12 A. Let me think. Probably would have been back, 13 I know it was during the summer. Could have been like 14 May or June of-- we are already here maybe 197 . May o 15 June of 197 . I keep an appointment book on-- I could 16 send that onto you . I keep all my appointments . I 17 keep them for the years . a 18 Q . If I suggest to you the date of June 10 , 19 1997-- W a ® 20 A. That could be . cc 21 Q . -- does that sound like it might be 0 CO CO 22 appropriate? 3 23 A . That might be appropriate , yes . 24 MR. ARCIERO : Did you say June loth? 25 MR. CIAMPA: I did . 10 1 MR. ARCIERO : Schedule A references June 2 12th as the date . Make sure there ' s not another 3 day we are using . 4 MR. CIAMPA: Counsel is correct . 5 Q . Do you know whether the meeting that you 6 referenced in your office happened on June loth or on 7 June 12 , 1997? 8 A. It could be one of those dates . I know it 9 was beginning of summer . 10 Q . Would it be fair to say perhaps the second it week of June in 1997? 12 A. That would be fair . 13 Q . There was a meeting in your office about Mrs . 14 Hutensky' s situation? 15 A. Yes . 16 Q . How did it come to be that there was such a 17 meeting? A A g 18 A. There was a person by the name of Jacqueline 19 Smith who is the Democratic Chairman of the Democratic Z W ® 20 party in Town . She had called me and said would I have g 21 some time to meet with constituents or friend, I forget 0 Er 22 how she put it , that has a particular problem and would 23 like me to come along and dicuss it'. I said fine . And 24 my secretary set the appointment . 25 Q . What was your understanding at the time or of 11 1 the purpose of this meeting? 2 A . I didn ' t know until we got there . Mrs . Smith 3 told me that there was a complaint from an individual 4 on one of our departments and that she would like to 5 discuss it in my office . 6 Q . Had you known Mrs . Hutensky previously? 7 A. No . 8 Q . Had you ever heard of Mrs . Hutensky? 9 A. Nope . 10 Q . Did you know anything about Mrs . Hutensky' s 11 reputation in South Windsor? 12 A. No . 13 Q . Did there come a time when you met Mrs . 14 Hutensky in your office? 15 A. Yes . 16 Q . Have we agreed that it might be the 10th or 17 the 12th of June 1997 ; am I right? a w 18 A. Correct . < 19 Q . Who was present? Z W a ® 20 A . Jacqueline Smith who was the person who made cr 21 the appointment . Myself and Mrs . Hutensky . 0 W 22 Q . Would you tell me what happened? 23 A. I think Jacqueline Smith introduced us . Told 24 me that Mrs . Hutensky had a concern about an incident 25 that happened to her house and how the police 12 1 department conducted an investigation . And at that 2 point I shook Mrs . Hutensky ' s hand and we sat down in k7ti O 3 table like this and I said boom , fill me in and tell m 4 what ' s going on and which she we must have been there 5 forty five minutes , an hour maybe , talking . She told 6 me about the incident of her house and the Detective 7 Martin was the detective and how she felt that he 8 didn' t do enough to investigate . And also some 9 statements that he might have made . We also talked 10 about the fact that , I asked her well I will take a 11 look into it and get the chief and I ' ll find out what 12 was going on , and she asked me not to do anything 13 because she was going to be moving and she was afraid 14 of reprisal or whatever . And after she moved then 15 maybe she would give me another call and we would 16 discuss it at that point . 17 Q . When you say "she" , did you mean-- a m 18 A. Meaning Mrs . Hutensky . 19 Q . During that conversation in your office, did Z W ® 20 Mrs . Smith tell you anything about some communications cc 21 by members of a town council with the Chief of Police LL z 2 W 22 concerning Mrs . Hutensky ' s problem? 23 A. No . I don' t remember that . 24 MR . ARCIERO : Just for a moment when you say 25 town council are you referring to-- 13 1 MR. CIAMPA : C-I-L. 2 MR. ARCIERO : C-I-L. Thank you . 3 Q . I may have asked you this same question 4 again . But by town council I mean the legislative body 5 C-I-L? 6 A . No . She has not mentioned that . 7 Q . So , at the conclusion of this meeting which I 8 understand you told me lasted about three quarters of 9 an hour , did you make any agreements or promises to 10 Mrs . Hutensky? 11 A. No . I basically left it in her court because 12 she was moving , as I said, and she was concerned that 13 there would be reprisals even though I assured her 14 there wouldn't be . I was willing to take a look at 15 this . And she had said no she would, really would wait 16 until she had moved out of town or she had her house u 17 for sale or something . A a 18 Q . So Mr . Galligan , Mrs . Hutensky according to 19 your testimony went through all the trouble of Z W ® 20 arranging the meeting in your office to ask you not to 0 21 do anything . Is that your testimony? 2 W 22 MR. ARCIERO : Objection to form . 23 A. Basically I sat and listened to a person that 24 had a complaint and I didn ' t want-- I knew she was in 25 an upset state because the more we talked about it , the 14 1 more upset she came to be about it . And she basically 2 said you know I don ' t want any reprisals but I will-- 3 at one point I do want to look into this . I do want t 4 get to the bottom of it . And I said fine , you are 5 going to let me know when you feel comfortable in doing 6 that . 7 Q . Did there ever come a time when Mrs . Hutensk 8 told you she wished you would investigate her 9 complaint? 10 A. Wished to investigate . No , I think it was 11 kind of left very open . 12 Q . Let me ask you the question again . Did they 13 ever come a time when Mrs . Hutensky contacted you and 14 said now sir it ' s time for you , Mr . Galligan, to 15 investigate my complaint? 16 A. No . The only call I had gotten was that she 17 was going to sue the town I believe , I forget when that a 18 phone call was , was a couple of months later, and that 19 she apologized for that . I said there ' s nothing to Z W ® 20 apologize and she said I just feel that I have to do 21 what I feel is right . And I said I understand . And I LL O 22 think it was about a five minute maybe conversation . 23 And that was a couple of months after this , I couldn't 24 tell , after this meeting , I couldn ' t tell you exactly 25 when the date was . But I did get a phone call from 15 1 her . 2 Q . As a result of your meeting with Mrs . 3 Hutensky and Mrs . Smith in June of 1997 , did you make 4 any inquiries of the police department with respect to 5 Mrs . Hutensky' s situation? 6 A. Yes , I did . 7 Q . And, when did you make those inquiries? 8 A. I made it with the police chief . Might have 9 been maybe a week after I met with Mrs . Hutensky . 10 Q . Would it be fair to say these inquires you 11 made of the Chief of Police were in the middle of June 12 1997? 13 A . Yes , that would be fair . 14 Q . Did you make these inquiries in person? 15 A. I asked him to come to my office to discuss 16 this particular issue . 17 Q . Chief of police is named Tyler, T-Y-L-E-R? P O 18 A. That is correct . g 19 Q . So is it the same case then you telephoned Z W a ® 20 Chief Tyler? 0 21 A. That is correct . 0 W 22 Q . And is it the case that you explained to 23 Chief Tyler that you had received the complaint by Mrs . 24 Hutensky? 25 A. I said there was an issue with Mrs . i 16 1 Hutensky . I had a discussion with this individual who 2 had some issues with the police department . She-- I 3 believe I also mentioned about her concerns , but I said 4 I would like to know exactly what ' s going on - here . 5 Q . And during that conversation with the Chief 6 Tyler, then is it true that you invited Chief Tyler to 7 your office to discuss this question? 8 A . Yes , we did . 9 Q . Did Chief Tyler come to your office? 10 A . Yes he did . 11 Q . How long afterward was that? 12 A. Well it was an an appointment that was set . 13 Could have been a week after maybe I talked to him. I 14 know there was some problems with vacations and people 15 already had some time off so . 16 Q . Would it be fair to say your conversation 17 with Chief Tyler in your office face-to-face occurred 18 in the third week of June 1997? 19 A. I would say the end of June , yeah . Z W a ® 20 Q . How long did you and Chief Tyler speak? a 21 A. Basically probably about a half hour . I 0 W 22 started a conversation and I had this Mrs . Hutensky 23 came in with Jacqueline Smith , and what is the what the 24 issue here . I said she is concerned about reprisals 25 which I am sure you know we wouldn ' t do that in this 17 1 environment of public , you know, being in the public 2 here he assured me that would never happen in South 3 Windsor. I said well I would like to know a little bit 4 about what was going on and whether this Detective 5 Martin did his job , and in which he then explained to 6 me exactly what the case was about and what they did 7 and that he felt they investigated everything very 8 thoroughly to the best , I guess , of their ability. 9 Q . Now I am a little confused . We are talking 10 now, are we not , about the conversation that occurred 11 in your office in the third week in June 1997 . Am I 12 right so far? 13 A. Yes . 14 Q . And the people present were both you and 15 Chief Tyler ; is that correct? 16 A. That ' s correct . 17 Q . Was there anyone else present during that a ` 18 conversation? 19 A . No . Z W ® 20 Q . So in this conversation I think you just told 21 me you related to Chief Tyler that you had received a LL W 22 complaint? 23 A. Un hun . 24 Q . From Mrs . Hutensky ; is that correct? 25 MR. ARCIERO : Objection to the form . 18 1 A . She never asked me specifically to 2 investigate . But I just felt it was bothering me as a 3 town manager . That kind of-- it was too much in 4 limbo . I don ' t like things being in limbo , so I just 5 really kind of took it upon myself to find out what was 6 going on . 7 Q . All right . So , would it be fair for me to 8 say that you told Chief Tyler in your office that there 9 was an issue? 10 A . There was an issue , I would say yes . 11 Q . With respect to the police department 12 investigation of the crime reported by Mrs . Hutensky? 13 A. I would say that is fair . 14 Q . That is a fair statement? 15 A . Yes . 16 Q . And, what was his response to that? 17 A. His response was that he had a police report A Q 18 that he did bring over and did go through and talked 19 about how they did everything possible that they W a ® 20 could . Who was there , that each officer had to file 21 their own report and found that he felt that basically 0 22 you know we followed every procedure that we felt was 23 necessary in order to get this case closed . And, there 24 was a lot of discussion with Mrs . Hutensky . I did 25 raise the issue up of could Mrs . Hutensky-- because 19 1 Mrs . Hutensky raised it to me , about a statement that 2 Detective Martin said . And I said why was-- well was 3 that said and the Chief said to me well we don ' t like 4 to have our department to be just police services , but 5 if we think there ' s issues or things that we are 6 concerned about that people should be helped in other 7 areas , you know we try to take care of it . 8 Q . To what statement of Mrs . Hutensky were you 9 referring? 10 A. Mrs . Hutensky said there was a statement mad 11 by Detective Martin about having some sort of disease . 12 I forget the name of it now. It escapes me . Starts 13 with an M. 14 MRS . HUTENSKY : Munchausen? 15 A . Mu something like that . I am not a medical 16 wiz here . So I may be a good town manager but I am no 17 a medical wiz . 18 MR. ARCIERO : Is Mrs . Hutensky going to 19 question the officer? Z W a ® 20 BY MR. CIAMPA: 0 21 Q. Do I understand you to say that you were told W 22 by the Chief of Police that the investigating officer s 23 told him, the Chief of Police , that he the 24 investigating officer thought that Mrs . Hutensky had a 25 disease? Is that what you just told me? t 20 1 MR. ARCIERO : Objection to the form of the 2 question . 3 A . No . What I think I am telling you is I 4 raised the issue to the Chief of Police , because Mrs . 5 Hutensky raised the issue to me . 6 Q . Would you tell me that again please? I 7 didn ' t follow what you said? 8 A. Mrs . Hutensky in our discussion of our forty 9 five minute discussion raised the issue to me that 10 Detective Martin had made that statement , I think in 11 the presence of her and her daughter . It might have 12 been something else . 13 Q . And what statement was that sir? 14 A. The statement of having some sort of disease 15 or something . Munchausen , whatever it is , disease . I 16 raised the issue to the Chief because Mrs . Hutensky 17 raised that issue to me . And I said you know, is they A 01 18 anything in Martin ' s report on this or something that- 19 why was that statement raised .. I raised the issue to Z W a ® 20 him. It wasn ' t that Detective Martin told the Chief . cr 21 I am just relaying to him my conversation with Mrs . 0 W 22 Hutensky . 23 Q . Did Chief Tyler reply to you in anyway to 24 this statement that you made? 25 A. Well we had a long discussion that is that a 21 1 part of the investigation we tried to close the cases 2 as much as possible . We tried to find everything 3 that ' s going on . And that he felt that there were 4 other maybe problems here . Maybe that ' s why the 5 officer had made this statement as part of his 6 investigation to say with the daughter that we have to 7 look at other issues here . We 've exhausted a lot of 8 the-- I guess there was , from what I understand from 9 the Chief , they checked out people who Mrs . Hutensky 10 told them to check . They did a lot of investigation . 11 They couldn ' t find any problems . So they thought that 12 maybe it was some other issues here that they felt 13 should be dealt with . 14 Q . So is it the case , Mr . Galligan , that in you 15 conversation with the Chief of Police in your office, 16 Chief Tyler told you that the police department had 17 performed the customary burglary investigation? Am I a 18 right so far? 19 MR. ARCIERO : Object to the form. W ® 20 A. They did an investigation . a g 21 Q . And that as a consequence of that LL 22 investigation they decided that Mrs . Hutensky was N S 23 mentally ill? 24 MR. ARCIERO : Objection to the form. 25 Q . Is that what he told you sir? 22 1 A . He didn ' t tell me she was mentally ill , no . 2 Q . As a result of the conversation with Chief 3 Tyler did you come away with the impression that Mrs . 4 Hutensky was mentally ill? 5 MR. ARCIERO : Objection to the form . 6 A . No , not mentally ill . That there was 7 possibly some other issues here that could have 8 caused-- 9 Q . Could you tell me the list of these other 10 issues that you felt were involved here? 11 A. Well he said the-- what was told to me was 12 that Mrs . Hutensky was recently divorced . And that she 13 maybe somewhat upset about that . And , there was some 14 discussions with her children about the effect of 15 that . That ' s the other issue . 16 Q . Discussions with her children by whom please . 17 A. I would imagine by it was by Detective 18 Martin . g 19 Q . Did the Chief of Police tell you that it was Z W a ® 20 an appropriate part of a burglary investigation to a 21 inquire about the victim' s relationships with her 0 F.C. 22 children? 23 A. He didn ' t say it was the normal procedure or 24 whatever, no . He just said he was looking at the 25 investigation . You look at a wide range of things whe 23 1 you can ' t get to the point of closing the case and you 2 are trying to find out where the activity is , and other 3 information comes across as you constantly investigate , 4 talking to Mrs . Hutensky , her children or other people , 5 whoever they talk to at that point , that may lead the 6 investigation into different areas . 7 Q . Was it your understanding as a result of your 8 conversation with the Chief of Police , that the police 9 department ' s focus was on Mrs . Hutensky ' s relationship 10 with her children and her mental state? 11 A. No . The focus and investigation was to find 12 out who was in the house and why they can 't find this 13 individual . 14 Q . What conversations did you have with Chief 15 Tyler about the police department ' s effort to find the 16 person who was in the house? 17 A. The only thing I know there was a lot of A m A 18 police officers there . I think it was Detective 19 Martin . I think he told me that the , I don' t know the Z W . ® 20 detective-- the officer' s name , but we do have a dog. a g 21 He was part of the investigation . And there was a , LL O W 22 maybe one or two officers in the house , but I don't 23 know their names . I don ' t have , you know, who they 24 were but I understand it was a couple of officers who 25 were working on this . But I guess Detective Martin ' s 24 1 was probably the lead dog in the case I would say . 2 Q . Following your conversation with Chief Tyler 3 in your office , which you have agreed probably happened 4 in the third week of June 1997 , what did you do to 5 follow up on the police department ' s investigation of 6 Mrs . Hutensky' s burglary? 7 A. Well basically after talking to the Chief he 8 had assured me that everything was provided , that the 9 information that he had , I was comfortable that the 10 police department did everything they could in its 11 investigation . And there was nothing further to 12 investigate after that . 13 Q . So , let me see if I can recapitulate what I 14 believe you told me this morning . First of all you had 15 a meeting in your office in the middle of June 1997 . 16 Am I right so far? 17 A. Un hun . A m N s 18 Q . You have to say yes or no? m 19 A. Yes . I am sorry . Yes . W a ® 20 Q . This meeting was attended by Mrs . Hutensky cc LL 21 and by a woman named Jacqueline Smith ; is that right as 0 W 22 well? 23 A . That ' s correct . 24 Q . Mrs . Hutensky told you about the issues that 25 she had with respect to the investigation conducted by 25 1 the South Windsor Police Department of a burglary of 2 her house . Is that right as well? 3 A. That ' s correct . 4 Q . As a result of that meeting , you made some 5 inquiries of the South Windsor Police Department ; is 6 that correct? 7 A. Police Chief , correct . 8 Q . You made those inquiries to the Chief of 9 Police? 10 A . Yes . 11 Q . You had the Chief of Police come to your 12 office? 13 A. That ' s correct . 14 Q . The Chief of Police told you that the police 15 department had investigated the burglary according to 16 their own standards? .g 17 A . Correct . 18 Q . The Chief of Police told you that they found 19 issues with respect to Mrs . Hutensky' s mental state? W a _ ® 20 MR. ARCIERO : Objection to the form. 21 A. Well that is not correct . What he said was LL O co W 22 that it was issues that she may be upset because of the 23 divorce she was going through . And things like that . 24 But it ' s not-- maybe emotional state . It would be 25 more , emotional state would be more accurate . 26 1 Q . Well in other words Mr . Galligan , Chief of 2 Police told you that Mrs . Hutensky made this up ; is 3 that what happened? 4 MR. ARCIERO : Objection to the-- 5 A. He never told me anything was made up . What 6 he said was they did their investigation and they 7 couldn ' t find the individual who was involved here and 8 there was some other issues upon the investigation that 9 came up , talking to other members of the family or 10 whatever , that led them to finish their investigation . 11 Never said it was made up . 12 Q . So is it the case then, Mr . Galligan , that 13 the Chief of Police told you that they had stopped 14 treating this as a residential burglary? Did he tell 15 you that? 16 MR. ARCIERO : Objection to the form . 17 A. No, I don ' t think he ever, he didn ' t say 18 that . What he said was that the investigation here was g 19 what they had . I couldn ' t even tell you if it ' s still W a ® 20 an open case or not . You would have to ask the Chief a f a 21 on that . I don ' t know what their records are . But m W 22 that they did everything they possibly could to find 23 the individual who was involved in this . They followed 24 up on every lead they could . They could not find them 25 and there was issues in their investigation that they 27 1 just couldn ' t , it was-- there was nobody there . They 2 couldn ' t find the person . 3 Q . Could you give me a list of the issues he 4 told you were in the investigation as you just 5 testified? 6 A . Well I guess there was individual names that 7 were mentioned that Mrs . Hutensky gave them who she 8 thought might have been , what would you call it , 9 appropriate suspect or a person involved or whatever, 10 in which they interviewed everyone of those 11 individuals . And I guess exhausted whatever they could 12 exhaust there . There was other things that she gave 13 them where they kept going back to Mrs . Hutensky' s and 14 ' asking her well is there anything else that you might 15 have seen , noticed or whatever . And they kept 16 following up on these things and they kept going back 17 asking more and more questions . And everything that 18 Mrs . Hutensy gave them was basically coming to a dead 19 end . Z W a ® 20 Q . Following your conversation with Chief Tyler 21 in your office , did you report the results of your 0 W 22 inquiries to Mrs . Hutensky? 23 A. No . 24 Q . Following your conversation with Chief Tyler 25 in your office did you report the results of your 28 1 investigation to anybody else? 2 A . No . 3 Q . Following your conversation with Chief Tyler 4 in your office what did you do? 5 A. Well I just , I didn' t really do anything . I 6 was satisfied with the investigation . Ms . Hutensky 7 asked me not to do anything until she would contact me 8 after she moved out of South Windsor , and felt at that 9 point when she called me I would let her know what I 10 .found out and she had those things with her and if she 11 wanted to pursue it she could always file a complaint 12 with the police department or through the town attorney 13 or the town clerk and say you know I want a formal 14 investigation and we would hire , well not hire , but 15 we ' d have what you call an internal review procedure, 16 have the town attorney take a look at that and see what a 17 he thinks in order to satisfy any questions that Mrs . 18 Hutensky would have . The next telephone conversation 19 that she did call me was that she told me she was Z W a ® 20 putting in a , suing the town . And at that point I said s 21 well you know-- she apologized for , she understand my 0 CO W 22 position in the town, and I said well you know-- you 23 have to do what you feel you have to do . And then I 24 didn ' t have any other conversation with her after that . 25 Q . I would like to come back to that 29 1 conversation with Mrs . Hutensky about suing the town . 2 But I just would like to follow up on your efforts to 3 contact the police department . 4 So , as a result of your conversation with 5 Chief Tyler in your office in June , were you satisfied 6 with the police investigation of the burglary reported 7 by Mrs . Hutensky? 8 A. The police investigation . What they have 9 done , yes I was satisfied with that . 10 Q . Sitting here today, do you continue to be 11 satisfied with the quality of the investigation done by 12 the police department of the burglary reported by Mrs . 13 Hutensky? 14 MR. ARCIERO : Objection to the form. 15 A. Yes . 16 Q . You talked about the next communication you a 17 had with Mrs . Hutensky . You said to me I think that it w 18 was a telephone call that she made to your office? s 19 A. I believe that ' s what it was . Z W . a ® 20 Q . And, you remember when that happened? g 21 A. Gantick, P.E., Director of Public Works Date: July 20, 2000 Re: Letter from Tom Munsell regarding Avery Street The section of Avery Street (Woodland Drive to Dart Hill Road) discussed in Mr. Munsell's letter has been the subject of much attention over the years. In the last 15 years there have been no less than eight subdivision projects accessing onto Avery Street between Woodland Drive and Dart Hill. In addition there have been several individual house lots developed that are also within this stretch of road. All these developments have included some form of either road widening and/or utility excavation within Avery Street - requiring patching. Along the stretch between Philip Smith School to north of the Avery Street pump station we had the area repaved last year. Just north of the intersection of Woodland Drive new drainage was installed and new curbing has been installed. Utility patches associated with Cutler Ridge Subdivisions I and II will be repaired after the required settlement period of one year. Additionally, Avery Street (from Beelzebub Road to Dart Hill Road) is scheduled for resurfacing (overlay) in 2001. Complete reconstruction of Avery Street is not likely in the short term. In the 1980's Avery Street was on a regional list to be considered for reconstruction, however resident opposition lead to the project being withdrawn from the list. Since that time federal/state funding has been redirected and committed to other projects to the point where several of our current projects have been delayed by several years. So even if Avery Street makes it back on the list, it could be 10 plus years before funding is available to undertake reconstruction of Avery Street. The spot improvements (drainage, widening and curbing) associated with some of the subdivision projects along with the Town resurfacing and drainage projects have, overall, improved the riding condition of Avery Street despite increased traffic. Enclosed are a series of pictures taken to,illustrate the condition of this area. 'These photographs are numbered on the reverse side and correspond to the, following: Photo#1 -A view facing south toward the Manchester line that illustrates the poor condition of the turnaround. The trap rock in the turnaround has not been replenished since originally put down in 1996. Photo#2-A close-up of the barricade that includes the walkway showing the concrete curbing pushed into the plantings from snow removal activity in past winters. It is difficult to distinguish the weeds from the plantings. Photo#3- This is the walkway between the barricades where water collects each time there is any significant rainfall. Silt from the surrounding area runs into the low spot and collects as well. Following rainy periods, discarded furniture found on the Manchester side of the barricade is frequently used to create a"bridge." This photo also demonstrates the scraggly condition of weeds and plantings in this area when not properly maintained. Photo#4-A view looking north from the barricade that serves to illustrate the uneven condition in the turnaround area and the proliferation of weeds. After these photos were taken in July of this year, town_equipment did"shred"some of the growth in this area at the request of a street resident. The shredding is only a temporary solution. These photos bear little resemblance to the`projected view"-of this site that was submitted to the Planning and Zoning Committee in 1996. We the undersigned residents of Slater Street request that steps be taken of a permanent nature to (1)deal with the"water buildup"that follows each heavy rain; (2)properly grade and pave the turnaround area;and(3)that ensure that plantings in this area be maintained on a regular basis. cc: Marianne Lassen_an Fisher, Mayor of South Windsor (w/o encls.) After hooking the water into the house, Mr.Jennings attempted to hook the sewer up to the house. Unfortunately,on October 191h the town closed the project down, due to the sewer lateral aiming downward and`sludge' from the neighbor's house, coming into my property. Mr. Jennings informed me that the town would have to have a contracting firm access and rectify the lateral before the project could continue. Mr.Fred Shaw of the Town Hall, informed me that bids would have to be ascertained from 2-3 contractors(Mr.Jennings being one of the bids)before a decision was to be made on the contractor to perform the necessary work. Mr. Jennings removed his equipment and some of the supplies,as he could not tie up his machinery at my house until a decision was made. Therefore, due to this shutdown, on October 30th in my screen door,he dropped off the attached bill. This has been faxed to Fred Shaw(in November),however I have not received a response. I had not heard from Mr.Jennings,as he was not the contractor the town elected to correct the lateral problem. I therefore, needed to have the project completed and had to obtain Gerber Construction(11-21-00),the contractor the town chose to have the lateral repaired, complete the sewer into the house. The attached bill from Gerber will indicate the project was completed and a charge of$3,000 was the fee. Today,I have received the attached paperwork for a lien of$6,355;$3,000 for the balance of Mr.Jennings contract(which I have attached)$3,355 for the additional costs due to shutting the project down(also attached). I do not feel I should be responsible for paying the$6,355 lien as I have already have had to pay Gerber Construction for the completion of the sewer. Could you please let me know what the town plans on doing, since now I have had a lien placed on my home, for an issue that was not created by me,a South Windsor taxpayer? We love our town and neighborhood, and because of that, we need to register our great concern over the sudden increase in truck traffic on Chapel Road. We spoke with you on a few different occasions over the past two months, as well as to the Police Department, Sergeant Tom Fields of the Traffic Division, and Mike Turk with Zoning. You told us that the Police Department was working on the situation. We appreciate the call, but unfortunately, there is no improvement. Eighteen-wheeler trucks continue to rumble down our road. As we explained to you,the trucks are going to C F, Central Auto and Transport on King Street next to the home number 574 driveway. They make a delivery and fifteen minutes later they are on our road rolling back to Route 5. Not only is our road narrow, it tilts toward our property, a fact we made known to the town several years ago, as our mailbox has been hit many times even by our own town dog warden and fire department. The trucks wake us up in the very early hours of the morning, and go back and forth several times a day. Our biggest concern is for safety. These trucks are a danger to everyone on our narrow street, especially our grandchildren and our neighbors'children. Please work to stop this dangerous situation. On October 17, 2000 1 contacted the South Windsor Police Dispatcher and asked,"Why the American Flag was not being flown at haft staff."The dispatcher seemed confused by my question and I asked, "If she was aware of the attack that had occurred on the U.S.S. Cole and the tragic loss of life that 17 sailors had faced."She said, "She was aware, but it was the responsibility of the Town Manager or the Chief of Police to direct the placement of the flag." I was not satisfied with this answer and next attempted to contact the Mayor. Mayor Lassman-Fisher was not available at the time and I related my concerns to her husband. He informed me that he believed that the town generally followed the State's lead in flying the flag at half staff. It was at this point I elected to wait until Monday morning to contact someone at town hall and express my concerns. On Monday your office in fact contacted me and apologized for the over site and told me it would be corrected. That afternoon I saw that the towns flags had been lowered to express the sorrow for the loss of our servicemen. Unfortunately I next noticed that the flag at the Foster Street fire house was still at full staff, so I contacted the Fire Chief and expressed my concern. On Wednesday 10/18/00, a national memorial service was held to honor the lost service men. It was a day set aside to grieve for these brave individuals and a day to remind all of us how thankful we should be for their sacrifice.A day to consider the people in our armed forces and to reflect on how fortunate we are to have them stand on guard for us, protecting our freedom and our way of life. The following day the flags flown at the federal and state offices and facilities where again raised to full staff. I am deeply disappointed that here in the Town of South Windsor our flags still fly at half staff. Twelve days following the memorial and no one in our town offices has even considered how we are displaying the towns flags. The flag is one of the most important symbols of country, it stands for the sacrifices made by many to maintain our freedom. I am appalled at the disregard this town shows in displaying our flag. Windsor, CT 06074 Sir. I am writing to protest, in the strongest terms possible, your performance in allowing the tax rate in this town to continually, time after time, escalate to the point where many people are forced to leave their long term residences In short, you and this town SUC'yy;,;UUUR N are guilty of age discrimination in its'purist form! The latest tax rate represents a 4.94% increase in taxes Said so blandly without a single regard for what it means to retired senior citizens. And if it isn't a tax increase, it becomes a reevaluation which, out of the other side of managers' mouths means, a tax increase!Every single year. I've been a town resident going on to 40 years Probably before you found out that you could earn a GREAT salary here because S. Windsor has to be the best of everything. We get there by paying the MOST for everything. Schools, Town Hall, Library, even the stone work along the streets but, especially, our illustrious school department with emphasis on the Taj Mahal of the state known as Timothy Edwards which requires busing to commute from one end to the other. Your title is Town Manager. Managing implies some discipline other than the ability to say `yes" to everything. The same goes for the Superintendent of Schools who is already working on adding another ten percent to next years budget knowing it will be cut to sir percent. He's played this game so long he has software to program the school budgets As a Town Manager, you OWE the town your utmost ability to manage and to act for the welfare of the town and I mean the ENTIRE town, not just the employed and the wealthy. I was a Manager for many years for United Technologies and adhered to a simple discipline. If anyone, myself included, could not do the job required to earn his/her salary, find someone that could! As a Manager, set your goal to allow no tax increases Then set your budgets with a directive to work within the established budget with the knowledge that, if the individual were found lacking, another was ready, willing and able to accept$100K and do the job within assigned guidelines Guess what? When you're retired, there is no appeal, When Medicare and HMOs' churn out higher and higher bills for less and less service, I can't go running to the Town Manager and ask for more money. I survive by the simple expediency of managing what money I have I set budgets and adhere to them. In short, I wish you were familiar with "The Guy in the Glass"which Parcells read to his players on his final day as the Jets coach. I'll cite a small example: "For it isn't your father, mother or wife Whose judgment upon you must pass The fellow whose verdict counts most in your We Is the one staring back from the glass" As a manager, make sure you can live with what you see in the mirror! I recently tried to book the pavilion at Never-,Park for a Taycee monthly membership meeting,at which we discuss the upcoming events that we will be running or taking part in. Projects that include the Wapping Fair,Family Awareness Day,n_Al2.E Spaghetti Dinner,Mini-Golf Tournament for the Teen Center, many donations to the human services department, and many more. in the past few years we have been able to nse the pavilion for our Augjst.meeting and our 5K Road Race at no cost to the chapter. At the August meeting our members get the chance to bring their families to a picnic before the meeting, This year for the first time ever we were told that there would be a$75 charge: I'm sad to say we didn't hold our membership picnic. I believe a charge of$75 for 3 hours of use is unreasonable, That.$75 can be used to run such projects like Santa Letters. The children send letters to Santa, and at NO cost to their parents letters are sent back to each and every child with each and ever question personally answered. This project like many others are funded solely by the chapter. At the present time we use rooms at the Community Center for our membership meetings. This has become a concern, for us regarding being charged for the use of rooms in the future. If so,this means that we will have to spend more on renting rooms and pavilions. Windsor Tel.: 644-3053 (H) A very pleasant gentleman; however, one who was quite concerned about the condition of Avery Street in several locations from Woodland Drive north to Dart Hill Road. He realized that there has been, and continues to be, a great deal of new homes built in this area. It was his opinion, however, that "builders" were leaving this section of Avery Street in a "deplorable condition" and should be made to be responsible for leaving the road in good travelling condition. He particularly noted the area between "Evans Crossing" and Philip R. Smith School. Mr. Munsel said he has lived on Stephanie Lane for 15 years; and one of the "drainage-type ditches" left open by a builder has been causing damage and spilling water out onto Avery Street every time it rains for at least 12 of those years. He felt that was "long enough." He also said he was a biker (bicycle) and, even though he was familiar with the conditions of this roadway, had taken a "nasty spill" recently because rainwater obscured one of the many poorly repaired "cuts" by builders along this portion of Avery Street. Mr. Munsel stated that all builders in the area should be made to leave "imperceptible" pavement cuts, etc. He said he would follow up this phone call with a written complaint sometime soon, but urged the Town to completely overlay this portion of Avery Street to make it safe and passable--particularly for those residents who lived in the immediate area, and had to use this road several times a day. As a small businessman myself,I do not feel this should be allowed in a residential area. Plus the yard looks like"Trash Valley",with over 50 junk lawn mowers under trees, bushes, and anywhere else they can be put. This is truly an eyesore that is hurting this community. I do not feel that this leaves a very good impression on out-of town people who drive by and see this. 1 1p 1 A$ TOR OWN OFSO Il WINDSOR 10WIY NMft : : i a . The week prior to July 4th, we were in the process of sealing our driveway in preparation for a large family outing we were hosting the following holiday weekend. Only a portion of the driveway was completed so we blocked it off at the street with a lawn rake, garage push broom and three cans of driveway sealer. One can of sealer was empty, another was partially filled, and the other was completely filled. The driveway sat that way for three days. On the third day, which was also garbage day, we came out in the morning to find all the items blocking the driveway missing. The broom, rake and cans were clearly separate from the three garbage cans and recycling container. A week or so later we called the Town Hall and was directed to the Director of Public Works (Mr. Gantick). After conversing with the Director of Public Works, who had presented our case to the garbage disposal people, offered the following explanation to US. 1. Since no one actually saw the garbage people remove it, it was our problem. 2. The garbage people would never take a filled or partially filled can of driveway sealer. 3. A lawn rake and garage push broom would not fit in the garbage truck. Our concerns with the Director of Public Works and the accuracy of his statements are as follows: 1. He would lead us to believe that the rake, broom and cans of sealer sat out there for three days and were then taken by someone on garbage day morning? And that the person(s) who took them wanted the can that was empty? 2. After completing the entire driveway we discarded three cans. One can still had material in it and the garbage people took them without issue a week or so later, but didn't on.the day in question? We would also mention, the last time we sealed the driveway a few years ago, we left the sealer in the garage where it froze over the winter and we discarded them the following spring without incident. 3. The statement that a lawn rake and push broom would not fit into a garbage truck, we will leave to your opinion. We are concerned on a couple of points. 1. The Director of Public Works promotes an environment that creates a confrontational environment between citizens of this town and the Garbage Disposal Company. This is not healthy and clearly not necessary. It is our understanding it is his responsibility to manage the garbage disposal process. 2. The Director of Public Works should use common sense in the arguments he uses as to why the Garbage Disposal people could not have possibly made an error. People make mistakes and we understand that. Overall we think the garbage disposal people do a credible job, and frankly leave that issue to the people who get paid to manage them. We are most upset at the cavalier attitude of the Director of Public Works. His attitude and posture was contrary to whom we believe he works for, which is the citizen's of this great Town. With all due respect, we may be simple people, but the arguments we were given would only make sense to someone simple minded. There is one other point, we would like to bring to your attention as well. A number of years ago, our then very young son told us the garbage truck had backed into our mailbox while turning around early one morning. We lived on Kent Lane when it was a cul-de- sac before moving to our present address. When we checked the mailbox, sure enough it was broken and cracked. We reported it, got a similar response from Town Hall and then replaced it at our expense and forgot about it. We do not recall who the garbage removal company was at that time. In short, we let it go. We don't intend to let this one go. We would therefore please request your assistance on the following: 1. Receive a check in the amount of$31.78, which represents the cost to replace the rake and broom only. We had enough driveway sealer to finish the job and then some. We expect the refund from the Town, not the garbage disposal people. It is our belief the town represents us in removing garbage, and we don't wish to get in the middle of the Town's issue with the disposal people. A receipt for the replacement broom and rake are attached. 2. We would like to be advised as to when the budget review process occurs for the Public Works Department. We will assume if we have not heard from the town within the next two weeks, the Town has no wish to rectify the situation, in which case we will be pursuing the matter in small claims court. Thank you for your great service to the Town of South Windsor and your assistance on this matter. I am also sending your letter to the Police Department to reinvestigate the CF, Central Auto and Transport on King Street, to see if we can facilitate a cooperative effort to have those trucks go in a different area. There was a NU-METRICS Traffic Analyzer Study done on that particular area, which I have also enclosed for your review. Although this does not really help at this point, I will refer this to the Police Department for further review, based upon the information provided in your letter. As soon as this is checked out, we will proceed with some solution to the traffic problem on Chapel Road. Unfortunately, we have no legal recourse to keep truck traffic out of public streets per Connecticut State Statutes. We are currently studying this issue with the Legislature. We would like the Town to be able to control its traffic patterns throughout the local community. I thank you for your patience and understanding in this matter. Very truly yours, Matthew B. I spoke to employees of Hartford Trucking on Mcguire Road. This is the only known business where truck traffic goes to on a regular basis. They stated that the directions they give to people to get there are to take Burnham Street to King Street to McGuire Road. They also stated that the only truck traffic they get is pickup trucks, and large commercial trucks do not frequent their business on a regular basis. I spoke to G. King, the owner of some property along McGuire Road. He stated that there is a company that uses storage space there, but they only deal in produce, and had a bad season. He stated that the activity is very infrequent from truck drivers in that area. He stated that East Hartford recently posted a sign that prohibits trucks in excess of 7000 pounds and cited that as a possible reason for an increase in truck traffic: 1 set up traffic counters along Chapel Road west of Rt. 5. I am a reside at of the Town South Windsor and I live in the newly developed subdivision of Chase Orchards. My first issue relates to the streetlights within our subdivision, It is my understandirAg t19at the Position of the Town of South Windsor i8 that tlac puwcr supplied to those lights is the responsibility of the builder. Purthertnore, the Tovm contends that responsibility of providing power to those lights does not convey to the Tnu fi,rrttil the roads have be.c-u apprQvoct,dvt;vpte-d,cettitfied or whatever other construction jargon that may apply. As of last evening,we still Dave.no lights in our subdivision. I find this position to be ridiculous to say the, test. My second 'issue relstr.s to our attempt to hQ-" 30mc caution signs installed ou our street, Today, rray Wife spore to Sgt,Tom,Field to request that signs alerting drivers to the presence of children be installed. She made him,,aware that tl,p vehicles that drive down our road ate being driven at excessive speeds, obviously resulting in a danger to the children ira the community. The vehicles, normally construction vehicles, race from the Chase Orchards subdivision, down Ti nibull I One into the adjoirung construction area. To say that Sgt.Tom Field responded in a rude and belligerent manner would be an understatement, He rudely stated that he WoT UT)riot do anything to a3sist. no e Ile stated 4l Esc there is speed limit and until the roads axe approved, accepted, certified, etc. by the Town, lie was other is obligation to provide any signs. When lily wife sugga..qtP.d that we should iriour the c patx6e Df uuytirg and installing signs,he proceeded to quote the ordinance related to the size and shape of signs. He further stated that if people are speeding,we should keel]our daughter mit of the street. First,I,e ltkc tQ Gi7Jittttld1 Sgt.Field for havir.,g the ability to read the ordinance on the size and shape of a sign. Secondly,I am thoroughly disappointed at the}lack of concern for public safety, the di.grespeet shown.t.D a taxpayer and tl.ic complete"I don't give a damn attitude that my wife received fiorn this public servant. Given these two situations,I would like a formal response form the Town of South Windsor. I would like to know if it is truly your position that the Town has no responsibility to provide lighting to the subdivision. I would like to know if it is holy your position that public safety is not the Town's responsibility at this time. I would like to know if it is acceptable to drive in a manner drat is dangerous iu air urea where taxpayers live. 1 would like to know what other services=y be withheld(i.e.k`olicc,fire, etc,)I would like to know if the definition of public service is epitomized by the likes of Sgt.Field. I'iaaally,if it is the Town of South W irtasor's position that the responsibility for our subdivision rests entirely on the builder,I would like a prorated mill rate:to be applied to my tax calculation that reflertc that limited sea-vice tlAat.I receive from the'10'wu of South Windsor. At the current rate,I will pay nearly S 10,000 in taxes.
